Anti-corruption in the Aral region on the status of actions

(According to the indicator of 12 months of 2021)

An anti-corruption commission has been established under the Akimat of the district (consisting of heads of local representative and executive bodies, heads of law enforcement agencies and representatives of non-governmental organizations). On January 5 of this year, a work plan for 2021 on anti-corruption issues was approved, and relevant work is being carried out.

In 2021, in accordance with the approved plan, 4 meetings of the commission, 1 unscheduled meeting, 5 legal trainings, 3 seminars were held in the district commission on combating corruption.

In the above-mentioned work plan for 2021, 6 issues were considered.

In particular, on February 8, 2021, on the agenda "On measures for the targeted use of funds allocated from the budget and control over accounting";

On August 2, 2021, according to the results of sociological surveys in the field of entrepreneurship by the international non-governmental organization Transparency International Kazakhstan, the progress of anti-corruption measures in this area is on the agenda";

On October 12, 2021, on the agenda " on the ongoing work on the formation of an anti-corruption culture and measures to ensure public access to information related to anti-corruption issues" and the unscheduled agenda " on the progress of ongoing activities and upcoming work on identified shortcomings in accordance with the resolution of the Republican Public Council for combating Corruption under the party"Nur Otan;

The performance pleased the audience with its sincerity. The audience, delighted with the skill of the artists of the regional House of Culture, expressed their appreciation and applause.

If there are facts of corruption on the territory of the region, in order to study and eliminate deficiencies in the territory of the district, warning letters are regularly sent to the heads of state institutions subordinate to the akimat of the district and akims of cities, towns, rural districts.

At the same time, within the framework of the project "Akmeshit-adaldyk alany", 25 special offices (corners) and 49 special offices (corners) were created in the building of the akimat of the district, as well as in the buildings of the akimats of cities, towns, rural districts under the akimat of the district in the buildings of schools in the district (including 9 schools located in the city of Aralsk, 40 schools located in settlements, rural districts), in all the above-mentioned schools (49, in total, billboards on combating corruption and the activities of the project office "Akmeshit-adaldyk Alany" in the amount of 27 pieces have been installed on the streets of the center and in places of mass congestion of rural districts.

In accordance with the plan of the project office "Akmeshit – Adaldyk Alany" for 2021, in order to introduce youth to honesty and justice, the Center "Adal Zhastar" was created and operates at the Youth Resource Center in the district center.

Within the framework of the project, measures were taken to prevent domestic corruption among the population in the district center, villages and rural settlements in various formats (round table, meetings with the population, dissemination of information and propaganda materials, a dialogue platform, an open Day and seminars). The events are informed about on the Facebook pages of each rural district (city, village).

In accordance with the order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016 No. 12, an internal analysis of the activities of state bodies subordinate to the akimat of the district, quasi-public sector entities (a total of 19 state bodies and quasi-public sector entities) for corruption risks was carried out in 2021, according to the results of which relevant proposals were made.

Based on the above, the district is constantly working to form a positive image of the public service, including in the direction of combating corruption.

Anti-corruption in the Aral region on the status of actions

In 2021, 2 commission meetings, 3 legal trainings, 3 seminars were held in the district.

Since the beginning of 2021, the fact of embezzlement of public funds by former accountants of state institutions subordinate to the akimat of the district (2 persons) has been established, in 2021 a court verdict imposed a punishment.

In this regard, on February 8, 2021, reports of the head of the district department of employment, social programs and civil registration and akim of the Belaransky rural district were heard on the agenda of the meeting of the anti-corruption commission under the akimat of the district "on measures to control the targeted use of budget funds and accounting", as a result of which specific instructions were given. The execution of the protocol is under strict control.

In addition, on February 18, 2021, the Department of the Anti-Corruption Agency of the Republic of Kazakhstan (Anti-Corruption Service) in the Kyzylorda region issued instructions concerning the submission of January 30, 2021 No. 5-1-5/476 and February 4, 2021 No. 5-1-5/565, considered at the meeting on the "ZOOM" program (online).

According to the plan, a meeting of the anti-corruption commission is planned under the chairmanship of the akim of the district. On the state of anti-corruption actions in the Aral district

On June 10, 2021, the head of the project office of "Akmeshit-Adaldyk Alany" of the Kyzylorda region, Master of Law Zhandos Tusmagambetov paid a working visit to the district, got acquainted with the work of the Aral regional hospital and independent departments, met with the akims of cities, towns, rural districts and representatives of non-governmental organizations.

