About the procedure for obtaining the state service " Sale to private ownership of a land plot previously provided for land use"
1 The state service "Sale to private ownership of a land plot previously provided for land use" is provided by local executive bodies of the regions, the cities of Astana, Almaty and Shymkent, districts, cities of regional significance, cities of district significance, akims of a settlement, village, rural district.
Receiving an application and issuing a result on the provision of a public service
it is carried out through the office of the service provider.
Procedure for the provision of public services
The term of rendering the state service:
1) from the date of delivery of the package of documents to the service provider – 15 (fifteen) working days;
2) the maximum allowed waiting time for the delivery of a package of documents is 15 (fifteen) minutes;
3) the maximum allowable service time is 15 (fifteen) minutes.
The form of public service provision: paper.
The result of the provision of a public service is the decision of the service provider on
granting the right to a land plot or a reasoned refusal to provide
state services on the grounds provided for in paragraph 10 of this
the standard.
The form of providing the result of the provision of public services: paper.
The state service is provided free of charge to individuals and legal entities
persons.
The service provider's work schedule is from Monday to Friday from 9.00 to 18.30 hours from
lunch break from 13.00 to 14.30 hours, except for weekends and holidays
days, according to the labor legislation of the Republic of Kazakhstan and Article 5 of the Law
Of the Republic of Kazakhstan dated December 13, 2001 "On holidays in the Republic of Kazakhstan".
The state service is provided at the location of the land plot in
on a first-come, first-served basis, without prior appointment and accelerated service.
8. The service recipient (or his representative by proxy), including
persons who have benefits, presents in one copy to the service provider:
1) an application for the sale of a land plot into private ownership, previously
granted for land use in the form of;
2) identity document (for identification of the person);
3) the act of cadastral (estimated) value of the land plot.
The grounds for refusal to provide a public service are:
1) establishing the unreliability of the documents submitted by the service recipient
for obtaining a public service, and (or) the data (information) contained in
them;
2) in respect of the service recipient, there is a decision that has entered into legal force
the court on the basis of which the service recipient is deprived of a special right,
related to the receipt of a public service;
3) inconsistency of the submitted materials, data and information
the service recipient required for the provision of public services, the requirements,
established by part 2 of paragraph 1 and paragraph 6 of Article 24, part 6 of paragraph 3 and paragraph 6-1 of Article 43, part 2 of paragraph 6 of Article 49-2, paragraph 2, 2-1 and 4 of Article 50 of the Land Code of the Republic of Kazakhstan dated June 20, 2003.
10. In cases of disagreement with the results of the provision of public services
the service recipient applies to the court in accordance with the legislation of the Republic
Kazakhstan is fine.
