HISTORY OF CREATION AND DEVELOPMENT OF THE EURASIAN ASSOCIATION OF CONSTITUTIONAL REVIEW BODIES

It was established with the aim of promoting generally accepted constitutional values, maintaining a permanent dialogue and sharing experience on the issues of ensuring the supremacy of constitution.
On October 24, 1997, the Constituent Conference of Constitutional Control Organs of Countries of Young Democracy was held in Yerevan; within the framework of it the delegations of Armenia, Belarus, Georgia, Kazakhstan, Moldova, Russia, Tajikistan and Ukraine took part.

By the results of the Constituent Conference, the delegations of Armenia, Belarus, Kazakhstan, Russia, Tajikistan and Kyrgyzstan (with the written consent) made a decision to establish the Conference of Constitutional Control Organs of Countries of Young Democracy, which was reflected in the Joint Communiqué.

This important act states that the constitutional control organs of Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia and Tajikistan realizing the extremely important role and significance of the institution of constitutional control in the formation of constitutional state and development of democratic processes in the society; taking into account the peculiarities of transition period in the development of effective system of constitutional control; striving for the maximum use of consultative cooperation in the framework of organizing and holding the topic discussions on relevant issues on constitutional justice of mutual interest; having the aim to enlarge the cooperation and to establish the constant exchange of experience between constitutional courts of countries of young democracy, declare about the creation of Conference of Constitutional Courts, as a consultative institution, and invite the constitutional control organs of other countries of young democracy to join this Conference.

On 4 October, 2003, the Agreement on Cooperation between the Conference of Constitutional Control Organs of Countries of Young Democracy and the European Commission for Democracy through Law of the Council of Europe (Venice Commission) was signed. It is stated that, by sharing the general interests in the development of constitutional justice, the parties agreed to provide mutual support in the exchange of information and publications on relevant issues of constitutional justice.

By the decision of participants of the Conference of Constitutional Control Organs of Countries of Young Democracy, adopted at a meeting in Rio de Janeiro (Brazil) within the framework of participation in the Second Congress of the World Conference on Constitutional Justice, the Conference was renamed into the Conference of Constitutional Control Organs of Countries of New Democracy from March 1, 2011.

In 2015, the Constitutional Court of Mongolia became a member of the Conference. Its appeal indicates that the Constitutional Court of Mongolia joins the Conference and within its framework expresses interest in developing cooperation with other bodies of constitutional justice.

At present, the constitutional control organs of Armenia, Belarus, Kazakhstan, Kyrgyzstan, Mongolia, Russia, Tajikistan and Uzbekistan are members of the Conference.

During these years a number of meetings of the Conference participants were held. Most meetings were chaired by the Constitutional Court of Armenia in the framework of annual Yerevan international conferences.
In December 2017, the Chairman of the Constitutional Council of the Republic of Kazakhstan K. Mami was elected as the Chairman of the Conference.

The first meeting of members of the Conference chaired by Kazakhstan was held at the Constitutional Court of the Russian Federation (St. Petersburg, May 16, 2018).

Delegations of all participants of the Conference participated in the meeting. Its results were formalized in a protocol. The parties reaffirmed their interest in deepening cooperation both among themselves and with other international structures, regional and linguistic associations.

In addition, the importance of holding the Congresses of the World Conference on Constitutional Justice was noted and the new logo of the Conference was approved.

The Association has its own periodical - “Constitutional justice” Bulletin, the editorial board of which includes representatives of all members of the Conference.

On August 27, 2018, in Kazakhstan the Cooperation Agreement between the Conference of Constitutional Jurisdictions of Africa and the Conference of Constitutional Control Organs of Countries of New Democracy was signed.

On August 28, 2018, in Astana the regular meeting of the Conference took place. The Constitutional Court of the Republic of Azerbaijan was admitted to its composition. An Internet resource of the Conference, placed on the platform of the website of the Constitutional Council of Kazakhstan, was presented to participants.
The parties approved a new composition of the editorial board of the Bulletin and considered organizational issues related to activities of the association (approval of the flag, schedule of the next meetings and others).

The Conference of constitutional control organs of the countries of new democracy was renamed into Eurasian Association of constitutional review bodies at the meeting held on May 31, 2019 in Minsk. All members of the Association supported this decision.

In addition, the new logo was approved, and also established the flag and breastplate of the organization.
At present, the constitutional control organs of Armenia, Belarus, Azerbaijan, Kazakhstan, Kyrgyzstan, Mongolia, Russia, Tajikistan and Uzbekistan are members of the Association.

On August 25, 2023, in Astana the 1st Congress of the Eurasian Association of Constitutional Control Bodies was held in a hybrid format in Astana, focusing on the theme "Supremacy of the Constitution – the Basis of State Sovereignty, Sustainable Development, Legality, and Law and Order, Human Rights Protection."

Since 2017, the Constitutional Control Body of the Republic of Kazakhstan has been presiding in the Eurasian Association of Constitutional Control Bodies. The main goal of the Association is to promote universally recognized constitutional values, maintain a constant dialogue, and exchange experiences on issues related to ensuring the supremacy of constitutions in member countries. The Congress was organized by the Constitutional Court of Kazakhstan and brought together the constitutional courts of the member states of the Eurasian Association of Constitutional Control Bodies (Azerbaijan, Armenia, Belarus, Kyrgyzstan, Mongolia, Russia, Tajikistan, Uzbekistan). The Congress was attended by judges from the Eurasian Economic Union Court, the Commissioner for the Human Rights of the Republic of Kazakhstan, deputies from both chambers of the Parliament of Kazakhstan, representatives of the Prosecutor General's Office of Kazakhstan, the Ministry of Justice of Kazakhstan, international associations, domestic and international academic fields.

Flag

The flag of the Association is a rectangular white cloth with the image in the center of the logo of the organization. White symbolizes nobility, purity, wisdom and generosity.
The proportion of the width of the flag to its length is 1:2.

Logotype

The logo consists of four separate elements connected in a single creative concept.
In the central circle «Wreath of two ears», which implies fruitful cooperation in ensuring the supremacy of the Constitution.
The «Themis», placed in the center, holds the scales in her left hand, and in the right hand – the text of the Constitution, which symbolizes the rule of law.
Inside the Foundation is the abbreviation of the logo of the Eurasian Association of Constitutional Review Bodies in English, - «ЕАСRB».
On the outside of the central circle, there is a circular inscription: «Eurasian Association of constitutional review bodies (in russian)» at the top and «Eurasian Association of Constitutional Review Bodies» at the bottom. Two points in the form of the sun and rays to separate inscriptions.