On June 28, 2021, the secretary of the Kyzylorda regional Maslikhat Baykadamov Nauryzbay Seitkalievich, the head of the department of the Agency of the Republic of Kazakhstan for Combating Corruption (Anti-Corruption Service) for the Kyzylorda region, Major General Kozhakhmetov Kanat Ospanovich and first deputy Alimkulova Galiya Ubaydullovna, the head of the Department of Agriculture of the Kyzylorda region Duisebayev Talgat Tursynovich visited our district, deputy Director of the Chamber of Entrepreneurs of the Kyzylorda region Syzdykov Pirmukhammad Aitbayevich and held a meeting on subsidizing agricultural producers, preventing corruption in this area and measures of state support provided to farms by the local akimat.

The meeting was also attended by the secretary of the district maslikhat, akim of the city, akims of settlements and rural districts, heads of independent departments, territorial inspections, the Chamber of entrepreneurs, directors of enterprises, chairmen of peasant farms, individual entrepreneurs and media representatives.

On March 9, 2021, the Agency held a training seminar on conducting an internal analysis of corruption risks, which was attended by local executive bodies of the Aral region as part of a working group on conducting an internal analysis of corruption risks.

In accordance with the order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016 No. 12, in 2020, an internal analysis of the activities of state bodies subordinate to the akimat of the district, quasi-public sector entities (a total of 19 state bodies and quasi-public sector entities) for corruption risks was carried out, according to the results of which relevant proposals were made.

Within the framework of the project "Saktyk zhol-Adaldyk alany", "Adaldyk komek" and "Adaldyk alany" initiated by the Department of the Agency of the Republic of Kazakhstan for Combating Corruption (Anti-Corruption Service) in the Kyzylorda region, the akims of cities, towns, rural districts made reports and answered the questions of the population, going live through the Facebook page.

In addition, the "Adaldyk Alany" project initiated by the Anti - Corruption Agency of the Republic of Kazakhstan within the framework of the "Akmeshit-Adaldyk Alany" project, the regional center "Parasat Zholy" was opened at the Aral Central District Library, where all rural libraries participated in the opening through the ZOOM platform. The opening of the center was attended by honorary citizens of the Aral region, deputies of the Maslikhat, representatives of the clergy, veterans of the Afghan War and members of the Youth Resource Center, active youth from the field of education, culture, etc.

On March 9, 2021, the Agency held a training seminar on conducting internal analysis of corruption risks, which was attended by local executive bodies of the Aral region as part of the working group on conducting internal analysis of corruption risks.

On the state of anti-corruption in the Aral region

A commission on combating corruption (consisting of the heads of local representative and executive bodies, heads of law enforcement agencies and representatives of non-governmental organizations) has been established under the akimat of the district. On January 5 of this year, the work plan on anti-corruption issues for 2020 was approved, and relevant work is underway.

In the reporting period, under the chairmanship of the district akim, 4 scheduled, 2 unscheduled meetings of the commission were held, as a result, 125 protocol instructions were given.

Since the beginning of 2020, 1 fact of corruption has been registered in the district.

In this regard, reports of the head of the district Department of Education and the director of the Aral Multidisciplinary College were heard at the meeting of the commission on combating corruption under the akimat of the district.

In order to eliminate domestic corruption, create a favorable environment for the population, improve the quality of public services, the charter of the district working group of the project office "Akmeshit – adaldyk alany" was approved, and the head of this working group was appointed as a freelance adviser to the district akim.

In addition, a meeting was held with the participation of members of the district working group of the project office "Akmeshit - Adaldyk alany" in the Aral Multidisciplinary College, as well as in the Aral Industrial and Technical College.

In January 2020, in order to increase the moral and spiritual wealth of civil servants, a training was conducted with the participation of a member of the information and educational staff, a psychologist-coach Aymakhanova Nazira Kenzhebekovna, which was created under the department of the Agency of the Republic of Kazakhstan for Combating Corruption in the Kyzylorda region.

Within the framework of the project "Akmeshit-adaldyk alany", 25 special offices (corners) are equipped in the building of the district akimat, as well as in the building of the office of the akim of the city, village, rural district under the akim of the district.

