The Department of Internal State Audit for Aktobe Region, based on an individual's appeal received through the State Institution "Department of the National Security Committee of the Republic of Kazakhstan for Aktobe Region," conducted an unscheduled audit of the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of Aiteke Bi District of Aktobe Region."
During the audit, it was established that a citizen belonging to socially vulnerable segments of the population was provided with housing from the state housing fund with a total value of 17,936.0 thousand tenge. Subsequently, when considering the privatization of the said housing, the housing commission failed to ensure proper verification of the completeness of the submitted documents and their compliance with legal requirements.
In particular, another person was included as a family member in the privatization process without proper documents confirming the legality of their participation and a corresponding decision of the housing commission. Moreover, information about the existence of real estate registered in the name of this person was not examined at all.
During the audit, it was established that the person included as a family member had several residential houses in private ownership.
Despite this, the housing commission made a decision to permit the privatization of the housing under the right of common joint ownership.
As a result, the state housing provided to a citizen with a disability who was registered as needing housing was registered not in their private ownership, but under the right of common joint ownership with another person, thereby violating the legal rights and interests of the citizen.
Based on the department's order, appropriate measures were taken to eliminate the identified violations and the violated rights of the citizen with a disability were restored. In particular, the housing privatization agreement was reissued exclusively in the name of the said citizen, and the ownership right to the housing was registered in their name in accordance with the established procedure. As a result, the apartment with a total value of 17,936.0 thousand tenge was privatized into the private ownership of the citizen with a disability.
