How to apostilize (legalize) documents

If you plan to study or work abroad, you may be required to apostilize/legalize some of your personal documents, i.e. certify their authenticity and give legal effect in a foreign country.

In this material we will talk about apostilization, legalization of documents and how they are drawn up.

How to apostilize documents from prosecution, investigation and inquiry bodies

In order to apostilize official documents coming from prosecution, investigation and inquiry bodies, it is necessary to come to the branch of NJSC GC "Government for Citizens". (PSC), bearing the following documents:

  • ID card;
  • a receipt for the payment of state duty (0.5 MCI);
  • original of the document to be apostilled.

After filing an application with the Central Election Commission, you will receive the apostille document within 5 working days.

A certificate of criminal record or lack thereof may be apostilled on the basis of a single application (composite service):

  • submit an application via the online service;
  • pay the state fee online through the e-Government Payment Gateway (eGAP);
  • choose the address of the CA on the portal to get the result of the composite service in paper form.

The certificate of criminal record with an apostille is issued for submission only to the Hague Convention countries.

You will receive an apostille certificate of criminal record or no criminal record within 10 (ten) working days at the PSC whose address was selected on the portal.

However, if there is a need for additional verification of information, this period may be extended to 20 working days (you will be sent an interim response) from the moment of to receive the service provider's application.

Also, according to the principle of "one application", an archival certificate can be apostilled (the state service "Issuance of archival certificates and/or copies of archival documents within the archives of the Committee and its territorial bodies"). An apostilled archival certificate is issued within 13 (thirteen) working days at the PSC whose address was selected on the portal.

 

What is the difference between apostilizing documents and their consular legalization?

Personal documents of a citizen of Kazakhstan, which for various reasons should be used on the territory of another state, require authentication, i.e. preservation of legal force.

There are two concepts that describe this procedure - apostille and legalization of documents.

Apostille

Apostille, i.e. stamping "apostille", is a simplified legalization of documents among countries that have acceded to the Hague Convention.

Simplified such procedure is called precisely because, on the one hand, apostilization is carried out rather quickly and only by one authorized body, and, on the other hand, the document becomes legally valid in the territory of all countries acceded to the Hague Convention.

Document legalization

Legalization of the document is necessary if the country to which you are preparing the document is not a party to the Hague Convention. This is a more complicated procedure, which includes document certification in the bodies of the Ministry of Foreign Affairs of the Republic of Kazakhstan, and then in the accredited diplomatic mission of the country of destination in the Republic of Kazakhstan. In this case, the document will have legal force in the territory of only the country whose consulate is marked on it.

On March 8, 2023, the People's Republic of China joined the Convention Abolishing the Requirement for the Legalization of Foreign Official Documents, done in The Hague on October 5, 1961. The Convention entered into force with respect to the PRC on November 7, 2023.

Since the entry into force of the convention, official documents issued by China for use in Kazakhstan no longer undergo the procedure of consular legalization, instead additional certificates (apostille) will be issued.

The Convention will continue to apply to the Hong Kong Special Administrative Region of the PRC and the Macao Special Administrative Region.

How to apostilize archive certificates and documents from the archives of the Ministry of Defense and Ministry of Internal Affairs of the Republic of Kazakhstan

In order to apostilize archive certificates and copies of archive documents coming from the Central Archive of the Ministry of Defense of the Republic of Kazakhstan, it is necessary to come to the branch of NJSC SC "Government for Citizens" (PSC), bearing the following documents:

  • ID card;
  • receipt of payment of the state duty (0.5 MCI).

After submitting an application to the PSC, you will receive the apostilled document within 15 working days.

In order to apostilize archive certificates and copies of archive documents coming from the special state archive of the Ministry of Internal Affairs of the RK and its territorial subdivisions (service provider), you need to apply to:

  • the office of the service provider;
  • branch of NJSC GC "Government for Citizens" (PSC).

It is necessary to have the following documents with you:

  • an identification document, a document confirming authority, or a notarized power of attorney, when representing the interests of the service recipient by a third party;
  • archival certificate and (or) copies of archival documents issued by a special state archive, on which an apostille stamp must be affixed;
  • a document confirming payment of state duty to the budget (0.5 MCI).

After submitting an application to the PSC or service provider, you will receive the apostille document within 10 (ten) working days.

Document legalization

If the country to which you are preparing the document is not a party to the Hague Convention, you need to legalize the documents.

It is carried out:

Legalization of documents is the establishment and certification of the authenticity of the official's signature and seal on documents with the purpose of using them in another state.

In order to legalize documents, an application in any form shall be submitted to the Consular Service Department or a foreign office with the following documents attached:

for an individual:

  • a copy of the identity document (original for verification) or an electronic document from the digital documents service (for identification);
  • a document subject to legalization;
  • a document confirming the payment of the consular fee;
  • a copy of the document confirming the authority (the original for verification) (when submitting documents by a legal representative or an authorized person by proxy on behalf of the owner of the legalized document).

for a legal entity:

  •  a copy of the identity document of the authorized person (original for verification) or an electronic document from the digital documents service (for identification);
  •  a document subject to legalization;
  •  the original document confirming the payment of the consular fee.
  •  information from the electronic government information system confirming the state registration (re-registration) of a legal entity or another document confirming the legal capacity of a legal entity (for foreigners);
  •  a copy of the document confirming the authority (the original for verification) (when submitting documents by a legal representative or an authorized person by proxy on behalf of the owner of the legalized document).

Originals of documents as well as their notarized copies are accepted for legalization.

Legalization of documents is carried out within 3 working days from the moment of application submission, and in case of necessity of additional study or check, the term can be extended not more than for 30 calendar days.

