The provision of land plots or the right to lease land plots that are state-owned and not provided for land use is carried out at auctions (tenders, auctions), except for the cases provided for in paragraph 1 of article 48 of the Land Code of the Republic of Kazakhstan.
A land plot intended for sale is put up for auction after:
determination of the boundaries of the land plot;
determination of the purpose of the land plot and its cadastral (estimated) value;
decision-making on holding tenders (competitions, auctions);
publication of a message on the holding of tenders (competitions, auctions).
The local executive body acts as the seller of the land plot or the right to lease the land plot.
The owner or a specialized organization acting on the basis of an agreement with him acts as the organizer of bidding (tenders, auctions).
The owner of the land plot determines the form of bidding (tenders, auctions), the initial price of the subject of bidding and the amount of the deposit.
The procedure for organizing and conducting tenders (competitions, auctions) for the sale of a land plot or the right to lease a land plot, including in electronic form, is determined by the central authorized body.
In case of refusal to grant the right to a land plot, with the exception of land plots for running a peasant or farm enterprise, agricultural production, due to the need for such granting at auctions (competitions, auctions) by the local executive body of a region, city of republican significance, the capital, district, of the city of regional significance, the akim of the city of district significance, settlement, village, rural district, tenders (competition, auction) for the requested land plot must be held no later than ninety calendar days from the date of the decision to refuse to grant the right to the land plot.
The decision of the local executive body to grant a land plot or the right to lease a land plot is made no later than two working days after the end of the auction (tenders, auctions). The contract for the sale or lease of a land plot is concluded within one working day from the date of the decision.
