Receiving a land plot for IHC

You, as a citizen of Kazakhstan, have the right to receive land for individual housing construction free of charge. A land plot is provided as a private property in the amount of 0.10 hectares, and it does not matter if you have another property.

At the same time, you can only become the owner of the land after its development, i.e. after signing an act of putting the house into operation. The repeated free provision of land plots for this purpose is not allowed.

In this material we will describe the procedure for obtaining 10 decares of land.

Special registration (queue)

In case of absence of prepared grounds for withdrawal, the application is taken on a special registration, i.e. is put in a queue.

Then, within 2 working days a notice is issued with the number of the queue in the general list. When ready-made sites appear, you will be notified of the need to submit an application within one month from the date the site is ready.

Information on preparation of sites for allotment and lists of priority for receiving a land plot shall be open and placed on the websites of akimats and (or) by publication in local mass media.

Provision of land plot

As soon as it is your turn to receive a land plot, you will need to coordinate the final act of choosing a land plot in the akimat at the location of the land plot and pay for the services of land cadastral works.

After that, the State Corporation produces a land cadastral plan and the Akimat decides on granting the right to lease the land plot.

Next, you must conclude a lease agreement with the akimat for the allocated land plot.

Then it is necessary to carry out work on establishing the boundaries of the land plot, for this it is necessary to contact the entities performing land management work, or in the  "Government for Citizens". It should be taken into account that you need to pay for land management work and a land cadastral plan.

The cost of making a land cadastral plan for a land plot is calculated in accordance with the Order on approval of prices for goods (works, services) produced and (or) sold by the State Corporation "Government for Citizens".

After three years from the date of granting the right to lease a land plot, upon completion of the construction of an individual residential building, you need to go through the procedure of acceptance of the constructed object into operation.

After that, you can submit an application to the akimat for the provision of a land plot in private ownership. If the house has not been built within three years, it is necessary to apply to the akimat with an application for the provision of a land plot for a new term. If, within three years from the date of granting the land plot, it has not been used for its intended purpose – i.e. there is no construction work or operation of individual housing, the state has the right to withdraw it according to Articles 92 and 94 of the Land Code.

Where and with what documents to apply

Application in any form to provide a land plot for IHC should be filled in at the Akimat. You also need to have the original and a copy of your identity document with you.

Depending on where you want to get the land, it is necessary to apply to the appropriate akimat. If the land plot:

  • within the boundaries of the city of republican importance and the capital – then to the akimat of the city of republican importance and the capital;
  • within the boundaries of the city of oblast significance - then to the akimat of the city of oblast significance;
  • within the boundaries of the city of district significance - then to the akim of the city of district significance;
  • within the boundaries of the village - then to the akim of the village;
  • within the boundaries of aul (village) - then to akim of aul (village), aul (rural) district.

The application should specify the purpose of using the land plot, its size limits, location, the right of use requested and information about the presence of any other land plot that could suit you.

 

Period of consideration

The total period of consideration of the application is 2 months.

The akimat sends documents to the authorized body on land relations and architecture to determine the possibility of using the requested land plot. Term of consideration up to 10 working days.

Then within 2 working days it is sent for consideration of the land commission.
