Documents required for submission to "Government for Citizens" Public Corporation":

- For an individual by notarized power of attorney.

1. Application for the provision of public services for entering into the information system of the legal cadastre of identification and technical information of buildings, structures and (or) their components for newly created real estate.

2. ID card of the applicant (natural person), and an authorized representative of the applicant (the original is available for identification of the applicant) and a copy of the document confirming powers of the representative of the applicant.

3. Certificate of acceptance of the real estate object in operation for the newly constructed real estate object and (or) the identification document for the land plot.

4. Document confirming payment according to the Prices of goods (works, services).

1. Application for a conclusion on the establishment of discrepancies between identification and technical information based on the results of a technical survey of a newly created real estate object.

2. ID card of the applicant (natural person), and an authorized representative of the applicant (the original is available for identification of the applicant) and a copy of the document confirming powers of the representative of the applicant.

3. Title document for the real estate object with the attachment of the identification document for the land plot, if available.

4. Document confirming payment for issuing technical passports, except for payment made through payment gateway provided in two stages:

  • when submitting an application for the provision of public services, payment is made in the form of the basic cost of the service for the state technical inspection of a real estate object according to the Prices of goods (works, services);
  • when receiving the result of the state service, a full payment (surcharge) is made for the work performed on the state technical inspection of the real estate object according to the Prices of goods (works, services).

If you apply for a technical survey of the apartment, Dorm rooms and built-in premises, the identification document for the land plot is not provided.

Government for citizens
Legal entities

Documents required for submission to "Government for Citizens" Public Corporation":

- For a legal entity under a document confirming authority:

1. Application for a conclusion on the establishment of discrepancies between identification and technical information based on the results of a technical survey of a newly created real estate object.

2. ID card of the applicant (natural person), and an authorized representative of the applicant (the original is available for identification of the applicant) and a copy of the document confirming powers of the representative of the applicant.

3. Title document for the real estate object with the attachment of the identification document for the land plot, if available.

4. Document confirming payment for issuing technical passports, except for payment made through payment gateway provided in two stages:

  • when submitting an application for the provision of public services, payment is made in the form of the basic cost of the service for the state technical inspection of a real estate object according to the Prices of goods (works, services);
  • when receiving the result of the state service, a full payment (surcharge) is made for the work performed on the state technical inspection of the real estate object according to the Prices of goods (works, services).

1. In the Public Corporation - act of acceptance of the real estate object into operation with a note on entering into the information system of the legal cadastre of identification and technical information of buildings, structures and (or) their components for the newly created real estate. Conclusion on the establishment of discrepancies in the identification and technical data of newly created real estate with the attachment of a technical passport or a written reasoned response to the refusal to provide public services.

2 - On the portal - the service recipient is sent a notification to the personal account about the readiness of the result of the state service, indicating the place and date of receipt. Electronic technical passport for the apartment, a room in the dormitories, individual garages and garden buildings. The conclusion on the establishment of discrepancies between the identification and technical data of newly created real estate based on the results of the technical survey is issued in the form. Thus the Conclusion about establishment of the differences of identification and technical information, the newly established immovable property according to the results of technical survey with the application of the technical passport of the immovable property) issued by the provider of the document confirming payment for the issuance of conclusions from the application of technical passport of real estate, and at the conclusion of the contract for services with legal entities, also provided with a signed certificate of completion.

Grounds for refusal to provide the public service established by the laws of the Republic of Kazakhstan
  1. Establishing the unreliability of documents submitted by the service recipient for the receipt of the public service, and (or) the data (information) contained therein.
  2. If in relation to the service recipient there is a court decision (verdict) that has entered into force on the prohibition of activities or certain types of activities that require the public service receipt.
  3. If in relation to the service recipient there is a court decision that has entered into force on the basis of which the service recipient is deprived of a special right related to the public service receipt.
  4. The absence of the consent of the service recipient, provided in accordance with Article 8 of the Law "On Personal Data and Their Protection", to access restricted personal data required for the provision of public services.
Grounds for institution of an administrative procedure
  • appeal;
  • initiative of an administrative body or official.

