Permit to open a branch of a non-resident insurance broker of the Republic of Kazakhstan

You can obtain a service via the Portal:

1. Click “Order Online” button, then a new window will open of e-Licensing Portal;

2. Sign in or log in on e-Licensing Portal;

3. Click “Order Service Online” button on e-Licensing Portal page;

4. Fill in the fields of request;

5. Sign a request with digital signature;

6. You can track status of request in “My applications” section of Personal Account, status on obtainment of license in “My licensing documents” section and status on obtainment of notification in “My notifications” section.

Required documents to be furnished to the Service Provider:

1. An application in the Kazakh or Russian language for issuing a permit to open a branch of non-resident insurance broker of the Republic of Kazakhstan.

2. A decision of the non-resident insurance broker of the Republic of Kazakhstan to open a branch in the territory of the Republic of Kazakhstan.

3. Draft regulation on the non-resident insurance broker branch of the Republic of Kazakhstan.

4. Copies of the constituent documents of the non-resident insurance broker of the Republic of Kazakhstan (notary certified in the case of failure to submit the original for verification).

5. Information about the non-resident insurance broker of the Republic of Kazakhstan, including the presentation of financial statements for the last two completed financial years (including consolidated, if any), certified by an audit organization.

6. Organizational structure of the non-resident branch insurance broker of the Republic of Kazakhstan and information about the affiliated entities and natural persons of the non-resident insurance broker of the Republic of Kazakhstan.

7. Documents of the natural persons proposed for the positions of executives of the branch non-resident insurance broker of the Republic of Kazakhstan in accordance with the requirements for executives of the branch non-resident insurance broker of the Republic of Kazakhstan, established by regulatory legal act of the authorized body.

8. A written statement of financial supervisory authority of the state whose resident is the non-resident insurance broker of the Republic of Kazakhstan, about the absence of objections to opening of a branch by the non-resident insurance broker of the Republic of Kazakhstan in the territory of the Republic of Kazakhstan or a statement certifying that under the law of the state whose resident is a non-resident insurance broker of the Republic of Kazakhstan such authorization is not required.

9. A written statement of financial supervision authority of the state whose resident is the non-resident insurance broker of the Republic of Kazakhstan certifying that the non-resident insurance broker of the Republic of Kazakhstan has a valid insurance broker license.

10. A written statement of financial supervision body of the state whose resident is the non-resident insurance broker of the Republic of Kazakhstan certifying that the non-resident insurance broker of the Republic of Kazakhstan has not had any violations of the requirements of the law governing the non-resident insurance broker of the Republic of Kazakhstan within the two years preceding the application submission.

11. A written statement of authorized body of the state whose resident is the insurance broker-non-resident of the Republic of Kazakhstan certifying that the founder (s) of the non-resident insurance broker of the Republic of Kazakhstan has no convictions for economic and corruption crimes and offenses, and also that the founder (s) has not held office of executive of the non-resident insurance (re-insurance) company of the Republic of Kazakhstan, as well as non-resident insurance broker of the Republic of Kazakhstan or another financial organization of the state of the non-resident insurance broker of the Republic of Kazakhstan within at least one year from the date of the license revocation in the manner prescribed by the law, of the decision on mandatory liquidation, and mandatory stock buyout of the non-resident insurance (re-insurance) company of the Republic of Kazakhstan and non-resident insurance broker of the Republic of Kazakhstan. This requirement is applied within a five years period once the license is revoked, as well as from the date of the decision on mandatory liquidation and mandatory stock buyout of the non-resident insurance (re-insurance) company of the Republic of Kazakhstan and non-resident insurance broker of the Republic of Kazakhstan.

12. A copy of current license of the non-resident insurance broker of the Republic of Kazakhstan, issued by the financial supervision authority of the state whose resident is the insurance broker-non-resident of the Republic of Kazakhstan.

13. Documents for the Republic of Kazakhstan non-resident insurance broker branch registration.

14. A copy of the document confirming the insurance broker license fee payment except for the cases of payment through the "electronic government" payment gateway.

1) the non-compliance of the submitted documents with the requirements specified in paragraph 1 of Article 16-4 of the Law of the Republic of Kazakhstan "On Insurance Activities";

2) the non-attendance of the comments of the authorized body on the submitted documents within the time limit established therein;

3) the non-compliance with the requirements established by subparagraph 9) of part one of paragraph 1 of Article 16-4 of the Law;

4) the non-compliance of the name of the branch of a non-resident insurance broker of the Republic of Kazakhstan with the requirements of paragraph 8 of Article 16-4 of the Law;

5) the provision of inaccurate information concerning a non-resident insurance broker of the Republic of Kazakhstan to the authorized body;

6) the absence of consent of the service recipient, provided in accordance with Article 8 of the Law of the Republic of Kazakhstan "On Personal Data and Their Protection", to access sensitive personal data, which are required for the public service provision.

 General requirements for the appeal

The appeal submitted in hard copy or electronic form shall indicate:

• Full name, IIN, postal address of a natural person, BIN of a legal entity;
• name of administrative body, official to whom the appeal is submitted;
• the essence of an appeal;
• date of filing an appeal;
• signature of the applicant or his representative;
• other information provided for by legislation of the Republic of Kazakhstan.

If the administrative procedure is on a paid basis, the applicant must submit a document confirming the payment.
