In accordance with Chapter 2 of the Model Rules for Conducting Internal Analysis of Corruption Risks, approved by Order No. 12 of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016, the State Unitary Enterprise "Department of State Architectural and Construction Control of the East Kazakhstan Region" plans to conduct internal analysis of corruption risks on September 3, 2025.
Internal analysis of corruption risks is carried out in the following areas:
- Analysis of legal acts and internal documents regulating the activities of the Department of State Architectural and Construction Inspectorate for the presence of corruption risks;
- Analysis of legal acts and internal documents regulating the activities of the Department of Licensing and Certification for the presence of corruption risks;
- Analysis of legal acts and internal documents regulating the activities of the Department of Financial and Legal Work for the presence of corruption risks
The Department of State Architectural and Construction Control of the East Kazakhstan region informs about the functions of the Construction Customer and his responsibilities.
The customer is an individual or legal entity operating in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities. Depending on the objectives of the activity, the customer may be the investor of the project (program), the customer (owner), the developer or their authorized persons.
The scope of the customer's activity includes the construction of new and (or) modification (expansion, modernization, technical re-equipment, reconstruction, restoration, overhaul) of existing facilities (buildings, structures and their complexes, communications), installation (dismantling), commissioning of related technological and engineering equipment, as well as conservation of unfinished construction objects.
The customer carries out the construction of facilities, including the implementation of investment projects (programs) at the expense of funds coming from the republican and local budgets, own funds, funds of the investor (investors), as well as from legal entities and individuals making investments in the order of equity participation in construction.
The main requirements for obtaining a license for construction and installation work are:
Qualification requirements for licensees of the III category for construction and installation work:
- the presence in the staff of at least one certified engineering and technical employee who has the appropriate certificate for the profile of the works included in the requested subspecies of the licensed type of activity and works on a permanent basis with the applicant in one of the following specializations:
chief engineer, head of the production and technical department, head of the site, work producer, foreman.
- availability of a production base on the right of ownership (economic management or operational management) and (or) lease for a period of at least one year (with state registration in the legal cadastre), equipped with:
1) administrative and industrial buildings or premises necessary to perform the declared types of work, a subspecies of the licensed type of activity. At the same time, administrative, industrial and other buildings or premises of the production base can be combined, if this does not contradict the requirements of the occupational safety and health system during work, and also does not violate the working conditions of administrative, technical and production workers.
2) workplaces organized in accordance with working conditions
- the presence of minimal material and technical equipment on the right of ownership (economic management or operational management) and (or) lease, including a minimum set of equipment, control and measuring devices, machines and mechanisms that are installed in accordance with the technical requirements for the performance of construction and installation works, depending on the technical requirements for the declared works of the subspecies of the licensed type activities in accordance with Annex 3 to these Unified Qualification Requirements and the list of documents confirming compliance with them, to carry out activities in the field of architecture, urban planning and construction.
GU "Department of State Architectural and Construction Control of East Kazakhstan Region" (Management) informs:
In accordance with Article 34-2 of the Law on Architectural, Urban Planning and Construction Activities of the Republic of Kazakhstan dated July 16, 2001 No. 242.
The construction customer has the right to:
1) to monitor the progress and quality of the work performed by the contractor (general contractor) and compliance with the deadlines for their execution;
2) do not accept work performed in violation of the requirements from the contractor;
3) to control the activities of technical supervision;
4) refuse to receive the conclusions of technical and author supervision in case of inconsistencies;
5) exercise other rights in accordance with the laws of the Republic of Kazakhstan.
The construction customer is obliged to:
1) before the start of construction and installation work, transfer to the contractor (general contractor) the approved design (design estimates) documentation;
2) provide the facility with all necessary permits provided for by the legislation of the Republic of Kazakhstan;
3) ensure the construction of the facility with the support of technical and author supervision;
4) take measures against the contractor (general contractor) for non-fulfillment or untimely and poor-quality execution of instructions from technical and author supervision;
5) provide working conditions for technical and author supervision;
6) ensure the fulfillment of the instructions of the state architectural and construction control and supervision bodies;
7) provide access to the facility for officials of the state architectural and construction control and supervision bodies to monitor the activities of technical supervision;
8) within three working days from the date of approval of the act of acceptance of the facility into operation, send to the State Corporation "Government for Citizens" at the location of the facility the approved act of acceptance of the facility into operation with the attachment of the technical characteristics of the facility, a declaration of conformity and conclusions on the quality of construction and installation works and compliance of the work performed with the approved project.
