Rules for providing paid activities for the sale of services by state institutions of the Armed Forces for the provision of medical care within the guaranteed volume of free medical care and in the system of mandatory social health insurance and spending money from the sale of services

Chapter 1.
Generalities The rules for providing paid activities for the sale of services by state institutions of the Armed Forces to provide medical care within the guaranteed volume of free medical care and in the system of mandatory social health insurance and spending money from the sale of services (hereinafter – the rules) determine the procedure for providing paid activities for the sale of services by military medical institutions of the Armed Forces of the Republic of Kazakhstan (hereinafter-the Rules). – military medical institutions) to provide medical care within the guaranteed volume of free medical care and in the system of mandatory social health insurance and spending money from the sale of services. In accordance with these Rules, military medical institutions provide medical care within the list of guaranteed amounts of free medical care and medical care in the system of mandatory social medical insurance (hereinafter-paid types of medical services) :
1) persons dismissed from military service upon reaching the age limit of the state in military service, for health reasons, who have received an illness in connection with the performance of military service duties, as well as those who have twenty or more years of service;
2) family members of military personnel under the contract of the Armed Forces of the Republic of Kazakhstan (hereinafter-the Armed Forces);
3) military personnel of other troops and military formations of the Republic of Kazakhstan;
4) employees of special state and law enforcement agencies, the state courier service of the Republic of Kazakhstan;
5) civilian personnel of the Armed Forces;
6) other consumers of medical services. Paid types of medical services in military medical institutions are provided on the basis of contracts for the purchase of medical services concluded between the social medical insurance Fund (hereinafter – The Fund) and military medical institutions in accordance with the order of the Minister of health of the Republic of Kazakhstan dated August 7, 2017 No. 591 "on approval of the Rules for purchasing services from healthcare entities within the guaranteed volume of free medical care and in the system of mandatory social medical insurance" (registered in the Register of state registration of regulatory legal acts for No. 15604) (hereinafter – the procurement Rules). These Rules apply to military medical institutions that provide paid activities for the implementation of medical care services within the guaranteed volume of free medical care (hereinafter – gobmp) and in the system of mandatory social health insurance (hereinafter – OSMS).

Chapter 2.
The procedure for providing paid types of medical services in military medical institutions medical care is provided in accordance with standards in the field of health. Military medical institutions, when providing medical care, use clinical protocols adopted by the Commission on the quality of medical services, established in accordance with the current legislation of the Republic of Kazakhstan in the field of health, as well as by order of the Minister of health of the Republic of Kazakhstan dated December 8, 2017 No. 931 "on approval of the Kazakhstan national medicinal form" (registered in the Register of state registration of regulatory legal acts for No. 16141) (hereinafter – the Kazakhstan national medicinal form). Paid types of medical services are provided to consumers of medical services in the following types:
1) pre-medical care;
2) qualified medical care;
3) specialized medical care;
4) high-tech medical service;
5) medical and social assistance.

Medical care is provided to consumers of medical services in the following forms:
1) outpatient care in the form of consultative and diagnostic assistance;
2) inpatient care;
3) inpatient care.

The military medical institution provides maintenance of primary medical documentation in accordance with the current legislation of the Republic of Kazakhstan in the field of health.

Filling in and providing documentation by a military medical institution within the framework of concluded contracts for the purchase of medical services is carried out through information systems and electronic health information resources in compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of Informatization. Military medical institutions for the performance of part of the obligations under the contract for the purchase of services conclude a civil contract of co-performance with health care entities included in the database, and are also involved as co-performers in accordance with the rules of procurement.

Chapter 3.
Payment for the provision of paid types of medical services Is carried out by the Fund in accordance with the order of the acting Minister of health of the Republic of Kazakhstan dated March 29, 2018 No. 138 "on approval of the Rules for payment for services of healthcare entities and Rules for payment of the cost of pharmaceutical services to entities in the field of circulation of medicines and medical devices" (registered in the Register of state registration of regulatory legal acts No. 16685) (hereinafter – the payment Rules).

