General provisions
The state Institution "Department of Urban Planning and Land Control of the Mangystau region" is a state body of the Republic of Kazakhstan that provides guidance in the field of state architectural and construction control, licensing, certification, accreditation, use and protection of land in the territory of the Mangystau region.
The State institution "Department of Urban Planning and Land Control of Mangystau region" carries out its activities in accordance with the Constitution, the Entrepreneurial Code of the Republic of Kazakhstan, the Land Code of the Republic of Kazakhstan, the Code of the Republic of Kazakhstan "On Administrative Offense", the laws of the Republic of Kazakhstan dated July 16, 2001 "On architectural, urban planning and construction activities in the Republic of Kazakhstan", from January 12, 2007 "On the procedure for consideration of appeals of individuals and legal entities", dated May 16, 2014 "On Permits and Notifications", dated November 18, 2015 "On Combating Corruption", dated November 23, 2015 "On the Civil Service of the Republic of Kazakhstan", acts of the President and Government of the Republic of Kazakhstan and other regulatory legal acts, as well as this Regulation.
The state institution "Department of Urban Planning and Land Control of Mangystau region" is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the treasury bodies.
The state institution "Department of Urban Planning and Land Control of the Mangystau region" enters into civil relations on its own behalf.
The state institution "Department of Urban Planning and Land Control of Mangystau region" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.
The state institution "Department of Urban Planning and Land Control of Mangystau region" on issues of its competence in accordance with the procedure established by law makes decisions issued by orders of the head of the state institution "Department of Urban Planning Control and Protection of Lands of Mangystau region" and other acts provided for by the legislation of the Republic of Kazakhstan.
The structure and staffing limit of the state institution "Department of Urban Planning and Land Control of the Mangystau region" is approved in accordance with the current legislation.

This Regulation is the constituent document of the state institution "Management of Urban Planning and Land Control of the Mangystau region"
Financing of the activities of the state institution "Management of Urban Planning and Land Control of the Mangystau region" is carried out from the republican and local budgets.
the state institution "Management of Urban Planning and Land Control of the Mangystau region" is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the state institution "Management of Urban Planning and Land Control of the Mangystau region".
If the state institution "Department of Urban Planning and Land Control of the Mangystau region" is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is directed to the state budget income.
Mission, goals, main tasks, functions, rights and obligations of the state institution "Department of Urban Planning and Land Control of Mangystau region"
The mission of the state institution "Department of Urban Planning and Land Control of the Mangystau region" is to implement the implementation of state policy in the field of architecture, urban planning, construction, development of the production base of the construction industry and state control over the use and protection of land in the territory of the Mangystau region.
The purpose of the state institution "Management of Urban Planning and Land Control of the Mangystau region": to ensure compliance with the norms of legislation and urban planning documentation during construction, operation of construction facilities and use of land plots.
Tasks of the state institution "Department of Urban Planning and Land Control of Mangystau region":
implementation of the state architectural, urban planning and construction policy in the subordinate territory;
prevention and timely response to violations of architectural and construction norms and legislation of objects under construction on the territory of the Mangystau region;
monitoring of objects and complexes under construction (planned for construction) in accordance with the procedure established by the authorized body for architecture, urban planning and construction on the territory of the Mangystau region;
implementation of control ensuring effective and rational use of land resources of the Mangystau region;
elimination of violations in the use of land;
introduction of digital technologies to ensure transparency of activities and improve the quality of public services;
implementation in the interests of local public administration of other tasks assigned to local executive bodies by the legislation of the Republic of Kazakhstan.
The functions of the state institution "Department of Urban Planning and Land Control of the Mangystau region" include:
implementation of state architectural and construction control and supervision over the quality of construction of facilities, application of administrative measures established by the Code of the Republic of Kazakhstan on Administrative Offenses to violators of architectural and urban planning discipline at these facilities;
implementation of licensing in the field of architectural, urban planning and construction activities;
certification of experts for the right to carry out expert work and engineering services in the field of architectural, urban planning and construction activities;
organization and supervision of the quality of project documentation;
accreditation of project management organizations in the field of architecture, urban planning and construction;
monitoring of facilities under construction (reconstructed, expanded, modernized, overhauled) and put into operation;
making decisions on the application of the provided legislative measures to violators in connection with violations and deviations from the norms of legislation, state regulatory requirements, conditions and restrictions established in the field of architectural, urban planning and construction activities;
carrying out inspections for:
8-1) availability of the relevant right to the land plot, approved design (design and estimate) documentation, a positive conclusion of the expert examination of projects, as well as notification of the bodies carrying out state architectural and construction control and supervision on the start of construction and installation works;
8-2) reliability of the data specified in the notification;
8-3) availability of a license for the right to carry out the relevant types of licensed architectural, urban planning and construction activities;
8-4) compliance of completed (performed) construction and installation works, applied building materials (products, structures) and equipment with approved design solutions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and operational qualities of buildings (structures);
8-5) organization and implementation by the contractor (general contractor) of all types and forms of own production control and supervision of the quality of construction (entrance, operational, acceptance, laboratory, geodetic and others);
8-6) timeliness and correctness of execution of executive documentation;
8-7) organization and implementation by the customer (owner) of technical and author supervision during the construction of facilities;
8-8) compliance by persons carrying out technical and author supervision with the requirements established by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities;
9) when detecting violations of state standards and (or) deviations from approved projects (project decisions), makes decisions (issues prescriptions):
9-1) on the prohibition of the use of building materials, products, structures and equipment that do not comply with national standards and specifications;
9-2) on the elimination by the customer (developer) and (or) the contractor construction and installation organization (enterprise) of the violations committed within the established time limits;
9-3) on suspension of construction and installation works;
10)implementation of licensing control, including taking appropriate measures against violators of licensing standards based on the results of inspections;
11) conducting organizational activities for the certification of experts providing expert work and engineering services (electronic testing);
