The Department of Internal State Audit for Pavlodar Region conducts ongoing desk audits of public procurement in accordance with the Rules for Conducting Desk Audits approved by Order of the Minister of Finance of the Republic of Kazakhstan No. 598 dated November 30, 2015.
During desk audits, violations are frequently identified that involve the establishment of qualification requirements in tender documentation that are not provided for by legislation.
For example, this year local executive bodies established requirements for permits in the form of a license for design activities with subtypes of «wooden structures», «preparation of estimate documentation», and a license for «veterinary treatment and preventive activities».
However, the above-mentioned permits are not provided for by the Law «On Permits and Notifications».
In turn, according to Article 11 of the Law «On Public Procurement», in the case of public procurement for which it is necessary to have a permit or to send a notification on the commencement of activities in accordance with the Law of the Republic of Kazakhstan «On Permits and Notifications», the customer, organizer, and single organizer are obliged to establish a requirement for potential suppliers and (or) engaged subcontractors (co-executors) to have the relevant permit (notification).
In this regard, the permits required for public procurement must comply with the Law «On Permits and Notifications».
When such violations are identified, the Department sends notifications to eliminate the violations, which are executed by the organizers of public procurement by introducing appropriate amendments to the tender documentation.
The response measures taken are preventive in nature and prevent the establishment of unjustified qualification requirements.
