The new Law of the Republic of Kazakhstan "On Probation" dated December 30, 2016 provides for the institution of pre-trial probation.
In accordance with Article 13 of this Law, pre-trial probation is applied on a voluntary basis in relation to:
1) minors; 2) disabled people; 3) women: at the age of fifty-eight and over; pregnant women; having young children under the age of three; 4) men: at the age of sixty-three and over; bringing up young children under the age of three alone.
Pre-trial probation is carried out at the written request of these persons, from the moment of his application. Pre-trial probation is not applied to persons who have been subjected to a preventive measure in the form of house arrest or detention.
As part of pre-trial probation, social and legal assistance is provided. Based on the results of the implementation of this program, the probation service prepares a pre-trial report, submitted to the person to whom pre-trial probation is applied, before the start of the trial.
If the criminal case is terminated at the stage of pre-trial investigation, the probation service terminates pre-trial probation. At the same time, the provision of social and legal assistance to the person continues.
