Completed works in the field of land relations for the second quarter of 2023
For the 2nd quarter of 2023, the district Department of Agriculture and Land Relations received only 130 appeals from individuals and legal entities. Of these: 22 - legal entities and 108-individuals, 80 appeals were satisfied, burdensome administrative acts were adopted – 24, redirected to another state organization -14, 3 - explanations were given, 2 were refused, 5 were considered.
For public services in the 2nd quarter of 2023, the department provided 16 types of state services. The total number of incoming appeals is 206 (of which 111 appeals were received through the electronic portal of the government, 95 appeals through state-owned enterprises). 16 services were rejected due to non-compliance with legal requirements.
No appeals were received for the remaining 4 types of public services.
1) In connection with the lease of land plots: For 6 months, the department concluded 18 lease agreements with individuals and legal entities, produced 4,091,900.0 tenge to the local budget.
2) In connection with the acquisition of a land plot from the state: For 6 months in connection with the acquisition of land plots for private ownership, 14 contracts were concluded in the amount of 2,262,101.0 tenge received by the local budget.
3) In connection with the change of purpose: akimats, settlements, rural districts carried out work to change the purpose of land plots in the amount of 2,200,036.0 tenge.
4) In connection with the sale of land at auction: 2 auctions (bidding) were held in 6 months. As a result, ownership rights to 25 land plots were sold in the amount of 4,300,887.49 tenge received by the local budget.
5) Recultivation of agricultural land: The introduction of agricultural land into circulation is included in the list of target indicators of the district development plan. In pursuance of the development indicator of the district, on January 20, 2023, Resolution No. 13 approved a list of 31 agricultural land plots with a total area of 15120.0 hectares in the district. 3,814 thousand tenge has been allocated from the local budget for land management works.
6) On the return to the state of the land plots associated with it:
An inventory of agricultural lands is being carried out in the district, a memorandum on the use of pasture lands of limited liability partnerships and peasant farms for seasonal pastures for the rural population has been issued. 15 agricultural land plots with an area of 16 780.0 hectares were returned to the state.

In total, 5846 people are in the queue for a land plot in three settlements for housing construction as citizens in need of special assistance. Including: the village of Zhosaly – 303, the village of Toretam - 3030, the village of Akai - 2513. The Department of Land Relations of the Kyzylorda region is working with the Government on additional land plots from the complex at the Baikonur cosmodrome for the village of Toretam and the aul district of Akai. In the village of Zhosaly in the Tauelsizdik microdistrict, the State Institution "Karmakshinsky District Department of Architecture and Urban Planning", in accordance with the territory development plan, a detailed planning project (PDP) for 171.0 hectares has been developed.
In the village of Zhosaly, from 2006 to 2017, land plots were allocated to citizens who are in a special queue for individual housing construction.
Including:
A total of 1,140 out of 1,831 people in the period from 2006 to 2017 had a pre-selected land plot.
900 people prepared and approved the settlement project according to a formalized plan.
As a result: a decision was made to transfer the right of land use (lease) to 900 persons.
Currently, during the survey of leased land plots, it has been established that housing construction is being carried out on 135 land plots and construction works are being carried out on 3 land plots by laying the foundation stone of the construction object, and 125 land plots have a lease term.
In addition, in connection with the completion of construction work, the owner of 95 land plots has issued the right of private ownership.
637 land plots were returned to the state due to the expiration of the lease term and undevelopment.
For information: by 2018 - 105; by 2019 - 50; by 2020 - 23; by 2021 - 26; by 2022 - 94; by 2023 – 5 citizens, a total of 303 citizens in the queue.
Completed works in the field of land relations for the first quarter of 2022
For 3 months of 2022, the district department of land relations of the Karmakshinsky district received only 33 appeals from individuals and legal entities. Of these: 8 - from legal entities and 29 - from individuals, a favorable administrative act was adopted for 17 appeals, an burdensome administrative act was adopted for 8 appeals, answers were given for 2 appeals, 3 appeals were redirected to another body, 3 were considered.
For public services in 3 months of 2022, the department provided 7 types of public services. The total number of incoming appeals is 81, including 64 appeals through the electronic portal of the government, 17 appeals through the state body. Including services rendered:
- approval of the land management project for the formation of a land plot - 46,
- determination of the divisibility and indivisibility of the land plot -7,
- issuance of a final decision on the transfer of agricultural land from one type to another -0,
- issuance of a permit for the use of a land plot for survey work – 3,
- sale of a land plot to private ownership at a time or in installments - 10,
- approval and issuance of the project of reclamation of disturbed lands – 0,
- issuance of a decision to change the purpose of the land plot -11.
With the inconsistency of the legislation, the 4th state services were denied.
The district budget for 3 months of 2022 was credited with a total amount of 5,462,634.0 tenge.
In particular:
- In connection with the lease of land plots: 20 lease agreements were concluded with individuals and legal entities for 3 months, 1,480,927.0 tenge was paid to the local budget.
- In connection with the sale of land plots to private ownership: in 3 months, 10 contracts for the purchase and sale of land plots were concluded with individuals and legal entities. 3 228 876.0 tenge was received from the sale of land plots.
- Due to the change in the purpose of the land plot: 13 applications were received from the akimats of the district, settlements and rural districts in 3 months, 2 of them were refused and 11 were satisfactory. As a result, the amount of 752,831.0 tenge was received by the local budget.
Turnover of agricultural land.
The turnover of agricultural land is included in the list of target indicators of the district development plan. In order to meet the development indicators of the district, the decree No. 96 of January 20, 2022 approved a list of 35 agricultural land plots with a total area of 20,289.0 hectares. 3,632 thousand tenge was allocated from the local budget for the land management project, public procurement was announced and the land management project was approved. For 3 months of 2022, the competition of agricultural land plots was held 1 time, according to the results of the competition, 4 land plots with a total area of 700 hectares were granted for the right of temporary paid land use for a period of 10 (ten) years.

