The State institution "Department of Land Relations of Ulken Naryn District" (hereinafter referred to as the Department) is a state body of the Republic of Kazakhstan authorized by the Akimat of Ulken Naryn district to carry out activities in the field of land relations in the territory of Ulken Naryn district.

The Department carries out its activities in accordance with the Constitution of the Republic of Kazakhstan, the Civil Code of the Republic of Kazakhstan, the Administrative Procedural Code of the Republic of Kazakhstan, the Labor Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On public Procurement", the Law of the Republic of Kazakhstan "On Public Services", The Law of the Republic of Kazakhstan "On Combating Corruption", the Law of the Republic of Kazakhstan "On Legal Acts", the Land Code of the Republic of Kazakhstan, acts in the field of land relations, as well as the Regulations of the Department.

The Department is a legal entity in the organizational and legal form of a state institution, has a seal with the image of the State Emblem of the Republic of Kazakhstan and stamps with its name in Kazakh and Russian, letterheads of the established sample, accounts with treasury authorities in accordance with the Budget Code of the Republic of Kazakhstan, Order of the Minister of Finance of the Republic of Kazakhstan dated December 04, 2017 No. 540 "On approval of the Rules for Budget execution and its cash management".

The Department enters into civil law relations on its own behalf.

The Department has the right to act as a party to civil law relations on behalf of the State, if it is authorized to do so in accordance with the law.

The Department on issues of its competence, in accordance with the established procedure, makes decisions formalized by orders of the head of the municipal state institution "Department of Land Relations of Ulken Naryn District", provided for by the Civil Code of the Republic of Kazakhstan, the Labor Code of the Republic of Kazakhstan, the Budget Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On Legal Acts", The Land Code of the Republic of Kazakhstan.

The structure and staffing limit of the department are approved in accordance with the Labor Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan".

The activities of the Land Relations Department are financed from the local budget in accordance with the Budget Code of the Republic of Kazakhstan.

The Department is prohibited from entering into contractual relations with business entities for the performance of duties that are the Department's authority.

If the Land Code of the Republic of Kazakhstan grants the Department the right to carry out income-generating activities, then the income received is sent to the state budget.

The department's mission is to implement state policy in the field of land relations.

Department tasks:

1) regulation of land relations in the territory of Ulken Naryn district;

2) ensuring the implementation of land legislation, resolutions of regional and district executive bodies on the organization of land enforcement and protection, ensuring favorable environmental conditions and improving natural landscapes.

Department functions:

1) identification of ownerless land plots and organization of work on their registration;

2) implementation of the state policy in the field of regulation of land relations;

3) preparation of proposals and draft decisions of the local executive body of the district, city of regional significance on the provision of land plots and changing their intended purpose;

4) preparation of proposals and draft decisions of the local executive body of the district, city of regional significance on the establishment of public easements for the purposes of subsurface use related to the geological study and exploration of minerals;

5) preparation of proposals for the compulsory alienation of land plots for state needs;

6) determination of the divisibility and indivisibility of land plots;

7) organization of land management and approval of land management projects for the formation of land plots;

8) organization of the development of land zoning projects, projects and schemes for the rational use of land in districts and cities of regional significance;

9) organization of the development of projects for the land management of the territories of settlements;

10) organization of land auctions (contests, auctions);

11) conducting an expert examination of projects and schemes of urban and regional significance concerning the use and protection of land;

12) drawing up a balance of lands of districts and cities of regional significance;

13) keeping records of land owners and land users, as well as other subjects of land relations;

14) issuance of passports of agricultural land plots;

15) conclusion of purchase and sale agreements and lease agreements for land and temporary gratuitous land use and monitoring the fulfillment of the terms of the concluded agreements;

16) preparation of proposals for the issuance of permits by the local executive body of a district or city of regional significance for the use of land plots for survey work in accordance with Article 71 of this Code;

17) preparation of proposals for the transfer of agricultural land from one type to another;

18) identification of lands unused and used in violation of the legislation of the Republic of Kazakhstan;

19) preparation of proposals on land reservation;

20) approval of the land cadastre plan;

21) exercising, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

Rights and responsibilities of the department:

In order to implement the main tasks and perform its functions, the department has the right, in accordance with the procedure established by law:

1) to request and receive from government agencies, other organizations, officials and citizens the necessary information on the use and protection of land;

2) submit proposals for granting and terminating land rights for consideration by the executive bodies on the grounds provided for by legislative acts.;

3) exercise other rights stipulated by the legislation;

4) to make proposals on the cancellation of decisions of the akimat of Ulken Naryn district and maslikhat of Ulken Naryn district, contrary to the Land Code of the Republic of Kazakhstan;

5) exercise the powers provided for by the Regulations of the Department, the Land Code of the Republic of Kazakhstan, the Administrative Procedural Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan".
