Transfer of objects to property lease (lease) without holding a tender
1. granting of objects for property hire (lease) without holding a tender is carried out in the following cases:
1) provision of premises (regardless of their area) and equipment (regardless of its cost) to educational, scientific, cultural and sports organizations for holding course classes, conferences, seminars, concerts, exhibitions and sporting events;
2) providing premises for a candidate, political party or their authorized representatives to meet with voters and conduct election campaigning;
3) provision of premises and equipment to suppliers who have concluded contracts on public procurement (state assignment) related to the supply of goods, performance of works and provision of services to the balance holders of objects or state legal entities located on this object, if the contract on public procurement (state assignment) provides for the provision of premises and equipment to suppliers;
4) provision of premises, buildings and structures with an area of up to one hundred square meters, other property (motor vehicles, equipment, furniture, office equipment) whose residual value does not exceed one hundred and fifty times the monthly calculation index;
5) provision of space for installation of ATMs and multicast;
6) implementation of the activities of the National postal operator in villages and rural districts;
7) provision of objects related to the district communal property and transferred to the administration of the akims of the city of district significance, village, settlement, rural district;
8) providing premises (regardless of their area) and equipment (regardless of its cost) to suppliers who have concluded contracts for the procurement of catering services for students in secondary education organizations.
2. in the case of two or more applications for the provision of property lease (lease) of objects provided for in sub-paragraphs 4) and 5) 7 of these Rules, their transfer to the property lease (lease) is carried out with the tender.
In the case of a tender in connection with the submission of two or more applications for the provision of property lease (lease) of objects provided for in sub-paragraphs 4) and 5) 7 of these Rules, by conducting a tender, the lessor shall ensure that information about the transfer of these objects to the property lease (lease) by conducting a tender on the web portal of the register within seven working days after such a decision is made.
3. The provision of an object for property hire (lease) without a tender is carried out on the basis of an application for the provision of an object for property hire (lease) (hereinafter – the application) in accordance with Annex 2 to these Rules.
The application should be made in electronic form on the web portal of the registry, specifying the name of the object, its owner, and needs justification in the object with the copy of (scanned) document certifying powers of the representative of the legal entity or individual (power of attorney).
For the objects specified in sub-paragraphs 3) and 8) of paragraph 7 of these Rules, the registry web portal accepts applications only from participants specified in contracts providing for the provision of state property (premises and equipment) to suppliers.
4. provision of premises to a candidate, political party or their authorized representatives for meetings with voters and conducting election campaigning shall be made on the basis of their written application in any form addressed to the landlord.
The lessor notifies the candidate, political party or their authorized representatives of their readiness to enter into a contract of property lease (lease) for real estate within two working days from the moment of receipt of the application.
The requirements of the second part of paragraph 9 of these Rules do not apply to cases when premises are provided to a candidate, political party or their proxies for meetings with voters and conducting election campaigning.
5. the Lessor shall consider an application for granting property lease (lease) of objects, with the exception of those specified in sub-paragraphs 4) and 5) 7 of these Rules within five business days.
The lessor considers the application for the provision of property lease (lease) of the objects specified in sub-paragraphs 4) and 5) 7 of these Rules within five working days from the date of receipt of the first application.
Based on the results of consideration of the application (s) for granting property lease (lease) of objects, the lessor makes one of the following decisions:
1) on the delivery of the object for property hire (lease);
2) on holding a tender in accordance with this Chapter, in the case of filing two or more applications for the provision of property lease (lease) of the objects specified in sub-paragraphs 4) and 5) paragraph 7 of these Rules;
3) on refusal to hand over the object for property hire (lease), if the lessor makes a different decision on the legal fate of the object, or if the object specified in the application does not meet the requirements of paragraph 7 of these Rules.
6. The contract with the lessee is concluded in electronic format on the web portal of the register and is signed by the lessor and the lessee using EDS within five working days from the date of making the decision to lease the property and is registered on the web portal of the register with the indication of the contract ID.