In addition, 49 school buildings in the district are equipped with special offices and "Adaldyk dukeni"was put into operation in all the above-mentioned schools.

At the initiative of the Department of the Agency of the Republic of Kazakhstan for Combating Corruption in the Kyzylorda region, the action "People's Lawyer"was held 4 times.

During the campaign, representatives of state bodies accepted the appeal and provided free legal assistance to the residents of the district on issues of control and supervision, law enforcement, health, education, agriculture, housing, land relations, income, and provision of services to the population.

In addition, at the initiative of the Anti-Corruption Agency of the Republic of Kazakhstan, the campaign "Adal Komek"was launched in order to provide free legal assistance to citizens for the development of volunteerism among civil servants, civil society and youth.

On February 29, an action "Adal Komek" was held in the building of the district akimat.

During the campaign, residents who applied for an appointment were given free consultations by the staff of the akimat and experienced lawyers.

In addition, since the beginning of the year, 34 billboards on combating corruption and the activities of the project office "Akmeshit-alandyk alany"have been installed in places of mass congestion of the city, towns, rural districts and central streets.

In order to explain the changes and additions to the legislation on public procurement in 2020 with the participation of experienced experts of Astana Orleu LLP (certified at the international level) 53 civil servants have been trained.

In addition, in order to adapt the building of the district akimat to the "Open space" format, an office was created "Open Akimat".

Based on the above, the district will take measures to create a positive image of the public service, including strengthening anti-corruption efforts.

Introduction

The essence of the internal analysis of corruption risks is to identify corruption risks in the field of personnel management, control and supervision, implementation and organization of financial services in regulatory acts that affect the activities of all kindergartens subordinate to the office of the mayor of the city of Aralsk.

The internal analysis of corruption risks was carried out by collecting, analyzing and summarizing information, as well as collecting, analyzing and evaluating information obtained from legal statistics published in the media, appeals of individuals and legal entities, and other information not limited by law.

The internal analysis of corruption risks is conducted based on the results of 11 months of 2020.

The analysis consists of 3 main sections, namely the introductory, information - analytical and final part.

The practical value of internal analysis of corruption risks is to eliminate these shortcomings by taking organizational and legal measures on corruption risks.

Information and analytical part.

The Law of the Republic of Kazakhstan "On Combating Corruption" was adopted on November 18, 2015 (hereinafter-the Law).Paragraph 5 of article 8 of this Law states that State bodies, organizations and entities of the quasi-public sector conduct an internal analysis of corruption risks, based on the results of which they take measures to eliminate the causes and circumstances that contribute to corruption offenses.

In order to implement this requirement of the Law by order of the Chairman

The Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption of October 19, 2016 No. 12 approved the Model Rules for Internal Analysis of Corruption Risks. In paragraph 3 of the rules, the decision of the first head of the subject of internal analysis of corruption risks to conduct an internal analysis of corruption risks is made based on the results of anti-corruption monitoring.

According to the results of the anti-corruption monitoring, the working team created by the order of the mayor of the city dated November 12, 2020 No. 166-o / nk in the nursery-garden "Sartay"," Gulder"," Altyn Balyk "of the mayor's office of the city and the kindergarten" Chagall " conducted an internal analysis of corruption risks for 11 months of 2020.

Results:

In relation to appeals of individuals and legal entities, publications in the mass media:

when considering appeals (applications) of individuals and legal entities, there were no shortcomings in the terms, application of legal norms, re - filing of complaints, etc.

However, the register of complaints to the nursery-garden "Altyn Balyk" is not intended.

Also, the district's periodical printed newspapers do not publish negative articles on the facts of corruption related to the activities of local executive bodies.

For civil servants brought to disciplinary responsibility for corruption-related crimes:

For 11 months of 2020, there were no facts of criminal prosecution against officials for violating anti-corruption legislation and offenses that create conditions for corruption.

Nevertheless, for the irresponsible attitude to official duties, a strict reprimand was issued to the teacher of the nursery garden "Altyn Balyk" Sangasinova Zhanagul Shortanbaevna and the teachers of the nursery garden "Gulder" B. Kurmanova, A. Baidauletova, A. Daribayeva, a warning was issued in accordance with paragraph 1 of Article 64 of the Labor Code of the Republic of Kazakhstan.

Human Resources management.

