The Prosecutor's Office of Akmola region summed up the results of work for 2022
The board of the Regional Prosecutor's Office with the participation of Deputy Prosecutor General of the Republic of Kazakhstan Dembaev Bulat Beknazarovich, chaired by the prosecutor of the region Mailybaev Aidos Serikkhanovich, reviewed the results of work for 2022.
It is noted that the criminogenic situation in the region is characterized by a general decrease in crime by 21% (from 6,602 to 5,208), including theft – by 21% (from 2,514 to 1,997), hooliganism – by 27% (from 82 to 60), fraud - by 6% (from 1,103 up to 1,032), including on the Internet – by 8%.
Crimes against the sexual integrity of minors were reduced by 36% (from 48 to 31), financial pyramids – by 57% (from 7 to 3), drug crimes – by 8% (from 268 to 247).
Coordination measures have achieved a decrease in crimes against the individual by 4%, against the family and minors - by 14%, against property - by 8%.
Attention is focused on the observance of the constitutional rights of citizens in criminal proceedings.
In the field of public interest protection, 165 inspections, 569 analyses were carried out, over 1,200 violations were detected, and the rights of 329 thousand citizens were protected. 1,605 persons have been brought to various types of responsibility. 1.9 billion tenge was reimbursed to the state revenue and property worth 1.9 billion tenge was returned.
In addition, effective inspections were carried out in the field of healthcare, land relations, sports, the road industry and budget spending.
Prosecutors are focused on protecting the rights of entrepreneurs, the rights of over 8,000 entrepreneurs are protected in the field of business protection, 27 officials have been brought to justice.
Deputy prosecutor of the region Berdikulov Zh.B. for excellent performance in the work was awarded the badge "Prosecutor's Office kurmetti kyzmetkeri".
Also, at the end of the year, the prosecutor's office of the Burabay district was recognized as the best prosecutor's office, and the prosecutor of the district Birzhan sal Nurmanbekov S.S. was recognized as the best investigative prosecutor.
The prosecutor of the region, A.S. Mailybaev, stressed that the most objective indicator of trust in the supervisory authorities is the appeals and statements of citizens. The regional prosecutor's office reviewed about 10 thousand appeals.
Based on the results of the work, tasks and priorities for 2023 were determined.
The first deputy prosecutor of the Akmola region Malakhov V.M. with the participation of representatives of the defense organizations, the akim of the district conducted a tour of the institution No. 1 Atbasar of the Akmola region and received 21 convicts on personal issues, 16 persons were explained their rights, 5 applications were accepted.
A meeting was also held with the staff of the administration of the institution on the issue of compliance with the legality of the constitutional rights of citizens, including on countering torture in the penitentiary system of the region.
The Prosecutor's Office of the Akmola region in the city of Kokshetau revealed significant violations of the rights of persons with disabilities and people with limited mobility.
Thus, 36 new objects (residential buildings, shops, public buildings) with such violations as the absence of ramps, incline angle mismatch and others were installed only by random inspection.
This makes it difficult for people in need of special needs to move.
According to the operational measures of the Prosecutor's office, 18 objects have been brought into compliance, lifting devices, ramps, sides, handrails, contrasting markings have been installed, thresholds on entrance doors have been removed.
The remaining facilities are also adapted in accordance with the requirements of the legislation.

On February 21, the Prosecutor's office of the Akmola region held an interdepartmental meeting with the participation of the chairman of the Akmola regional court Zhukenov A.S., the head of the Police Department of the region Taeva D.A., the head of the anti-corruption service of the region Rakhimov A.T. and other heads of law enforcement agencies of the region, as well as a representative of the Commissioner for Human Rights.
On this platform, the existing issues related to the problems of judicial and investigative practice, as well as compliance with the constitutional rights of persons involved in the orbit of criminal prosecution, were voiced.
The participants, having discussed the most common mistakes during the investigation of criminal cases, made specific proposals to prevent further violations of the norms of criminal procedure legislation.
It is noted that in 2022, the criminogenic situation is characterized by a decrease in crime registration by 21.2% (from 6,744 to 5,317).
The decrease is observed in all categories of severity.
Against this background, the number of detained citizens has also been reduced by 24% (from 690 to 525).
The Prosecutor of the region, A.S. Mailybaev, noted the importance of such events, which allow us to develop constructive proposals for improving judicial and investigative practice.
The judicial corps expressed its readiness to hold such meetings on a systematic basis and conduct a seminar-classes for novice employees of investigative units of criminal prosecution bodies.

«Torture» means any actions by which severe pain or suffering, physical or moral, is intentionally inflicted on any person in order to obtain information or confessions from him or from a third person, to punish him for an action that he or a third person has committed or is suspected of committing.
Each State Party shall take effective legislative and other measures to prevent acts of torture in any territory.
Torture is of deep concern to the international community. They are used not only to deliberately undermine the physical and mental health of individuals, but in some cases also in order to trample on dignity and break the will.
This year, the Prosecutor General of the Republic of Kazakhstan approved an Instruction on the organization of pre-trial investigation of criminal cases of torture in the Prosecutor's office.
The Prosecutor who has received a statement (message) about torture or has established the fact of torture, immediately registers it in the Unified Register of Pre-Trial Investigations (hereinafter - ERDR), with simultaneous urgent investigative actions.
The reporting of torture in places of deprivation of liberty, the registration of the ERDR is entrusted to the prosecutors overseeing the execution of court sentences.

For 3 years, citizens of our region continue to become victims of fraud.

Seminar on registration of pre-trial investigation and urgent investigative actions in cases of torture
Under the chairmanship of the Deputy prosecutor of the Akmola region Ilyasov Serik Kazakhstanovich, a seminar was held with the staff on the topic – «issues of registration of pre-trial investigation and urgent investigative actions in cases of torture».
Reports were made by the heads of the Departments of Special Prosecutors Kazhigaliev E.A. and criminal prosecution Petrova N.S., ways of solving problematic issues arising at the beginning of the organization of work in this direction were announced.
It should be recalled that since January 1, 2023, the exclusive jurisdiction in cases of torture has been determined by the prosecutor's office.
If earlier cases of torture were investigated by the anti-corruption service, the police's own security departments or other criminal prosecution bodies, now these cases are investigated exclusively by prosecutors.
This is a high trust on the part of the President of the country and the request of society, at the same time, and a huge responsibility for making objective and fair procedural decisions.

The rights of entrepreneurs were violated when providing regulated services
The protection of the rights of entrepreneurs is an urgent and priority direction of state policy.
In this area, the Prosecutor's Office of the Akmola region conducts analyses on an ongoing basis, including monitoring to identify and suppress illegal actions of state bodies.
An analysis of compliance with the requirements of legislation when drafting contracts for the provision of regulated services with business entities revealed a number of violations.
According to the requirements of the Standard Contract, payment is made by the consumer monthly for the amount of services actually provided up to the 25th day of the month following the billing period.
However, in the contracts for the provision of water supply services by monopolists, the payment deadline is unreasonably specified until the 15th.
A warning about the suspension (termination) of the provision of services is provided at least three calendar days in advance, whereas according to the requirements of the legislation, the period is 30 days.
These violations infringed on the rights of 892 entrepreneurs. According to the revealed violations, acts of prosecutor's supervision have been submitted to the local executive bodies.
According to the results of the review of the acts, the contracts were brought into line with the norms of legislation, the rights of 892 entrepreneurs were protected, the guilty officials were brought to disciplinary responsibility.