According to the district, in three localities, 6766 people have been placed on special registration in the queue for a land plot for housing construction, a total of 6766 people. Including: in the village of Zhosaly – 2056 (of which 900 individuals were granted a land plot for residential housing), in the village of Toretam - 2603, in the rural district of Akai - 2107. For additional land plots for the village of Toretam and the rural district of Akai, work is being carried out between the Government and the Baikonur cosmodrome complex by the Department of Land Relations of the Kyzylorda region. In the village of Zhosaly, the Molteke microdistrict, KSU "Karmakshinsky District Department of Architecture and Urban Planning", in accordance with the territory development plan, a detailed planning project (PDP) for 171.0 hectares has been developed. According to the decision of the commission for the regulation of land relations of the village of Zhosaly, a positive conclusion was made on the allocation of a land plot for the construction of a residential building to 104 individuals who have been on a special queue since 2006, 290 persons since 2007, 155 persons since 2008, 84 persons since 2009, 65 persons since 2010, 11 persons since 2011 of the year, 49 persons since 2012, 67 persons since 2013, 87 persons since 2014 and 105 persons since 2015, 363 persons since 2016, 286 persons since 2017. Of these, 751 persons were decided by the akim of the village of Zhosaly to provide a land plot.

For the 12th month of 2021, the district department of land relations received only 307 appeals from individuals and legal entities. Of these: 17 - legal entities and 289-individuals, 231 appeals were satisfied, 75 - gave explanations, 0 were refused, 1 was considered.
For public services for 12 months of 2021, the department provided 7 types of public services. The total number of incoming appeals is 509 (of which - the electronic portal of the government - 440 appeals, through state-owned enterprises - 69 appeals). Among them: 368-approval of a land management project, 8-transfer of agricultural land from one type to another, 24- determination of a land plot into divisible and indivisible, 37-purchase and sale of a land plot, 17 services were refused for non-compliance with legislation.
The department credited the Republican and district budgets for 12 months of 2022 for a total amount of 22,701,026.3 million tenge.
In particular:
1) In connection with the lease of land plots: 164 lease agreements were concluded with individuals and legal entities for 12 months, 4,724,711.3 thousand tenge were made to the local budget.
2) In connection with the acquisition of a land plot from the state: For 12 months in connection with the acquisition of land plots for private ownership, 18 contracts were concluded for the amount of 6,689,569.0 thousand tenge received by the local budget.
3) In connection with the purchase of land from the state: For 12 months of 2021, 37 contracts related to the acquisition of land from the state were concluded, 8,177,995.0 tenge was transferred to the local budget.
4) In connection with the change in the purpose of the land plot: For 12 months, 61 applications were received from the akim's office of the district, settlement, rural districts for changing the purpose of land plots, of which 13 motivated refusals, 48 were satisfied. The district budget received 2,748,870.0 tenge.
5) Funds from agricultural expenses - 188,481.0 tenge.
6) On the return to the state of the land plots associated with it:
Since the beginning of the year, a total of 67 letters have been sent to the owners of land plots not in accordance with the intended purpose of the land plot note. Agricultural land plots with a total area of 5330.0 hectares were returned to the state (return 3 voluntarily, 9 unilaterally).
On the progress of work on the inventory of vacant land and compliance with land legislation in the district