The full-time number of employees of the nursery-garden "Altyn Balyk" is 71.5, the kindergarten"Chagall" - 35.1, the nursery-garden "Gulder" - 54.5 units.

In 2020, the nursery-gardens "Gulder", "Chagall" hired 1 full-time unit in the specialty of speech therapist. When hiring an employee, the requirements of the Labor Code of the Republic of Kazakhstan were met, published on the portal "Enbekkz" and accepted in the direction. There is no dismissed employee.

On the implementation of the Action Plan of the Aral Region for 2018-2020 on the implementation of the Anti-Corruption Strategy of the Republic of Kazakhstan for 2015-2025.

In connection with the prevention of corruption, the relevant banners in the kindergarten buildings are not placed in prominent places.

For public services.

According to article 5 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services", state bodies provide service recipients with complete and reliable information when providing public services. In accordance with this requirement, the standards of public services are placed in a prominent place in all kindergartens.

Rule-making in the nursery schools "Sartay", "Gulder", "Altyn Balyk" and the kindergarten "Chagall" registration of legal acts in accordance with the norms of the legislation and compliance with the legislation on public service.

When making legal acts, the requirements of the Law of the Republic of Kazakhstan of April 6, 2016 "On Legal Acts" were not observed in some kindergartens.

In particular, in the nursery-garden "Gulder", "Altyn Balyk" orders do not correspond to the resolution, in the nursery-garden "Sartai" mistakes were made in the execution of the order.

In accordance with article 13 of the Law of the Republic of Kazakhstan "On the Procedure for considering Appeals of Individuals and Legal Entities" (hereinafter referred to as the Law), heads of state bodies, local self - government bodies and their deputies are required to hold a personal reception of citizens and representatives of legal entities, including employees of these bodies, at least once a month, in accordance with the reception schedule approved by the head of the relevant state body.

According to the appeals of persons in this kindergarten and nursery school, no applications were received this year.

The log of registration of applications to the nursery-garden "Altyn Balyk" is not intended.

During the research work, the working group identified the following circumstances.

For financial services.

Paragraph 7 of Article 5 of the Law on Public Procurement states that customers have the right to make changes and (or) additions to the annual plan of public procurement no more than twice a month. However, if the annual plan was changed 3 times in January and 3 times in November in the Sartai nursery garden in connection with public procurement, 3 times in the Gulder nursery garden in January, 4 times in the Chagall nursery garden in January, and 3 times in February, then the requirements of the law are not met.

On the general document flow.

In state and non-state organizations, the log of registration of incoming documents, the log of registration of outgoing documents and the log of registration of internal documents must be opened in accordance with Annex 15 to the Decree of the Government of the Republic of Kazakhstan dated October 31, 2018 No. 703 "on approval of the Rules for Documentation, document management and use of electronic document management systems, and the corresponding receipt and expenditure documents must be registered.

In the nursery schools "Sartay", "Gulder" and the kindergarten "Chagall", a log of registration of incoming and outgoing documents has been opened and approved, since the beginning of the year, incoming letters and outgoing letters addressed to institutions are registered in the corresponding log.

However, in the nursery-gardens "Sartay", "Altyn Balyk", the log of registration of outgoing documents and the log of registration of internal documents are open, the names and numbers according to the approved nomenclature are not put down on the back of the folder.

In all kindergartens, the documents are not archived.

Final part

As the results of the internal analysis of corruption risks conducted in the first 11 months of 2020 show, in order to prevent, suppress and suppress the facts of corruption in the nursery-gardens "Sartay", "Gulder", "Altyn Balyk" and the kindergarten "Chagall" under the jurisdiction of the Mayor's Office of the city, the working group proposes to perform the following:

1) take control of the registration of relevant incoming and outgoing documents in special journals in compliance with the requirements of the Decree of the Government of the Republic of Kazakhstan dated October 31, 2018 No. 703 "On Approval of the Rules for Documentation, Documentation Management and use of electronic Document Management systems in state and Non-state organizations"; (term: permanent )

2) maintaining office folders for documents in accordance with the nomenclature, completing the relevant documents in folders;

3) to exercise strict control over the high-quality development of legal (regulatory) acts, compliance with the rule of law.

In order to prevent the above-mentioned shortcomings, for its part, conduct an analysis and, if there are shortcomings, immediately bring them into compliance with the law.

