What punishment is provided for family rowdies in Kazakhstan
Deputy Minister of Internal Affairs of the Republic of Kazakhstan Murat Baymukashev named the main preventive measures for family rowdies.
«We are taking systematic measures to protect our women and children. After the adoption of the law in 2009, taking into account law enforcement practice and the current situation, amendments were made to it. That is, the law was constantly updated. The powers of police officers, opportunities and the establishment of duties and restrictions on persons committing offenses in the sphere of family life have been expanded», Murat Baymukashev said at an international conference on the topic «Family Institute and family policy in Kazakhstan: problems, trends and prospects».
According to him, now a police officer has the right, if there is a threat of domestic violence, to prohibit a rowdy from approaching the victim, contacting her by any means, including by phone.
«The validity period of such restrictions is 1 month. They are issued in the form of a special protective order. Violations of prohibitions and restrictions entail administrative responsibility, up to administrative arrest for a period of 5 days. In cases where beatings or minor injuries were inflicted during a domestic conflict, the offender faces a more severe punishment in the form of administrative arrest for up to 10 or 15 days,» the speaker noted.
With such facts and there are grounds to believe that illegal actions will continue, the court has the right, on its own initiative or at the request of the Department of Internal Affairs or other participants in the proceedings, to establish stricter prohibitions and obligations against the violator.
«In particular, these are bans on the storage and carrying of weapons, on drinking alcohol even at home. And in special cases, the court has the right to evict a rowdy for 10 days if he has another home. The duration of these prohibitions can range from three months to one year. For the period of validity of the protective order for special requirements to the behavior of the violator, the person is placed on preventive registration and control of the local police inspector,» concluded M. Baymukashev.