 General requirements for the appeal

The appeal submitted in hard copy or electronic form shall indicate:

  • Full name, IIN, postal address of a natural person, BIN of a legal entity;
  • name of administrative body, official to whom the appeal is submitted;
  • the essence of an appeal;
  • date of filing an appeal;
  • signature of the applicant or his representative;
  • other information provided for by legislation of the Republic of Kazakhstan.

If the administrative procedure is on a paid basis, the applicant must submit a document confirming the payment.

! It is barred to reject the receipt of an appeal.

  1. Once the appeal is submitted, the applicant is issued a receipt containing a unique number, indicating the date and time, last name and initials, and the position of the person who received the appeal.
  2. In the case of non-compliance with the requirements established by Article 63 Code, the administrative body and the official shall indicate to the applicant the requirements the appeal does not comply with, and set a reasonable time limit for bringing it into compliance with the requirements.
  3. Before a decision is made on the administrative case, the applicant may withdraw the appeal on the basis of his written application.

Referring the appeal to an authorized administrative body and official

An appeal received by an administrative body and official whose authority does not include the consideration of this appeal, within no later than 3 working days from the date of its receipt shall refer it to the authorized administrative body and official, with simultaneous notification of the participant in the administrative procedure.

  1. The timeframe of administrative procedure is 15 working days from the date of receipt of an appeal.

! The laws may set the other timeframe for consideration of appeals (For example, according to the Law “On Access to Information” a reply to a written enquiry is provided within fifteen calendar days from the date of receipt of the information by the owner).

  1. The period of administrative procedure may be extended by a reasoned decision of the head of the administrative body for not more than 2 months, consistently the participant in the administrative procedure is notified within 3 working days from the date of extension.

A participant in the administrative procedure has the right to file a complaint the administrative action (inaction) related to the adoption of an administrative act.

If an administrative body and official within the timeframe has not adopted an administrative act or committed an administrative action, then commencing from the date of expiry it is considered that the administrative body and official rejected to adopt the administrative act or commit the administrative action.

The complaint is submitted to the administrative body and official whose administrative act and administrative action (inaction) is being appealed.

An appeal to the court is allowed after a pre-trial appeal. If the law provides for the possibility of going to court without the need to appeal to a higher authority, the administrative act, administrative action (inaction) of the administrative body and official is being disputed, along with the revoke, submit to the court a reasoned position of the head of the higher administrative body and official.

! The Administrative Procedure Code not always rules the procedure of complaint; the industry laws may contain statutes indicating the appeal of the decision in the court, without pre-trial appeal.

  1. A complaint against an administrative act, administrative action (inaction) is submitted to the administrative body and official no later than 3 months from the day when the participant in the administrative procedure became aware of the adoption of the administrative act or the commitment of an administrative action (inaction).
  2. If the deadline is missed for a good reason, at the request of the participant in the administrative procedure, it may be renewed by the body considering the complaint.
  3. Missing the deadline for submitting the complaint is not a basis for rejection to receive the complaint by the body considering the complaint.

! Other laws may establish a special procedure and deadlines for appealing the decisions.

The period for consideration of the complaint is 5 working days from the date of receipt of the complaint.

! Other laws may establish a different period for appealing the decisions of administrative bodies.

The fee for a public service is determined in accordance with the Prices of goods (work, services) produced and (or) sold by the «State-owned corporation «Government for citizens» NJSC.

Срок оказания услуги

The day of receipt of documents is not included in the time period for the provision of public services.

1. Entering into the information system of the legal cadastre of identification and technical information of buildings, structures and (or) their components for newly created real estate - 1 working day.

Issuance of an Opinion on the establishment of discrepancies in the identification and technical data of newly created real estate based on the results of a technical survey with the attachment of the technical passport of real estate:

  1. For appartments, rooms in dormitories are given on the 3 working day.
  2. For individual residing houses, individual garages, countryside constructions are given on the 5 working day.
  3. For other objects of real estate with total area up to 1000 square meters are given on the 7 working day.
  4. For the objects with total area more than 1000 squar meters are given on the 10 tenth working day since the day of service recipient applying.
  5. For real estate objects with the exception of the real estate objects specified in paragraphs two and three of this sub-item, relating to the first category of complexity is issued for 5 working days.

Further extension of the term is made depending on the complexity category of the object in agreement with the service recipient, while the total period should not exceed two months from the date of application of the service recipient.