The main requirements for obtaining a license for construction and installation work are:
Qualification requirements for category II licensees for construction and installation work:
- work experience as a licensee or a category III licensee for more than five years from the date of obtaining a license or other permit for foreign persons to carry out project activities, but in case of termination of the license, work experience is canceled.
- availability of administrative and household premises on the right of ownership (economic management or operational management) and (or) lease, equipped with workplaces organized in accordance with working conditions.
- availability of software that allows performing calculations, drawing up and formatting graphic and other materials necessary for the declared subspecies of the licensed type of activity in accordance with Appendix 2 to these Unified Qualification Requirements and a list of documents confirming compliance with them for carrying out activities in the field of architecture, urban planning and construction.
- the presence of at least five completed construction projects of the second technically simple and (or) third level of responsibility as a general contractor with the presentation of documentary evidence (copies of signed acts of commissioning) or at least ten objects of the first and (or) second levels of responsibility, where the licensee performed work under subcontracting agreements, with the provision of documentary confirmation (copies of signed acts of completed works). For foreign persons, an equivalent document is taken into account as the provision of documentary evidence.
- the presence in the staff of at least one certified engineering and technical employee who has the appropriate certificate for the profile of the works included in the requested subspecies of the licensed type of activity and works on a permanent basis with the applicant in one of the following specializations:
chief engineer, head of the production and technical department, head of the site, work producer, foreman.
- availability of a production base on the right of ownership (economic management or operational management) and (or) lease for a period of at least one year (with state registration in the legal cadastre), equipped with:
1) administrative and industrial buildings or premises necessary to perform the declared types of work, a subspecies of the licensed type of activity. At the same time, administrative, industrial and other buildings or premises of the production base can be combined, if this does not contradict the requirements of the occupational safety and health system during work, and also does not violate the working conditions of administrative, technical and production workers.
2) workplaces organized in accordance with working conditions

- the presence of at least five completed construction projects of the second technically simple and (or) third level of responsibility as a general contractor with the presentation of documentary evidence (copies of signed acts of commissioning), or the presence of at least ten objects of the first and (or) second levels of responsibility, where the licensee has implemented work under subcontracting agreements, with the presentation of documentary evidence (copies of signed acts of completed works). For foreign persons, an equivalent document is taken into account as the submission of a documentary confirmation
Technical supervision of the construction of facilities is carried out by persons who have a certificate of an expert in technical supervision, carry out activities at facilities of technically simple second and third levels of responsibility.
Technical supervision is carried out by the customer independently and (or) with the involvement of experts who have the appropriate certificate for the right to provide engineering services in the field of architectural, urban planning and construction activities, at the expense of funds provided for in the design and estimate documentation for the construction of facilities in accordance with applicable regulations.
Individuals and accredited legal entities, when carrying out technical supervision activities, are required to own or lease measuring and control equipment, regulatory documentation and an accredited laboratory (involved).
The accreditation of legal entities engaged in technical supervision is carried out by the authorized body for architecture, urban planning and construction.
Technical supervision is the quality control of construction, repair, installation and commissioning works performed by a contractor at a specific facility and their compliance with design solutions.
Depending on the established violations or deviations from the requirements provided for by state regulations, the architectural and construction control and supervision bodies take measures against the construction subject in accordance with Chapter 20 of the Code of the Republic of Kazakhstan on Administrative Offenses.
In practice, subjects are often brought to administrative responsibility for the construction (reconstruction, restoration, expansion, technical re-equipment, modernization, major repairs) of an object without appropriate design documentation (Article 316 of the Administrative Code of the Republic of Kazakhstan), and also do not notify the state architectural and construction control and supervision authorities about the start of construction and installation works (art. 463 Administrative Code of the Republic of Kazakhstan).
Article 316 of the Administrative Code of the Republic of Kazakhstan – Part 1 "Construction (reconstruction, restoration, expansion, technical re-equipment, modernization, major repairs) of facilities and their complexes without design (design and estimate) documentation or according to design (design and estimate) documentation that has not been examined in accordance with the established procedure, except for the requirements established by technical regulations", provides for a fine in the amount of 120 MCI to 580 MCI, depending on the category of the subject. However, in case of repeated violation of this article (i.e. Part 2) during the year, a fine is provided in the amount of 160 MCI to 1000 MCI with the suspension of construction and installation work.
