Service for obtaining abstract of no criminal record by third parties
Today, this certificate is one of the most demanded public services. Without it, it is almost impossible to get a job, get a permit to be engaged in certain activity types, go abroad to study or work, etc.
The main circumstances when it is necessary to present such a certificate:
To be employed by a private company except for the companies that under restrictions within legislative acts in the recruitment of persons who have previously been convicted or committed criminal offenses (for example, stated in items 2) and 3) of paragraph 2 Article 26 of the Labor Code, also in accordance with item 3) of Articles 20-2 of the Law "On the National Bank of the Republic of Kazakhstan" to be employed to the National Bank of Kazakhstan and its departments, etc.);
to obtain a residence permit;
to obtain and extend the Republic of Kazakhstan exit visas, including for the purpose of study, business and the businessmen who immigrate (depending on requirements of the host country an apostilled document may be required, this information must be checked with the embassy);
to obtain permission to carry out a number of activities.
Issue of certificate on existance or absence of conviction record.
Issuance of certificate of no criminal record in paper with an apostille stamped or a motivated refusal to deliver the service.
Refusal to deliver a public service might be caused by unreliable documents provided by a service recepient and (or) data that is contained in the documents.
If you do not agree with the result, actions or inaction of government agency`s civil officers, you can apply to the service provider`s head. Your complaint will be considered within 5 working days from its registration and an answer will be provided.
A complaint can be submitted in several ways:
1.Online.
2. Submitted personally to the Ministry`s administrative office.
3. Via e-Gov Portal.
If you are not satisfied by the provided answer to your complaint, you have a right to submit a complaint to an agency authorized to assess and control quality of public service delivery, and also appeal to court.
Free-of-charge
- in State corporation and on the web-portal – 10 minutes;
- in case of additional checking – 5 working days;
- in case of departure abroad – 5 working days.
- in case if a service is need to be obtained in conjunction with the "Apostilization of official documents issued by the General Prosecutor's Office and law-enforcement agencies" public service ("one application" principle-based service) – 8 working days;
- issuance of certificate of no criminal record to travel abroad – 5 working days;
- apostilization of certificate of no criminal record – 3 working days.
The day of documents submission is not included into the period of public service delivery.
