What kind of documents to prepare

After the successful interview and the consent of the employer to hire you, there is a need to collect a standard package of documents for the conclusion of the employment contract.

An employment contract is a written agreement between an employer and a candidate under which the employer undertakes to provide the employee with a certain job, ensure working conditions and pay full salary in due time, and the employee undertakes to perform this work and comply with the internal work regulations of the organization.

The employment contract is drawn up in two copies, each of which is signed by both parties. One copy is given to you, the other is kept with the employer.

Necessary documents for conclusion of an employment contract:

  • identity card or passport (birth certificate for persons under 16 years of age); ethnic kazakh presents a ethnic kazakh certificate issued by local executive bodies;
  • residence permit or certificate of statelessness (for foreigners and stateless persons permanently residing on the territory of the Republic of Kazakhstan or a refugee certificate.
  • a document confirming work activity (for persons with work experience);
  • a document on the passage of a preliminary medical examination (for persons obliged to undergo such an examination in accordance with this Code and other regulatory legal acts of the Republic of Kazakhstan).

To conclude an employment contract in the field of education, upbringing, recreation and recreation, physical culture and sports, medical support, social services, culture and art with the participation of minors, a person submits a certificate of the presence or absence of information about the commission of a criminal offense: murder, intentional harm to health, against public health and morality, sexual immunity, extremist or terrorist crimes, human trafficking.

When a person enters a civil service position related to the performance of functions equated to state ones, or to work in a quasi-public sector entity, the employer requests information about the commission of a corruption crime against this person through the information systems of a state body that carries out activities in the field of state legal statistics and special accounting within its competence, or a web portal of "electronic government".

State program "With a diploma to a village"

By the decision of the Ministry of National Economy of the Republic of Kazakhstan, from April 1, 2023, Otbasy Bank was appointed as an attorney agent of the program "With a diploma – to the village!".

This program provides for the issuance of loans for the purchase or construction of housing and the payment of a lifting allowance.

In order to save citizens' time and speed up the process of obtaining state support for them, the program "With a diploma – to the village!" has been digitized. New applications from Kazakhstanis will be accepted online on the real estate portal otbasybank.kz.

To apply for participation in the program "With a diploma – to the village!", you need to register on the otbasybank portal.kz and sign the application using EDS.

Kazakhstanis of any age can participate in the program. The main thing is that they have a diploma and work in the countryside in a number of professions. These are specialists in healthcare, education, social security, culture, sports, agro-industrial complex, civil servants of the akims of rural districts (with the exception of akims and deputy akims).

District akimats and akimats of cities of regional significance annually form a list of workers in demand in their locality from the above-mentioned specialties. And it is within this list that state support will be provided.

The maximum loan amount is up to 1500 MCI. The interest rate on the loan is 0.01% (GESV – from 0.01% per annum).

The loan is issued for the purchase or construction of housing in the locality where the specialist works. The maximum loan term is 15 years. The main condition is that the participant of the program must work in rural areas in the specialty for 3 years.

It will be possible to apply for benefits and for a budget loan at the same time.

Now these loans within the framework of the project "With a diploma – to the village" will be serviced in Otbasy Bank. Therefore, Kazakhstanis who have these loans need to become customers of the bank in order to repay payments in a timely manner and in the future not to have delays or accrual of penalties.

Having become clients of the bank, they will also, without any changes in the terms of the loan, continue to pay for it.

There are several ways to become a bank customer:

  • download the Otbasy bank mobile app and use it to open a current account and deposit;
  • call for free from a mobile phone to the number 300;
  • contact the nearest bank branch or consulting center.

Within the framework of the project "With a diploma – to the village", Kazakhstanis can also apply for the payment of a lifting allowance in the amount of 100 MCI. It will also be possible to apply for this type of state support through the platform otbasybank.kz.

Social allowances in case of loss of employment

Social protection is provided in the form of social benefits in case of job loss at the expense of the "State Social Insurance Fund", subject to participation in the compulsory social insurance system.

 The right to receive social benefits arises from the date of registration of a participant in the compulsory social insurance system as an unemployed person.

To obtain the status of an unemployed person, it is necessary to be registered as a job seeker. This service is proactive, that is, there is no need to submit applications, the service is provided on the initiative of the service provider. The service is provided within two business days.

The social payment is assigned from 1 to 6 months, depending on the length of service in the system.

The amount of the payment is 45% of the average monthly income from which social contributions have been paid over the past 24 months.

