How to get a temporary residence permit in Kazakhstan?

Foreigners (EAEU citizens) who want to live and work in Kazakhstan need to obtain a temporary residence permit (TRP) on the territory of Kazakhstan.

What is TRP?

Temporary residence permit (TRP) is a document issued to foreigners or stateless persons temporarily staying in the Republic of Kazakhstan.

The TRP replaces visa of corresponding category for citizens of EAEU countries (Eurasian Economic Union, which includes Russia, Belarus, Kazakhstan, Armenia and Kyrgyzstan) and the CIS.

Thus, citizens of the EAEU can stay in Kazakhstan for no more than 90 days, and to extend their stay in the country, they can apply for a TRP - a temporary residence permit.

A temporary residence permit (TRP) gives the right to stay in Kazakhstan for the period of the employee's employment agreement, but not more than one year. If the term of the employment agreement is concluded for a period of less than one year, respectively, the TRP is issued for this period.

TRP can also be issued to the close family members of the employee as an accompanying person. To do this, you must provide a marriage certificate (for a spouse) and a birth certificate or passport (for a child).

A temporary residence permit entitles the one to get the child to the school. And if the foreigner deducts interest from his salary to the Social Medical Insurance Fund, then he can receive, on an equal basis with Kazakhstanis, the entire scope of medical care in the state outpatient facilities.

It is important to monitor the validity period of the TRP, since the untimely departure of a foreign citizen after this period entails a fine for both the foreign citizen and the receiving party / employer in accordance with Articles 517 and 518 of the Code On administrative offenses of the Republic of Kazakhstan.

What is the time frame for issuing a TRP?

  • For citizens of Armenia, Belarus, Kyrgyzstan, Russia, Azerbaijan and Tajikistan - within 90 days from the date of entry into Kazakhstan.
  • For citizens of Uzbekistan - within 30 calendar days from the date of entry into Kazakhstan.

At the same time, TRP does not give the right to register as an individual entrepreneur and own real estate in Kazakhstan.

If the foreigner changes his place of work, he must renew his permit within 15 days and make it from another employer.

If the foreigner, having received a TRP, left Kazakhstan and returned again, the employer is obliged to notify the migration service about the arrival of his employee within three days, there is no need to obtain a new TRP until the expiration of the previous permit.

How to issue a TRP?

When applying for a temporary residence permit, a foreigner must justify the purpose of his stay in Kazakhstan. These may be the following reasons:

  • work, medical treatment, study;
  • family reunification;
  • business immigrant (for entrepreneurial activity);
  • missionary activity.

If the purpose of arrival is work, then in order to obtain a temporary residence permit, you need to find a job.

What documents are required for registration of a temporary residence permit for the purpose of employment?

  1. Application questionnaire from the employer;
  2. a copy of the alien's identity document (the original is provided for verification);
  3. a copy of the medical insurance (the original is provided for verification) (with the exception of citizens of the countries of the Eurasian Economic Union);
  4. a notarized consent to the residence of a foreigner, if the service recipient (employer) is not the owner of the housing provided to the foreigner for his temporary residence;
  5. an employment contract (for citizens of the EAEU) registered in the unified system of accounting for employment contracts "ESUTD" or a civil contract for the performance of work (a permit to attract foreign labor issued by a local executive body; a certificate or permit issued by a local executive body of the Republic of Kazakhstan on compliance with the qualifications of a foreigner; a permit for a labor immigrant issued by by a local executive body, for carrying out work activities for individuals).

A temporary residence permit for a foreign employee is issued at the place of registration of the employer from the moment of conclusion of the employment contract.

TRP can be issued via:

1) service provider (migration service);

2) the state corporation "Government for Citizens" (PSC);

3) e-government web portal www.gov.kz.

From the date of delivery of documents to the service provider, to the State Corporation and or through the portal – 1 working day.

Documents drawn up in a foreign language are subject to translation into the state or Russian language.