In addition, 9 persons illegally owning land plots have been identified in the village of Toretam. In accordance with Article 136 of the Code of the Republic of Kazakhstan "On Administrative Offenses", 9 persons were sent to the Office of the akim of the village of Toretam, 5 of whom were fined a total of 984487.5 tenge. In the locality of Akai, 1 illegally occupied individual was identified. In accordance with Article 136 of the Code of the Republic of Kazakhstan "On Administrative Offenses", this person was sent to the Office of the Akim of the Akai rural District for consideration on the merits.
In the village of Zhosaly, 1 person was identified who illegally owns land plots. In accordance with Article 136 of the Code of the Republic of Kazakhstan "On Administrative Offenses", a fine was imposed for a total amount of 109387.5 tenge.
7) Withdrawal of agricultural land into circulation
The turnover of agricultural land is included in the list of target indicators of the district development plan.
In pursuance of the development indicators of the district, on January 20, 2021, Resolution No. 215 approved a list of 35 agricultural land plots with a total area of 15,527.0 hectares.
3,492 thousand tenge has been allocated from the local budget for land management works, public procurement has been announced, a land management project has been issued and approved. For 12 months of 2021, 4 tenders were held, according to the results of which 28 land plots with a total area of 12612.0 hectares were granted the right of temporary paid land use for a period of 10 (ten) years.
8) Information of waiting lists for a land plot for the construction of an individual residential building
In total, 6582 people are in the queue for a land plot in three settlements for housing construction as citizens in need of special assistance. Including: the village of Zhosaly – 2057 of which 1851 individuals were granted a land plot for residential housing, the village of Toretam - 2540, the village of Akai - 2103. During the survey of the transferred land plots, it was established that housing construction is being carried out on 155 land plots and construction work is underway with the laying of the foundation (foundation) of the construction object on 25 land plots.
In addition, in connection with the completion of construction works, 89 land plots were registered by the owner on the right of private ownership.
Due to the expiration of the lease term and undevelopment, 340 land plots were returned to the state.

For 9 months of 2021, the district department of land relations of the Karmakshy district received only 261 appeals from individuals and legal entities. Of these: 8 - legal entities and 253-individuals, 200 appeals were satisfied, 59 - explanations were given, 0 were refused, 2 were considered.
For public services in 9 months of 2021, the department provided 7 types of public services. The total number of incoming appeals is 425, including 372 appeals through the electronic portal of the government, 53 appeals through the state body. Including services rendered:
- approval of the land management project for the formation of the land plot - 308,
- determination of the divisibility and indivisibility of the land plot -21,
- issuance of a final decision on the transfer of agricultural land from one type to another -3,
- issuance of a permit for the use of a land plot for survey work - 7,
- sale of a land plot to private ownership at a time or in installments - 29,
- approval and issuance of a project for the reclamation of disturbed lands - 0,
- issuance of a decision to change the purpose of the land plot -41.
The inconsistency of the legislation of 16 states. the services were refused.
The republican and district budgets for 9 months of 2021 were credited with a total amount of 19,164,028.0 tenge.
In particular:
- In connection with the lease of land plots: 126 lease agreements were concluded with individuals and legal entities for 9 months, 3,478,364.0 tenge were paid to the local budget.

As a result, the amount of 1,900,795.0 tenge was received by the local budget.
Due to the loss of agricultural land, an amount of -186 000,0 tenge was received.

For 9 months of 2021, only 67 letters were sent to the owners of land plots not in accordance with the intended purpose of the land plot note. As a result, 8 agricultural land plots with a total area of 2230.0 hectares were returned to the state.