How to apostilize official documents from the judiciary

To apostille official documents originating from the judicial authorities, you need to come to the branch of the NJSC SC "Government for Citizens" (PSC), or submit an application through the online service of the e-government web portal.

When submitting an online application, you must attach scanned copies of a document originating from the judicial authorities submitted for apostille; a document confirming the change of the service recipient's full name (if the change occurred before 2008), pay a state fee of 0.5 MCI for each apostille document there and sign the application with your EDS, after which You will receive a notification about the application processing within 1 business day.

On the date and time set in the notification, you need to visit the Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan or its territorial bodies in regions, cities of republican significance and the capital, having the following documents with you: 

  • an identity card or an electronic document from the digital documents service (for identification);
  • the original of the apostilled document.

When applying for apostille in the PSC, you need to have the following documents with you: 

  • an identity card, or an electronic document from the digital documents service (for identification);
  • a receipt for payment of the state fee (0.5 MCI);
  • the original of the apostille document.
  • a notarized power of attorney (in the case of a representative of the service recipient);
  • a copy of the document confirming the change of the service recipient's name and surname (if the change occurred before 2008).

How to apostilize documents from justice authorities (marriage, birth certificates, etc.)

The official documents originating from the judicial and other state bodies, as well as notaries of the Republic of Kazakhstan can include, for example, a birth certificate, marriage, divorce, documents and certificates of real estate, etc.

To apostilize them, you need to come to the branch of NJSC SC "Government for Citizens" (PSC) or apply through an online service.

When submitting an online application, you must attach a scan copy of the document to it, there to pay a state fee of 0.5 MCI and sign your EDS application, after which you will receive a notice of processing the application within 1 working day.

The result of the provision of public services is a scanned document and an electronic apostille stamp. The service can be checked in the personal account of the portal "electronic government", from the email address (specified by the applicant) or from the mobile application "eGov mobile". Under the stamp of the electronic apostille, a link to the address of the electronic page of the state body is indicated.

The electronic service can also be checked on the portal of "electronic government" in the tab "Verification of the apostille stamp in the Electronic Register".

At the same time, the authorized body of a foreign state can check an electronic document with an electronic apostille stamp by clicking on the link "Check an apostille stamp in the electronic register".

At the same time, the countries of Jamaica, the Republic of Singapore, the Republic of Indonesia and Chile should be added to the list of participating countries that have acceded to the Hague Convention.

When submitting an application for an apostille in the PSC, you should have the following documents with you:

  • ID card;
  • receipt of payment of the state duty (0.5 MCI);
  • original of the apostille document;
  • notarized power of attorney (in case of a request from a representative of the service recipient);
  • a sample of the signature and seal of the issued documents by other state bodies.

You will receive the apostilled document within 2 working days, however, if you need additional verification of documents, this period can be extended to 30 calendar days.

How to apostilize information from state archives

To apostilize archive certificates, documents, extracts and their copies, it is necessary to come to the branch of NJSC SC "Government for Citizens" (PSC) or apply through an online service.

How to apostilize educational documents

To apostille documents on higher and (or) postgraduate education (diploma), you need to come to the branch of NJSC SC "Government for Citizens" (PSC) or apply online via the e-government web portal.

Recognition of documents on higher and postgraduate education

To recognize documents on higher and (or) postgraduate education (diploma), you need to come to the branch of the NJSC SC "Government for Citizens" (PSC) or apply through the portal "electronic government" (temporarily unavailable).

Recognition of educational documents is an official confirmation of educational documents issued by foreign educational organizations, including their branches, as well as scientific centers and laboratories. Recognition of educational documents is provided by the Republican state Enterprise on the right of economic management "Center of the Bologna Process and Academic Mobility". Recognition of documents on education is carried out in accordance with the current legislation of the Republic of Kazakhstan and is carried out by establishing the authenticity of the document on education, establishing whether the educational organization (scientific center, laboratory) that issued the document on education has the right to carry out relevant educational activities at the time of its issuance, conducting an expert assessment if necessary.

The term of consideration of the application for recognition of legalized or apostilled educational documents is:

- when contacting through the portal-15 (fifteen) working days

- when contacting the divisions of the State Corporation -20 (twenty) working days.

The term of consideration of the application for recognition of illegal and unposted educational documents is:

- when applying through the portal/State corporation -30 (thirty) working days

The term of consideration of the application for recognition of legalized or apostilled diplomas of academic degrees is 20 (twenty) working days.

How to apostilize documents from structural divisions of the Ministry of Finance of RK

To apostilize documents coming from structural subdivisions of the Ministry of Finance of the RK and its territorial bodies, it is necessary to come to a branch of NJSC SC "Government for Citizens" (PSC) or to the territorial bodies of the State Revenue Committee of the MF RK, having the following documents with them:

  • ID card;
  • receipt of payment of the state duty (0.5 MCI);
  • original of the apostille document;
  • notarized power of attorney (in case of a request from a representative of the service recipient).

After submitting an application to the PSC, you will receive the apostilled document within 3-5 working days.

Which documents can be apostilled

You can apostille the following types of documents:

  • Official documents originating from the bodies of justice, civil registration and other state bodies, as well as notaries;
  • Education documents;
  • Official documents issued by the structural divisions of the Ministry of Finance of the Republic of Kazakhstan;
  • Official documents issued by the Prosecutor's Office, investigation and inquiry bodies;
  • Official documents originating from the judiciary;
  • Archival certificates, extracts from the state archives of the Republic of Kazakhstan, as well as their copies;
  • Archival certificates, documents from the Central Archive of the Ministry of Defense of the Republic of Kazakhstan, as well as their copies;
  • Archival certificates, documents from the special state archive of the Ministry of Internal Affairs of the Republic of Kazakhstan, as well as their copies.
