In accordance with Article 50 of the Code, land plots are provided to citizens, with the exception of those included in the list of land plots offered for sale at tenders (contests, auctions) in accordance with paragraph 1 of Article 48 of this Code. The Republic of Kazakhstan into private ownership free of charge in the following amounts:
- for conducting personal subsidiary farming in rural areas (including household and cultivated areas)
- on non-irrigated lands of 0.25 hectares
- on irrigated lands of 0.15 hectares
- for individual housing construction-0.10 ha
- for landscaping, as well as cottage construction - 0.12 hectares.
Repeated gratuitous provision of land plots for these purposes is not allowed, except in the case specified in paragraph 4 of Article 94 of the Land Code.
The gratuitous transfer of land plots to private ownership for personal subsidiary farming (allocation of housing) and individual housing construction is carried out after land development. The provision of land plots for the period of development for these purposes is carried out on the basis of the right of temporary paid land use (lease) with the establishment of conditions and terms for the development of such land plots in accordance with article 92.
If there is gratuitous land on the territory of rural settlements, land plots for individual housing construction and the maintenance of personal subsidiary farms are provided in one array within the land plots provided for these purposes.
Land plots for landscaping are provided to citizens of the Republic of Kazakhstan on the basis of the right of temporary gratuitous land use in the amount of no more than 1 hectare.
