According to para. 1 of Article 19 of the Law of the Republic of Kazakhstan “On Gas and Gas Supply”, the owners of gas consuming systems and gas equipment are obliged to ensure proper technical condition and safety thereof.
The technical maintenance of gas consuming systems and gas equipment of the public utility and household consumers shall be done by signing a standard agreement with the gas distribution organization or an independent specialized organization certified to carry out works in the field of industrial safety.
Also, technical servicing of the gas equipment of the consumers lies within a competitive environment and the consumer has the right to sign an agreement with any organization that carries out technical servicing of the gas consuming systems certified in accordance with the law of the Republic of Kazakhstan in the field of industrial safety for the right to carry out works in the field of industrial safety.
Within the agreement, the Contractor is obliged to provide high-quality and timely maintenance of the consumer's gas equipment in accordance with the standard agreement for the maintenance of gas-consuming systems and gas equipment of the public utility and household consumers, approved by the Order No. 117 of the Minister of Energy of the Republic of Kazakhstan dated November 12, 2014. Accordingly, the consumer has the right to demand high-quality services from this organization, as specified in the standard agreement. Upon the inadequate fulfillment of obligations under the agreement the consumer has the right to sign an agreement with any other organization that carries out technical maintenance of gas-consuming systems and is certified in accordance with the law of the Republic of Kazakhstan or to appeal the Contractor's inaction to the Department of Emergency Situations that is engaged in issuing the certificates.
In accordance with para. 51 Chapter 4 of the Law on the Approval of Rules for Retail Sale and Use of Sale and Liquefied Petroleum Gas
–the Maintenance, Technical servicing and verification of metering devices shall be done by the owner of metering device. Technical servicing of metering devices as per agreement with the owner can be performed by a gas distribution and gas network organization or other specialized organization. Also, in accordance with para. 52 the verification of metering devices shall be done in accordance with inter-verification interval for a specific metering device within the timeframe specified in the register of state uniform measurement system approved by authority for technical regulation and metrology as well as in the case of uncertainty with regard to the accuracy of metering device readings as per the application filed by one of the stakeholders.
The verification of metering devices shall be done in accordance with the requirements of the Law of the Republic of Kazakhstan dated June 7, 2000, No. 53-II "On the Uniform Measurements Provision". The measuring devices shall be subject to the following verification types: initial, periodic, unscheduled, inspection, and expert ones. The measuring devices that are in operation shall be subject to periodic verification. A period of verification for a gas meter is indicated in the gas meter passport kept by the consumer of gas. Each gas meter has its specific verification period and an inter-verification interval is specified in the gas meter passport.
