PRESS RELEASE to the draft order of the Chairman of the National Security Committee of the Republic of Kazakhstan “On Amending Order No. 504 of the Chairman of the National Security Committee of the Republic of Kazakhstan dated November 30, 2013

The presented draft was developed on the basis of paragraph 2 of Article 50 of the Law of the Republic of Kazakhstan dated April 6, 2016 “On legal acts”.
The draft provides for amendments aimed at bringing the legal act in accordance with Article 22-1 of the Law of January 16, 2013 “On the State Border of the Republic of Kazakhstan” (hereinafter - the Law) in terms of regulating the concept of “another place where the pass through the State Border is carried out” . According to this norm of the Law, persons, vehicles, goods and goods passing through the state border are carried out at checkpoints, as well as in other places where the state border is being passed.
In addition, the project provides for the passage in the bodies and trailers of freight vehicles in the absence of the possibility of using inspection and inspection systems. The proposed amendment is aimed at identifying and detaining violators of the state border crossing order trying to hide in freight vehicles.
The need to include this rule is determined by existing threats to national security, such as uncontrolled migration processes, uncontrolled export of goods outside the country, and the growth of the shadow economy.
The implementation of this rule will have a positive effect on reducing the time for passing control at the border and reducing the risks of transporting people, goods with a restriction or prohibition on moving across the border in the cargo compartment, will help identify unscrupulous carriers, as well as reduce the costs of entrepreneurs unloading goods for inspection on the border.
This norm applies only to checkpoints in which there is no inspection and inspection complex; it does not contradict the norms of subparagraph 5 of paragraph 1 of Article 25 of the EAEU Agreement with regard to the free movement of goods.
Moreover, the solution of this issue will remove the problem of entrepreneurs with the border authorities of the Russian Federation, where this norm is legally fixed, is practiced at border crossing points and creates major difficulties for participants in foreign economic activity.
The adoption of the project does not imply financial costs from the republican budget and will not entail negative consequences.
The need to bring normative legal acts
in accordance with the developed project is missing.
The project is available on the Internet portal of open regulatory acts.