При акимате района создана комиссия по противодействию коррупции (в составе руководителей местных представительных и исполнительных органов, руководителей правоохранительных органов и представителей неправительственных организаций). 5 января текущего года утвержден план работы по вопросам противодействия коррупции на 2020 год, ведется соответствующая работа.
С начало года под председательством акима района проведено2плановые, 1 внеплановое заседании комиссии, по итогам было даны75 протокольных поручений.
С начала 2020 года в районе зарегистрировано 1 факт коррупции.
В связи с этим на заседании комиссии по вопросам противодействия коррупции при акимате района были заслушаны доклады руководителя районного отдела образования и директора Аральского многопрофильного колледжа.
В целях искоренения бытовой коррупции, формирования благоприятной среды для населения, повышения качества оказания государственных услуг утвержден устав районной рабочей группы проектного офиса «Ақмешіт – адалдықалаңы», а также руководитель данной рабочей группы был определен внештатным советником акима района.
Кроме того, с участием членов районной рабочей группы проектного офиса "Ақмешіт - адалдықалаңы" в Аральском многопрофильном колледже, а также в Аральском индустриально-техническом колледже была проведена встреча.
В январе 2020 года в целях повышения морального и духовного богатства государственных служащих, был проведен тренинг с участием члена информационно-просветительского штаба, психолога-тренера АймахановойНазирыКенжебековны, который был создан при департаменте Агентства Республики Казахстан по противодействию коррупции по Кызылординской области.
В рамках проекта «Ақмешіт-адалдықалаңы» в здании районного акимата, а также в здании аппарата акима города, поселка, сельского округа при акиме района оборудованы 25 специальных офисов (уголков).
Кроме того, в 49 зданиях школ района оборудованы специальные офисы и во всех вышеуказанных школах введен в эксплуатацию «Адалдықдүкені».
По инициативе Департамента Агентства Республики Казахстан по противодействию коррупции по Кызылординской области 2 раза проведена акция «Народный юрист».
В ходе акции представители государственных органов приняли обращение и оказали бесплатную правовую помощь обратившимся жителям района по вопросам контрольно-надзорной, правоохранительной, здравоохранения, образования, сельского хозяйства, жилья, земельных отношений, доходов, оказания услуг населению.
Кроме того, по инициативе Агентства Республики Казахстан по противодействию коррупции в целях оказания бесплатной правовой помощи гражданам для развития волонтерства среди государственных служащих, гражданского общества и молодежи стартовала акция «Адалкөмек».
29 февраля в здании районного акимата была проведена акция «Адалкөмек».
В ходе акции жителям, обратившимся на прием, были даны бесплатные консультации со стороны сотрудников акимата и опытных юристов.
Кроме того, с начала года в местах массового скопления населения города, поселков, сельских округов и центральных улицах было установлено 34 билбордов о противодействии коррупции и деятельности проектного офиса «Ақмешіт-алаңдықалаңы».
В целях разъяснения изменений и дополнений в законодательство о государственных закупках в 2020 году с участием опытных экспертов ТОО «Астана Өрлеу» (сертифицировано на международном уровне) прошли обучение на 53 государственных служащих.
Кроме того, в целях адаптации здания районного акимата к формату «Openspace» был создан кабинет «Открытого акимата».
На основании вышеизложенного, в районе будут проводиться мероприятия по формированию положительного имиджа государственной службы, в том числе усиление работы по противодействию коррупции.

On the state of anti-corruption in the Aral region

A commission on combating corruption (consisting of the heads of local representative and executive bodies, heads of law enforcement agencies and representatives of non-governmental organizations) has been established under the akimat of the district. At the initiative of the Department of the Agency of the Republic of Kazakhstan for Combating Corruption in the Kyzylorda region, the action "People's Lawyer"was held 2 times.

On February 29, an action "Adal Komek" was held in the building of the district akimat.

During the campaign, residents who applied for an appointment were given free consultations by the staff of the akimat and experienced lawyers.

In order to explain the changes and additions to the legislation on public procurement in 2020, 53 civil servants were trained with the participation of experienced experts of Astana Orleu LLP (certified at the international level).

In addition, in order to adapt the building of the district akimat to the "Open space" format, an office of the "Open Akimat"was created.

Based on the above, the district will take measures to create a positive image of the public service, including strengthening anti-corruption efforts.
