Chapter 1. General Provisions
These Rules for the accreditation of project management organizations in the field of architecture, urban planning and construction (hereinafter - the Rules) are developed in accordance with subparagraph 23-24) of article 20 of the Law of the Republic of Kazakhstan dated July 16, 2001 "On architectural, urban planning and construction activities in the Republic of Kazakhstan "and subparagraph 1) of article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013" On public services ".
The rules governs the accreditation of project management organizations in the field of architecture, urban planning and construction and determines the procedure for the provision of the public service "Accreditation of project management organizations in the field of architecture, urban planning and construction".
The following concepts apply in these Rules:
1) accreditation - the procedure for official recognition by the authorized body of the authority of an organization to manage projects in the field of architecture, urban planning and construction;
2) certificate of accreditation - a certificate certifying the status of a project management organization in the field of architecture, urban planning and construction;
3) applicant - a legal entity applying for accreditation as an organization for project management in the field of architecture, urban planning and construction;
4) authorized body - local executive bodies of regions, cities of republican significance, the capital.
Chapter 2. Rules and qualifications
The public service "Accreditation of project management organizations in the field of architecture, urban planning and construction" (hereinafter referred to as the public service) is provided by local executive bodies of the regions, the cities of Nur-Sultan, Almaty and Shymkent (hereinafter referred to as the service provider) in accordance with these Rules.
Legal entities (hereinafter referred to as the service recipient) shall send an application with documents in the form of an electronic document certified by electronic digital signature (hereinafter - EDS) to the service provider through the electronic government web portal www.egov.kz (hereinafter referred to as the portal) to receive public services.
The list of basic requirements for the provision of public services, including the characteristics of the process, the form, content and result of the provision, as well as other information, taking into account the specifics of the provision of public services, is set out in accordance with Appendix 1 to these Rules in the form of a public service standard (hereinafter referred to as the Public Service Standard).
The list of documents required for the provision of public services is determined by paragraph 8 of the Standard of public services.
Information of documents on state registration (re-registration) of a legal entity is provided to the service provider from information systems through the e-government gateway.
The service recipient agrees to the use of information constituting a secret protected by law contained in information systems.
The status of acceptance of the application for the provision of public services is indicated to the service recipient in the "personal account" with the date and time of receipt of the result of the public service.
Actions included in the process of providing public services, duration of implementation:
1) automatic registration of the application with the documents referred to in subparagraphs 1) and 2) of paragraph 6 of these Rules;
2) the issuance, renewal of the certificate in electronic form is carried out by the information system (computer) without the participation of the service provider - within 20-40 (twenty - forty) minutes.
Accreditation certificates are subject to renewal upon changing the name and (or) location of the legal entity.
The service provider ensures that data on the stage of the provision of public services is entered into the information system for monitoring the provision of public services in the manner established by the authorized body in the field of informatization in accordance with subparagraph 11) of paragraph 2 of Article 5 of the Law.
The accredited project management organizations for architecture, urban planning and construction are included in the Register of accredited architecture, urban planning and construction project management organizations in the form in accordance with Appendix 6 to these Rules, which contains the aggregate information on the details of the legal entity, date issuance and number of the certificate of accreditation, the availability of specialists in the staff, as well as information on measures taken in relation to this legal entity vennosti established by the laws of the Republic of Kazakhstan.
Suspension, renewal, deprivation (revocation) of the accreditation certificate is carried out in the manner and (or) on the grounds provided for in Article 45 of the Law of the Republic of Kazakhstan "On Permits and Notifications".
