How the sick leave is paid

If this happens and you get sick, the employer is obliged to pay social benefits for sick leave (the allowance) for the period of your temporary disability.

In this material, we will tell you how the benefit is paid when working for several employers, how much benefit you can count on and in what cases the benefit will not be paid.

Features of the payment of benefits in individual cases

The allowance is paid at the place of work:

  • when sent to work in another organization (with the preservation of salary at the main place of work),
  • employed in seasonal work,
  • home and home workers,
  • trainees of courses on training, retraining and advanced training of personnel (when sent to courses by an employer and keeping the salary paid).

If you are hospitalized in a hospital of a prosthetic and orthopedic organization, the benefits will be paid:

  • during the stay in the hospital,
  • during travel to the hospital and back.

The allowance is paid:

  • from the day of leaving / admitting to work in case of reinstatement of the employee at work, after the termination of the employment contract without a legal basis;
  • from the date of admission to work in the event of unlawful suspension earlier from work.

In what cases the benefit will not be paid

Social benefit for temporary disability is not paid to:

  • an employee, whose temporary incapacity for work occurred as a result of industrial injuries received during the commitment of a criminal offense, in the event of a determination of guilt by a court judgment that has entered into legal force;
  • during the period of compulsory treatment of an employee as determined by the court (except for the mentally ill);
  • during the time the employee is under arrest and during the forensic medical examination in the event that his guilt is established by a verdict or court ruling that has entered into legal force;
  • in case of temporary incapacity for work of an employee caused by diseases or work-related injuries resulting from the use of alcohol, narcotic drugs, psychotropic substances, their analogues and precursors;
  • for days of temporary incapacity for work falling on paid annual labor leave;
  • for days of temporary incapacity for work falling on unpaid leave;
  • for the days of temporary incapacity for work falling on unpaid child care leave until the child reaches the age of three years.

Grounds for the appointment and payment of benefits

The employer pays social benefits for the sick leave (benefits) to the employee at his own expense.

The basis for the appointment and payment of the benefits is a sick leave certificate.The sick leave certificate must be handed over:         

  • on the day of resuming the work indicated in the sick leave certificate,        
  • or before the sick leave ends. 

The benefits are paid from the 1st day of incapacity for work until the day of restoration of the ability to work or until the establishment of disability.

The allowance is paid for the period specified in the sick leave certificate and at the time of payment of the salary and wages. 

The allowance is assigned and paid for each place of work if a person works for several employers.

When an employee submits an application, the benefit can be received by:      

  • an authorized person on the basis of a corresponding power of attorney;       
  • legal representative.

How much is the benefit

The amount of social benefits paid for one month from July 1, 2023, cannot exceed 25 times the amount of the MCI for the corresponding year. Until July 1, the amount of social benefits did not exceed 15 times the amount of the MCI.  The amount of the benefit is determined by multiplying the average daily earnings by the number of working days falling during the period of temporary disability. 

The allowance in the amount of 100 percent of the salary is:

  • for working participants, invalids of the Great Patriotic War and persons equated to them;
  • upon payment in connection with a work injury (if there is an act of an industrial accident) or an occupational disease;
  • upon payment to the personnel of the diplomatic service during the period of his staying abroad.
