2) Good day! I bought a car on credit for 5 years, I still have two years to pay, can I pay the remaining amount from my pension savings?

According to the Law of the Republic of Kazakhstan dated 02.01.2021. No. 399-VI On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on the Restoration of Economic Growth citizens have the right to use part of their pension savings to improve housing conditions and (or) pay for medical treatment that is not included in the guaranteed volume of free medical care and compulsory social health insurance, as well as for the transfer of investment management to private investment managers.

In accordance with the provisions of Articles 30, 31 and 32 of the Law of the Republic of Kazakhstan On Pension Provision in the Republic of Kazakhstan (hereinafter - the Law), the right to use part of their pension savings in order to improve living conditions in their favor or a spouse or close relatives and (or) the following persons who have pension savings in the UAPF formed from compulsory pension contributions (CPC) and (or) compulsory occupational pension contributions (COPC) can use to pay for medical treatment for themselves or their spouse, or close relatives:

1) the amount of pension savings which exceeds the threshold of the minimum sufficiency of pension savings.

At the same time, a lump sum pension benefit cannot exceed the amount of the difference between the amount of pension savings at the expense of CPC and (or) COPC of the contributor (beneficiary) and the threshold for the minimum sufficiency of pension savings, calculated according to the Methodology for determining the minimum sufficiency of pension savings, approved by the Government of the Republic of Kazakhstan, as of the date receiving an electronic notification from an authorized operator;

2) for whom the size of the pension, and for the persons specified in paragraph 7 of Article 11 of the Law, the amount of pension and monthly maintenance provides a replacement rate for the beneficiary's average monthly income at a level of at least 40 percent, determined in the manner determined by the Government of the Republic of Kazakhstan. When calculating the replacement rate of the average monthly income, the beneficiary's income prior to the date of retirement is taken into account, but not more than the average monthly income in the republic.

In this case, the lump sum pension benefit cannot exceed 50 percent of the amount of pension savings at the expense of CPC and (or) COPC of the contributor (beneficiary) as of the date of receipt of the initial electronic notification from the authorized operator;

3) those who have entered into a pension annuity agreement with an insurance organization.

At the same time, a lump sum pension benefit cannot exceed the amount of pension savings at the expense of CPC and (or) COPC on the individual pension accounts of the contributor (beneficiary).

Thus, pension savings can be used exclusively for the purposes and in the manner established by the legislation of the Republic of Kazakhstan. At the same time, pension savings cannot be used to pay for consumer loans.

3) Good day! I am getting ready to receive my pension savings ahead of schedule and I am interested in the issue of paying individual income tax. Will I pay in full now? How will I receive my remaining savings after retirement? Are there any deductions?

In order to determine the procedure for taxing the amounts of lump sum pension benefits from the UAPF, article 351-1 of the Tax Code of the Republic of Kazakhstan On taxes and other obligatory payments to the budget provides for the specifics of calculating, withholding and paying individual income tax (IIT) from lump-sum pension payments in order to improve housing conditions and (or) payment for medical treatment carried out in accordance with the pension legislation of the Republic of Kazakhstan

In this case, the IIT is calculated by applying the rates established by Article 320 of the Tax Code (in the amount of 10%) to the amount of a lump sum pension benefit.

Withholding and transferring the IIT from the amounts of lump sum pension benefits in accordance with paragraph 2 of Article 351-1 of the Tax Code are made by the UAPF in accordance with the application of an individual on withholding the IIT in one of the following ways:

1) at a time, no later than the day of the implementation of a lump-sum pension payment in the manner prescribed by Article 351 of the Code;

2) monthly in equal installments for no more than sixteen years according to the schedule established by the UAPF for pension benefits.

Withholding of the IIT is carried out on the basis of an application for withholding the IIT, submitted by an individual to a tax agent represented by the UAPF in the form established by the authorized body in agreement with the authorized body in the field of pension provision.

1) at a time, no later than the day of the implementation of a lump sum pension benefit in the manner prescribed by Article 351 of the Code;

Thus, when an individual submits an application for withholding the IIT from lump-sum pension payments in accordance with subparagraph 2) of paragraph 2 of Article 351-1 of the Tax Code, withholding and transferring the IIT will be carried out by the UAPF upon reaching the retirement age according to the schedule for pension benefits established by the UAPF.

Please note that Article 351-1 of the Tax Code, which defines the specifics of calculating, withholding and paying individual income tax from a lump sum pension benefit, does not provide for tax deductions. That is, tax deductions from the taxable base for calculating the IIT will not be applied only in terms of lump sum pension benefits.

Upon subsequent retirement, the beneficiary retains the right to apply tax deductions for pension benefits from the UAPF in the manner prescribed by paragraph 3 of Article 353 of the Tax Code.

Recall that compulsory pension contributions (CPC) are not subject to individual income tax (IIT), IIT is withheld upon receipt of pension benefits. In this case, tax deductions are applied (amounts that are deducted from the taxable base to calculate the amount of withholding tax).

Let us consider the numbers. For example, the benefit from the UAPF is 50,000 tenge, for the calculation of the IIT as a tax deduction, one minimum wage (minimum wage) is applied - 42,500 tenge. In this case, the amount subject to IIT (or taxable base) will be 7,500 tenge (50,000 tenge - 42,500 tenge = 7,500 tenge). It is from this amount that the IIT will be withheld in the amount of 10% or 750 tenge.

Thus, the beneficiary will receive an amount of 49,250 tenge (50,000 tenge - 750 tenge = 49,250 tenge).