What do you need to know if you get fired or get cut

In accordance with Article 131 of the Labor Code of the Republic of Kazakhstan, the employer makes compensation payments in connection with the loss of employment, in the amount of the average monthly salary upon termination of the employment contract at the initiative of the employer in case of liquidation of the employer, termination of the employment contract at the initiative of the employer in the event of a reduction in the number or staff of employees, termination of the employment contract at the initiative of the employee in the event of failure by the employer to comply with the terms of the employment contract.

The employer makes compensation payments in connection with the loss of employment upon the termination of the employment contract at the initiative of the employer in the event of a decrease in the volume of production, work performed and services provided, which caused the deterioration of the economic state of the employer, in the amount of the average wage for two months.

According to Article 96 of the Labor Code of the Republic of Kazakhstan, upon termination of the employment contract, an employee who has not used or used not fully paid annual labor leave is compensated for the unused days of paid annual leave, which is calculated from the calculation of average wage of the employee.

All payments must be made no later than three working days after its termination.

In case of violation of their labor rights, the employee has the right to apply to the local executive body for labor inspection.

What people with disabilities need to know

Persons with disabilities have the right to freely choose their type of activity, including work, as well as vocational training and retraining.

It should be noted that currently the presence of a disability group is not an indicator of a person's ability to work or disability. The fundamental factors in the employment of persons, including those with disabilities, are their qualifications, professional competence, and the absence of medical contraindications for performing professional duties.

Thus, persons with disabilities, regardless of the category of disability group, have the right to work, if they are not contraindicated by the type of work according to the medical opinion of specialists of healthcare organizations.

To date, in accordance with the Social Code of the Republic of Kazakhstan, the practice of ensuring the employment of persons with disabilities includes the provision of intermediary services for employment through employment agencies, job quotas, the creation of special jobs for persons with disabilities, short-term training in skills in demand on the labor market, the provision of irrevocable grants, microcredit for youth, and also, referral to subsidized jobs, where they have a preferential right.

Local executive bodies ensure the implementation of state policy in the field of employment by establishing a quota of jobs for persons with disabilities in the amount of 2% to 4% of the number of jobs, excluding jobs in heavy jobs, jobs with harmful, dangerous working conditions.

The quota is set by local executive bodies for organizations with a list of employees:

- from 50 to 100 people – in the amount of 2% of the list number of employees;

- from 101 to 250 people – in the amount of 3% of the list number of employees;

- over 251 people – in the amount of 4% of the registered number of employees.

At the same time, since 2018, taking into account international experience, the procedure for subsidizing the costs of employers associated with equipping a special workplace for LSI employment has been introduced.

Subsidies are provided to employers in order to reimburse the costs of purchasing, installing and installing equipment for equipping special workplaces.

In addition, for persons with disabilities employed in special jobs, the state subsidizes wages in the amount of 60 to 70% for three years.

Active measures to promote employment

Currently, job security is being implemented as part of active employment promotion measures, which includes support for entrepreneurial initiatives, job subsidies and short-term vocational training.

Unemployed citizens who face difficulties in finding work can receive employment support depending on their individual needs.

To solve the problem of lack of work experience after graduation from an educational institution, a "Youth practice" is organized.

It also provides for the career development of young people through the transfer of experience and skills of people of pre-retirement age to young professionals within the framework of the Generational Contract project.

An important measure in partnership with employers is the targeted support of NEET youth in overcoming barriers to employment. The employment of this category of youth is carried out through the implementation of the "First Workplace" project.

At the same time, the Silver Age project is provided to encourage employers to employ people of pre-retirement age.

In addition, public and social workplaces are organized to provide temporary employment, which do not require prior professional training and work experience.

Today, the entire process of providing job subsidy services is fully automated through the portal of the Electronic Labor Exchange (enbek.kz).

Citizens from socially vulnerable segments of the population who want to start their own business can be trained in the basics of entrepreneurship under the Bastau Business project online through the skills.enbek platform.kz, and after completion, the trained have the opportunity to receive a grant of up to 400 MCI to open or develop their business.

Grants are mainly given for the purchase of inventory, technological equipment, tools, livestock and birds. Thanks to this, new sewing workshops, bakeries, beauty salons, dairy and other industries are opening.

The development of workforce skills is carried out through training in demanded skills in training centers at the request of employers, on-the-job training with a mentor for up to 3 months and subsidized wages, as well as online training in demanded skills on the Skills Enbek platform (skills.enbek.kz).

These short-term training measures provide citizens with opportunities to improve their skills and gain in-demand skills in the labor market for subsequent employment.

At the same time, a mechanism is being implemented for micro-crediting young entrepreneurs on preferential terms for up to 5 or 7 years with an interest rate of no more than 2.5 percent per annum.
