Private ownership of citizens of the Republic of Kazakhstan may include land plots for farming, personal subsidiary farming, afforestation, gardening, individual housing and suburban construction, as well as provided (provided) for construction or built up with industrial and non-industrial, including residential, buildings (structures, structures) and their complexes, including land intended for the maintenance of buildings (structures, structures) in accordance with their purpose.
The pre-emptive right to purchase a land plot into private ownership is held by a temporary paid land user (tenant) who has duly performed his duties under the lease agreement. The purchase of a land plot may be made before the expiration of the lease term of the land plot, if the lease agreement provides for the conditions for such termination.
The provision of land plots from state ownership to private ownership is carried out on a reimbursable basis by selling at a time or in installments by decision of the local executive body.
The procedure for granting the right to a land plot from land owned by the state is regulated by Article 43 of the Land Code of the Republic of Kazakhstan.
The decision on the provision of a land plot or refusal to provide a land plot is made on the basis of the conclusion of a commission established by local executive bodies from among deputies of a local representative body, representatives of territorial bodies for land management, architecture and urban planning and local governments (if any).
Individuals and legal entities interested in granting them ownership and (or) land use rights to land plots submit an application to the local executive body at the location of the land plot.
The application must specify: the purpose of using the land; its estimated size; location; the requested right of use.
