Analytical reference about the work done in 2022 city public procurement department

KSU "Kyzylorda City Department of Public Procurement", Akimat of the city of Kyzylorda, in accordance with the finances of all administrators of budget programs, including settlements and rural districts for 2022, a single organizer (hereinafter referred to as the Department) organized purchases in the amount of 490 auctions, for a total amount 9 billion 203 million 289 thousand tenge. Of these: 185 tenders were held for the purchase of works, 169 for the purchase of services, and 136 for the purchase of goods. At present, 4 open tenders were announced in November at the request of customers. The reason is that these 4 competitions have been announced for the 2023 transition period and are in the Published stage.

At the same time, according to the Rules of Public Procurement, approved by order of the Minister of Finance of the Republic of Kazakhstan No. 44 dated January 17, 2022, in 2023, 47 procurements are carried out using the “using a framework agreement” method.

Also, according to the requests of the departments under the Akimat of Kyzylorda, the Public Procurement Department conducted 66 auctions in the amount of 24 billion 393 million 067 thousand tenge. Currently, 55 tenders have been completed, the procurement process is underway for the remaining 11 tenders.

In the period from January to December 2022, potential suppliers did not agree with the results of the tender and filed complaints with the authorized body, as a result of which 53 appeals were received on the prevention and elimination of violations of the law, including 37 appeals affecting the results of the tender and 16 messages, did not affect the results of the competition. Compared to the results of 2021, the Department of Internal State Audit in the Kyzylorda region received 174 acts, the relative indicator decreased by 69.5% (percent).

Also during the year, once a quarter, with the participation of management representatives and with customers, 3 seminars are held by providing the necessary information in the form of clarifications to the legislation on public procurement and standard draft technical specifications, letters and memos are regularly sent out as part of changes in the law on public procurement.

Since the beginning of the year, 2 lawsuits have been filed with the court. On the grounds of the complaint of the Department of Internal State Audit of the Kyzylorda Region and the Committee of Internal State Audit of the Ministry of Finance of the Republic of Kazakhstan in connection with the disagreement with the notification of the elimination of violations identified by the results of the desk audit, and the final decision refused to satisfy the objection, and the lawsuit was sent to court. As a result, 2 of them were rejected by a court decision.

As a result of the control carried out by the department, all competitions included in the public procurement plan are held on time.

In addition, legal trainings are held related to the changes and additions made to the Order of the Minister of Finance of the Republic of Kazakhstan dated December 29, 2018 No. 1127 “On determining the lists of goods, works, services provided by the organizers of unified public procurement” and discussion of current changes, as well as proper and effective procurement planning and avoidance of disruption due to increased accountability of public procuring entities.