For the current year 2023, 69 administrative proceedings were initiated under this article.
Article 463 of the Administrative Code of the Republic of Kazakhstan – Part 1 "Engaging in entrepreneurial or other activities, as well as performing actions (operations) without registration, permission, as well as non-sending of notification in cases where registration, permission, and notification are mandatory, if these actions do not contain signs of a criminally punishable act" -
entail a fine for individuals in the amount of fifteen, for officials, small businesses or non–profit organizations – in the amount of twenty-five, for medium-sized businesses - in the amount of forty, for large businesses – in the amount of one hundred and fifty monthly calculation indices, with or without confiscation of objects and (or) instruments of committing administrative offenses, and engaging in entrepreneurial or other activities without a license additionally entails confiscation of income (dividends), money, securities received as a result of an administrative offense.
For the current year 2023, 22 administrative proceedings were initiated under this article.
The Department of GASK of East Kazakhstan Region to date, according to the results of unscheduled inspections, violations in the field of architectural, urban planning and construction activities for the following commercial multi-storey residential buildings have been established against developers:
1. The residential complex "Grand Residence" has no documentation, there is a court decision to suspend construction until documents are received
2. The residential complex "Astoria" lacks an agreed preliminary design, construction and installation work is suspended;
3. LCD "Oasis-4" there is no documentation, legal proceedings are underway;
4. The residential complex "Shanyrak" has no documentation; there is no agreed draft design, construction and installation work has been suspended;
5. LCD "Tumar Towers" there is no documentation, construction and installation work is suspended;
6. LCD "ASYL Tau" there is no documentation, construction and installation work is suspended;
7. LCD "Deluxe town" deviation from the approved project; construction and installation work is suspended (item 99), litigation is underway;
8. Residential complex "AB-RESIDENCE" deviation from the approved project (construction of 14 floors was completed together with 12), court proceedings are underway;
9. Residential complex "Krylova" deviation from the approved project, (instead of 5, work is underway on the construction of the 6th floor), court proceedings are underway;
On the territory of the regional center, shared-equity construction is actively developing, which is regulated by the Law "On Shared Participation in Housing Construction" (hereinafter – the Law).
In accordance with paragraph 1 of Article 7 of the Law "On Equity Participation in Housing Construction", equity participation is organized in three ways:
1) obtaining guarantees of a Single operator (the developer is obliged to conclude a guarantee agreement with a single operator of JSC "Kazakhstan Housing Company");
2) participation in the project of a second-tier bank (the developer must obtain permission from the local executive body to attract funds from shareholders);
3) attracting money from shareholders after the construction of the frame of an apartment building (the developer must obtain permission from the local executive body to attract funds from shareholders).
Currently, the office of the Akim of the East Kazakhstan region is monitoring on an ongoing basis, according to the results of monitoring by the GASK Management of East Kazakhstan Region, 5 developers (Deineka LLP (for 2 objects), Royale Finance Group LLP, DALA SK LLP, Elit Stroy group LLP, Asilzholgroup LLP) have been attracted to administrative responsibility under Article 320 of the Administrative Code of the Republic of Kazakhstan (for violating the requirements of the legislative act of the Republic of Kazakhstan on equity participation in housing construction and housing legislation of the Republic of Kazakhstan).
In relation to 4 developers, namely Stroi Invest Capital, Turquoise Example LLP, Royal Finance Group LLP, Baiterek Invest LLP, administrative proceedings were initiated under Article 320 of the Administrative Code of the Republic of Kazakhstan, the materials were sent to the Specialized Court for Administrative Offenses of Ust-Kamenogorsk for prosecution
As of November 1, 2023, the Department of State Architectural and Construction Control of East Kazakhstan Region accepted for consideration 1943 units of incoming correspondence, appeals of individuals and legal entities - 770.
Over the past period, for violations of the norms and requirements established by the legislation on architectural, urban planning and construction activities, Management:
- 321 administrative cases were initiated for a total amount of 45 million tenge, of which 107 administrative cases were sent to the administrative court for decision-making, 38 million tenge was recovered, which is 84 %
-411 coupons were issued for the acceptance of notifications on the start of construction and installation works, of which 305 are private sector facilities, 106 are budget-funded facilities;