Payment for rendering of paid medical services is made according to the tariffs approved by order of the Minister of health of the Republic of Kazakhstan of September 5, 2018 No. R DSM-10 "On approval of tariffs for medical services rendered within the guaranteed volume of free medical aid in system of compulsory social health insurance" (registered in the Register of the state registration of regulatory legal acts for No. 17353). The formation of payment documents for paid types of medical services, reports and forms, as well as their submission to the Fund is carried out in accordance with the payment Rules. Military-medical institutions, performing obligations under the contract saipanese, payment for medical services rendered is a subject of health, which contracted saipanese, under an agreement with the Fund the contract purchase of medical services. When providing medical care to consumers of medical services by co-executors, payment for the rendered medical services is made by military medical institutions.

Chapter 4.
The order of the expenditure of money from the sale of paid medical services the Money from the sale of military-medical institutions of paid medical services, remaining at their disposal are credited to the control account of cash, opening of the Central authorized body on budget execution in accordance with the order of the Minister of Finance of the Republic of Kazakhstan of December 4, 2014 No. 540 "On the approval of Rules of budget execution and its cash services" (registered in the Register of the state registration of regulatory legal acts for No. 9934) (more – The rules of budget execution).

Military medical institutions for conducting operations at the expense of money received from the sale of services remaining at their disposal, annually draw up a plan of receipts and expenditures of money received from the sale of paid types of medical services in accordance with the rules of budget execution. The money received military-the medical institutions rendering paid medical services, are spent within the framework of costs associated with the provision of medical care under the SGBP and the system OSMS identified by the Method of formation of tariffs for medical services rendered within the guaranteed volume of free medical aid in system of compulsory social health insurance, approved by order of the Minister of health of the Republic of Kazakhstan dated November 26, 2009 No. 801 (registered in the Register of state registration of normative legal acts for No. 5946) (hereinafter-order No. 801) on:
1) purchase (provision) of medicines and medical devices and consumables in accordance with clinical protocols and the Kazakhstan national drug form;
2) feeding and equipping patients with soft equipment in accordance with the decree of the Government of the Republic of Kazakhstan dated January 26, 2002 No. 128 "on approval of natural norms for food and minimum standards for equipping state health organizations with soft equipment of the Republic of Kazakhstan»;
3) professional development and retraining of personnel;
4) payment for utilities: heating, electricity, hot and cold water;
5) other expenses, including communication services, including the Internet, travel expenses, maintenance, rental of premises, purchase (provision) of office, household and fuel and lubricants, other goods and services, maintenance, payment for banking services;
6) renewal of fixed assets in the cases stipulated by the work plan for the formation of tariffs for medical services (the medical services) provided under the SGBP and (or) in the system OSMS approved by the authority in accordance with the Rules of formation of tariffs for medical services provided under the SGBP and the system OSMS approved by the order № 801. Payment of the penalty assessed in accordance with the terms of the contract of purchase of services under the SGBP and the system OSMS shall be paid on account of the money received from the military medical institutions rendering paid medical services. To provide food for patients receiving medical care in accordance with these Rules, a military medical institution enters into a civil contract with a supplier that provides catering services in this institution for military patients. Preparation and submission of report on implementation of plans of income and expenditure of money from the sale of paid medical services in accordance with the order of the Minister of Finance of the Republic of Kazakhstan from December 2, 2016 № 630 "On approval of Rules of preparation and submission of budget accountability of public institutions, administrators of budget programs, authorized bodies on budget execution and akim of cities of regional importance, villages, towns, rural districts" (registered in the Register of state registration of normative legal acts No. 14613). Military medical institutions account for paid types of medical services in accordance with the order of the Minister of Finance of the Republic of Kazakhstan dated August 3, 2010 No. 393 "on approval of the Rules of accounting in public institutions" (registered in the Register of state registration of regulatory legal acts for No. 6443). 20. Taxation of funds received from the provision of paid activities for the sale of paid medical services is carried out in accordance with the tax legislation of the Republic of Kazakhstan.
