  1. Obtaining a guarantee from the Housing Construction Guarantee Fund;

  2. Participation in a project financed by a second-tier bank;

  3. Attracting funds after completion of the structural framework of the residential building.

Any other methods of attracting funds are prohibited.

- placement of advertisements without the required permit.

Violators may be subject to administrative penalties, including fines and other enforcement measures.

Legislative Amendments to Strengthen Regulation

The Ministry of Industry and Construction has developed legislative amendments aimed at enhancing state oversight of shared-equity housing construction. The amendments include:

  1. Prohibition of preliminary sale and purchase agreements for residential units in buildings under construction.

  2. Increase in administrative fines for the unlawful attraction of funds from shared-equity participants (from 300 to 2,000 Monthly Calculation Indices (MCI)).

  3. Prohibition of advertising shared-equity housing projects without a permit to attract funds.

  4. Inclusion of low-rise residential construction within the scope of the Law of the Republic of Kazakhstan "On Shared Participation in Housing Construction."
