Memorandum on Mutual cooperation between the Prosecutor General's Office of the Republic of Kazakhstan and the National Chamber of Entrepreneurs of the Republic of Kazakhstan on the protection of the rights of entrepreneurs

The Prosecutor General's Office of the Republic of Kazakhstan and the National Chamber of Entrepreneurs of the Republic of Kazakhstan, hereinafter referred to as the Parties, guided by the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan
"On the Prosecutor's Office", "On the National Chamber of Entrepreneurs of the Republic of Kazakhstan" and the legislation of the Republic of Kazakhstan within their competence and powers, have reached an agreement and concluded this Memorandum on the following:

Article 1

The purpose of this Memorandum is to implement joint and coordinated actions to form an institutional framework for the growth and further development of entrepreneurship in the Republic of Kazakhstan on the principles of constructiveness, transparency and efficiency of their activities.

Article 2

The parties support the development of cooperation by:

- ensuring and protecting the rights and legitimate interests of business entities;

- identifying systemic problems and barriers that hinder the development of entrepreneurship, presenting comprehensive measures to solve them;

- joint adoption of measures to identify and eliminate violations of the rule of law in the field of entrepreneurship, the causes and conditions that contributed to such violations, the restoration of the violated rights of business entities;

- taking measures to eliminate the facts of illegal inspections carried out by control and supervisory authorities in the activities of private business entities;

- creating favorable conditions for the growth of entrepreneurial activity and identifying new opportunities for the development of entrepreneurship;

- analysis and making proposals for improving the current legislation affecting the rights and legitimate interests of entrepreneurs;

- constant exchange of information between the Parties, expansion of contacts with representatives of the business community of Kazakhstan;

- performing other tasks provided for by the legislation of the Republic of Kazakhstan.

Article 3

Within the framework of this Memorandum, the following forms of interaction are provided for:

- holding joint meetings on a regular basis, including those organized by the Parties in the video conference format, with the participation of territorial prosecutors, chambers of entrepreneurs of regions, Astana and Almaty cities, representatives of business associations;

- rapid exchange of information of mutual interest in the field of business development;

- development of joint programs, creation of consultative and advisory bodies, working groups, in order to fulfill the tasks assigned to the Parties by the legislation of the Republic of Kazakhstan;

- other forms of cooperation within the competence of the Parties.

Article 4

In case of disputes and disagreements in the interpretation and application of the provisions of this Memorandum, the Parties shall resolve them by organizing meetings and negotiations.

Article 5

Amendments and additions may be made to this Memorandum by mutual consent of the Parties, which are drawn up by separate documents that are integral parts of this Memorandum.

Article 6

This Memorandum shall enter into force and enter into force from the date of its signing by the Parties.

Article 7

The Memorandum is concluded for an indefinite period and is valid until one of the Parties sends a written notification to the other Party of its intention to terminate the Memorandum. In this case, the Memorandum will be considered terminated from the date of expiration of 30 (thirty) calendar days from the date of sending a corresponding written notification to one of the parties.

The Memorandum was signed in Astana on December 23, 2013 in two copies in the state and Russian languages.