Among them: 183-approval of a land management project, 3-transfer of agricultural land from one type to another, 16-determination of a land plot into divisible and indivisible, 20-purchase and sale of a land plot, 6-issuance of a permit to use a land plot for survey work, 3-issuance of a permit to change the intended purpose of a land plot, no appeals were received for the remaining 2 types of state services.
The department credited the republican and district budgets for 6 months of 2021 for a total amount of 14,060,269.0 million tenge.
In particular:
1) In connection with the lease of land plots: For 6 months, 46 lease agreements were concluded again with individuals and legal entities, 2,381,529.0 thousand tenge were paid to the local budget.
2) In connection with the acquisition of a land plot from the state: For 6 months in connection with the acquisition of land plots for private ownership, 20 contracts were concluded for the amount of 4,452,982,0 thousand tenge received by the local budget.
3) On the return of land plots associated with it to the state:
Since the beginning of the year, only 67 letters have been sent to the owners of land plots in the district not in accordance with the intended purpose of the land plot note. 8 agricultural land plots with a total area of 2230.0 hectares were returned to the state (2-voluntary return, 6-unilateral).

For public services for 3 months of 2021, the department provided 7 types of state services. The total number of applications received is 98 (of which 80 are the electronic portal of the government, and 18 are received through state-owned enterprises). And they: 61-approval of the land management project, 0-transfer of agricultural land from one type to another, 11-determination of the land plot into divisible and indivisible, 6-use of land plots for survey work, 7-sale of the land plot to private ownership at a time or in installments, 6 - issuance of a decision to change the purpose of the land plot, for the remaining 2 types of state services, no appeals were received.
The department was credited to the Republican and district budgets for 3 months of 2021 for a total amount of 7,202,293 tenge.
In particular:
1) In connection with the lease of land: For 3 months, 17 lease agreements were concluded again with individuals and legal entities, 1,654,118. 0 tenge was paid to the local budget.
2) In connection with the acquisition of land from the state: For 3 months in connection with the acquisition of land for private ownership, 7 contracts were concluded for the amount of 1,148,854.0 tenge received by the local budget.
3) On the return to the state of the land plots associated with it:
Since the beginning of the year, a total of 59 letters have been sent to the owners of land plots not in accordance with the intended purpose of the land plot. Agricultural land plots with a total area of 2230.0 hectares were returned to the state (the return is voluntary).
Land circulation
The turnover of agricultural land is included in the list of target indicators of the district development plan.

Out of 1831 people, 1008 people have a preliminary selection scheme. According to the scheme, 765 people completed and approved the land management project.
As a result, a decision was made to transfer the right of land use (lease) to 765 persons and 765 lease agreements were concluded.
When studying the allocated land plots, it was revealed that housing construction was carried out on 113 land plots and the foundation stone was laid on 7 plots.
In addition, in connection with the completion of construction works, the owners of 76 land plots were registered as private owners. 338 land plots were returned to the State due to the expiration of the lease term and non-use of the development.

For 12 months of 2020, the district department of land relations received only 126 appeals from individuals and legal entities. Of these: 19 legal entities and 107 individuals, 68 applications were satisfied, 52 gave explanations, denied - 0, reviews - 6.
For public services for 12 months of 2020, the department provided 11 types of public services. The total number of applications received is 415 (of which 48 applications were received through the Department of State Corporations "Government for Citizens" of Kyzylorda Oblast, "Public Service Center", through the electronic portal of the government - 260 applications, through state enterprises - 106 applications). And they: 252 - approval of a land management project, 4 - transfer of agricultural land from one type to another, 26 - definition of a land plot into divisible and indivisible, 32 - purchase and sale of a land plot, 72 - a land plot lease agreement was concluded, the acquisition of rights to land plots that are in state ownership, which does not require tenders (tenders, auctions) -11, issuance of a decision to change the designated purpose of a land plot -8, no requests were received for the remaining 3 types of state services.
The department credited the republican and district budgets for 2020 for a total amount of 20 608.8 million tenge.
In particular:
1) In connection with the lease of land plots: During the year, 138 lease agreements were again concluded with individuals and legal entities, 3,916.4 thousand tenge were made to the local budget.
2) In connection with the acquisition of a land plot from the state: During the year of connection with the acquisition of land plots for private ownership, 30 contracts were concluded in the amount of 5,476.6 thousand tenge were transferred to the local budget.
