Issuance of a license for dealer activity in the digital asset market - exchange operations with unsecured digital assets

To obtain a license:

Documents confirming the payment of authorized capital.

Charter, except in cases where the uncovered digital asset exchange operator operates under a standard charter.

A document defining the procedure for interaction between the uncovered digital asset exchange operator with a bank or the National Postal Operator, with a digital asset exchange, or other entities that provide access to digital assets.

Rules for the operation of uncovered digital asset exchange operator approved by the governing body of the uncovered digital asset exchange operator.

A document confirming the authority of the person to submit an application and documents and information attached thereto.
A notice of the license issuance with the license attached, or a grounded rejection to provide the public service
1) the inaccuracy and/or incompleteness of the data and/or information in the documents submitted to obtain a license for uncovered digital asset exchange operations;
2) the submission of an incomplete set of documents or non-compliance of the documents with the requirements of this Law and Regulatory legal act of the National Bank of the Republic of Kazakhstan;
3) the failure of the executive body chief of the uncovered digital asset exchange operator to comply with the established requirements;
4) The beneficial owner has an unexpunged or unspent criminal record. If the license issue is rejected, the legal entity shall resubmit the license application upon the causes addressed that led to the rejection of the uncovered digital asset exchange operator license, or he decides to change its name, reorganize, or liquidate. The failure to rectify the causes that led to the rejection of the issue of the unsecured digital asset exchange operator license is deemed as the ground for rejection of any further consideration.

General requirements for the appeal
The appeal submitted in hard copy or electronic form shall indicate:
- Full name, IIN, postal address of a natural person, BIN of a legal entity;
- name of administrative body, official to whom the appeal is submitted;
- the essence of an appeal;
- date of filing an appeal;
- signature of the applicant or his representative;
- other information provided for by legislation of the Republic of Kazakhstan.
If the administrative procedure is on a paid basis, the applicant must submit a document confirming the payment.

The Law of the RK "On Public services"
The license fee for issuing a license is 30 (thirty) monthly calculation indices.
The license fee payment is done in cash or by bank transfer through second-tier banks, branches of non-resident banks, or organizations that carry out certain banking operations types. The payment by bank transfer is done through the e-government payment gateway.
Within twenty working days from the date of registration of an application and complete package of documents.
