The provision of land plots or the right to lease land plots owned by the state and not provided for land use is carried out at tenders (competitions, auctions), with the exception of cases provided for in paragraph 1 of Article 48 of the Land Code of the Republic of Kazakhstan.
Land intended for sale is put up for auction after:
determination of the boundaries of the land;
determination of the purpose of the land and its cadastral (estimated) value;
making decisions on bidding (tenders, auctions);
publication of messages on tendering (tenders, auctions).
The local executive body acts as the seller of the land plot or the right to lease the land plot. The organizer of tenders (tenders, auctions) is the owner or a specialized organization acting on the basis of an agreement with him. The owner of the land determines the form of tendering (tenders, auctions) the initial price of the subject of bidding and the amount of the deposit. The procedure for organizing and conducting tenders (competitions, auctions) for the sale of a land plot or the right to lease a land plot, including in electronic form, is determined by the central authorized body.
In case of refusal to grant the right to a land plot, with the exception of land plots for peasant or farm farming, agricultural production, due to the need for such provision at tenders (competitions, auctions) by the local executive body of a region, city of republican significance, capital, district, of a city of regional significance, akim of a city of regional significance, a village, village, rural district, tenders (competition, auction) for the requested land should be held no later than ninety calendar days from the date of the decision to refuse to grant the right to the land.
The decision of the local executive body on the provision of a land plot or the right to lease a land plot is taken no later than two business days after the completion of tenders (tenders, auctions). The contract of sale or lease of a land plot is concluded within one business day from the date of the decision.
