The provision of land plots or right to lease of the land plots which are in the public property and not provided to the land use shall be carried out at bidding(tenders, auctions), with the exception of cases, provided for in paragraph 1 of Article 48 of the Land Code of the Republic of Kazakhstan.

The land plot intended for selling shall be put up for bidding after:

determination of boundaries of the land plot;

establishment of designation of the land plot and its cadastral (assessed) value;

decision on bidding (tenders, auctions) process;

publishing report on bidding (tenders, auctions) process;

The local executive body acts as a seller of a land plot or a seller of the right to lease of a land plot.

The owner or a specialized organization acting on the basis of an agreement with the owne acts as the organizer of bidding (tenders, auctions).

The owner of a land plot determines the form of bidding (tenders, auctions), the original price of the subject of an auction and amount of earnest money.

The procedure for organizing and conducting bidding (tenders, auctions) for the sale of land or the right to lease land, including in electronic form, is determined by the central authorized body.

In case of refusal in granting the right to the land plot, except for the land plots for farming, agricultural production, due to the necessity of such granting at bidding (tenders, auctions) by the local executive body of the region, city of republican significance, the capital, district, city of regional significance, akim of a city of district significance, rural settlement, village, rural district, bidding (tenders, auctions) shall be held for the requested land plot within ninety days from the date of the decision to refuse in granting the right to the land plot

 The local executive body shall make a decision to provide a land plot or the right to lease a land plot within two working days after completion of the bidding (tenders, auctions). The buy and sell agreement or land rental agreement shall be concluded within one working day after the decision is made.