If the beneficiary previously exercised the right to a lump sum pension benefit, for example, previously withdrew 5,000,000 tenge from his individual pension saving account with the payment of a deferred individual income tax (in the amount of 10% or 500,000 tenge) at retirement age, then the pension benefit of such a beneficiary at retirement age will change as follows.

The amount of the deferred IIT will be divided by the number of pension benefits, but not more than 192 payments (the payment of the deferred IIT is carried out within a period not exceeding 16 years). 500,000 tenge / 192 payments = 2,604.16 tenge.

And the beneficiary will receive an amount of 46,645.84 tenge (50,000 tenge - 750 tenge - 2,604.16 = 46,645.84 tenge).

4) Our mother is not officially employed and earns money by selling woolen things of her own making, but she is worried that in the future she will have a small pension, since she does not receive work experience. How can this problem be solved?

Your mom can pay the Single Aggregate Payment (SAP). To become a payer of the SAP, you do not need to register with the tax authorities, but you only need to pay the set amount of a single aggregate payment. The monthly payment of the SAP is 1 MCI (in 2021 - 2,917 tenge) - for individuals living in cities of republican significance, the capital and regional significance, 0.5 MCI (in 2021 - 1458.5 tenge) - for individuals living in other settlements. Payment is made through second-tier banks in one amount to the account of the State Corporation Government for Citizens. To make a payment, opening a bank account is not required. The amount of the single aggregate payment is distributed by the State Corporation in the following proportion: 10% - individual income tax (IIT), 20% - social security contributions (SSP), 30% - compulsory pension contributions (CPC), 40% - compulsory health insurance contributions (CHIC). For persons who have reached retirement age, the entire amount of the payment is recognized as individual income tax, and there is no distribution to social payments.

Thus, the SAP gives the right to participate in the accumulative pension system and receive a pension benefit depending on the length of time of participation in the system and existing savings. This will allow your Mom to receive a basic pension based on proven work experience. In addition, after paying the SAP, she becomes a member of the compulsory social health insurance system and will have access to medical services, unlimited in amount and types, with the right to choose a medical institution, and she will also be able to receive social benefits in cases of disability, job loss and other stipulated law cases.

Also, to ensure a decent pension in the future and replenish the pension saving account of Mom, you yourself or Mom can independently make voluntary pension contributions. You yourself determine the amount of the contribution and the frequency of paying the VPC, as well as the procedure for receiving pension savings when you become eligible for the VPC. To do this, it is necessary to conclude an agreement with the UAPF and transfer voluntary contributions to the UAPF to the bank details specified in the agreement. For convenience, the UAPF website has implemented a service for opening an individual pension saving account for accounting VPC online using the current EDS key. In addition, it is possible to pay VPC through banking services - the Kaspi.kz application, Halyk Bank terminals. As a result, VPC can be an excellent supplement to your Mom’s basic pension.

  1. Hello! I am a citizen of Russia, but since February 1, 2021, I have been temporarily living and working in Kazakhstan, how should pension savings be paid for me?

Pension provision for workers of the EAEU member states and family members is regulated by the legislation of the state of permanent residence, as well as in accordance with a separate international agreement between the EAEU member states. Such an international treaty is the Agreement on Pension Provision of Workers of the Member States of the Eurasian Economic Union dated December 20, 2019 (hereinafter referred to as the Agreement), which entered into force on January 1, 2021.

The main purpose of the Agreement is to form the pension rights of workers of the EAEU member states on the same conditions and in the same manner as the citizens of the state of employment, that is, each EAEU member state must guarantee to citizens of other EAEU member states the amount of pension rights equal to the scope of rights granted to its citizens on similar terms.

Thus, in accordance with Article 12 of the Agreement, containing transitional provisions, it is provided that the appointment and payment of pensions are carried out in the following order:

for the length of service acquired after the entry into force of the Agreement, the pension is assigned and paid by the EAEU member state in whose territory the corresponding length of service was acquired;

for the work experience acquired before the entry into force of the Agreement, the pension is assigned and paid in accordance with the legislation of the EAEU member states and the Agreement on guarantees of the rights of citizens of the member states of the Commonwealth of Independent States in the field of pension provision of March 13, 1992, and for the Republic of Belarus and Russian Federation - Agreement between the Russian Federation and the Republic of Belarus on cooperation in the field of social security dated January 24, 2006.

Thus, the norms of the Agreement will apply only to the length of service acquired by the worker in the period after the entry into force of the Agreement, subject to official employment with the conclusion of an employment or civil law contract, mandatory payment of pension (insurance) contributions to the pension system of the state of employment.

At the same time, subparagraph 2.3 of paragraph 2 of Article 2 of the Agreement establishes that in the Republic of Kazakhstan the Agreement applies to pension payments from the UAPF at the expense of formed pension contributions:

1)      upon reaching retirement age;

2) when establishing disability of the first and second groups, if the disability is established for an unlimited period;

3) a lump sum benefit to heirs.

Considering the above, we inform you that:

  1. From January of the current year, the employer is obliged, when calculating the income of citizens of the EAEU countries who work in Kazakhstan on the basis of a concluded empoyment or civil law contract without obtaining a residence permit for a foreigner in the Republic of Kazakhstan, to withhold and transfer pension contributions (CPC and COPC) to the UAPF. At the same time, an individual pension saving account (IPSA) for registering CPC will be opened in the UAPF automatically when the initial amount of CPC is credited from the employer, and to transfer the COPC it is necessary, together with the employer, to submit to the UAPF an application for opening an IPSA;
  2. in case of termination of the employment contract or civil law contract with the employer, the right to pension benefits from the UAPF will arise for these persons only upon the occurrence of the conditions provided for by subparagraph 2.3 of paragraph 2 of Article 2 of the Agreement.
