The Department of Internal State Audit for Pavlodar Region of the Committee of Internal State Audit of the Ministry of Finance of the Republic of Kazakhstan continuously carries out desk control to ensure compliance with legislation in the field of public procurement.
Since the beginning of the current year, during desk control, 62 violations have been identified on the part of customers, organizers, and unified organizers of public procurement.
The majority of violations are related to the preparation and conduct of tender procedures. In particular, cases have been identified where customers did not make changes to the draft tender documentation after receiving relevant comments from potential suppliers.
One such case was identified during the procurement of an interactive panel by the CSE "Secondary General Education School-Gymnasium named after Shapyq Shokin" of the Education Department of the City of Pavlodar, Education Administration of Pavlodar Region.
During the discussion of the draft tender documentation, potential suppliers submitted comments regarding the technical specification and its compliance with the subject of procurement. However, the customer did not make the appropriate changes to the draft tender documentation.
In addition, qualification requirements and other conditions not provided for by public procurement legislation were included in the technical specification for the draft tender documentation.
Thus, the SI "Finance Department of Pavlodar District", when procuring the goods "Lignite", established requirements in the technical specification for the draft tender documentation regarding the availability of "own or leased railway dead-end siding, own or leased open guarded coal warehouse".
Potential suppliers submitted comments to the draft tender documentation regarding the imposition of qualification requirements on potential suppliers.
At the same time, in accordance with the current legislation on public procurement, qualification requirements regarding the possession of material and labor resources are not imposed when procuring goods. However, the customer did not make the appropriate changes to the draft tender documentation.
Following the results of the desk control, notifications were sent to eliminate the identified violations of public procurement legislation, which were fully executed.
Such measures are preventive in nature. Their main goal is to prevent violations at subsequent stages of procurement, as well as to ensure compliance with the principles of legality, transparency, and openness.
Work on monitoring public procurement in the region continues. Specialists of the Department conduct a systematic analysis of procurement procedures, paying special attention to compliance with legislative requirements and improving the efficiency of public procurement.
