One of the most common violations in public procurement is the incorrect determination of the level of the single public procurement organizer. To avoid violations of the law, customers need to consider the established threshold values for procurement costs, which determine which single organizer should conduct the tender or auction.
Thus, for territorial subdivisions of central government bodies, procurement of goods, works, and services with a lot amount exceeding 20,000 MCI (86.5 million tenge) is carried out by the single organizer of the central government body.
At the regional level, the single public procurement organizer carries out procurement of goods, works, and services for regional administrators of budget programs and their subordinate organizations when the lot value exceeds 4,000 MCI (17.3 million tenge). For district administrators of budget programs and their subordinate organizations, such procurement is carried out by the regional single organizer when the value exceeds 40,000 MCI (173 million tenge). In addition, at the regional level, procurement for the development of design and estimate documentation and feasibility studies for district customers with a value exceeding 8,000 MCI (34.6 million tenge) is carried out, as well as procurement for medium and current repairs of regional highways and related engineering services.
District single organizers carry out procurement of goods, works, and services whose value does not exceed 40,000 MCI (173 million tenge), as well as procurement for the development of design and estimate documentation and feasibility studies with a value of up to 8,000 MCI (34.6 million tenge). Their competence also includes procurement for medium and current repairs of district highways, streets of populated areas, and their maintenance, as well as engineering services for the specified works.
It should also be remembered that procurement of homogeneous goods, works, and services by the method of requesting price quotations is carried out if their annual volume does not exceed 8,000 MCI (34.6 million tenge). Procurement from a single source under subparagraph 28) of paragraph 3 of Article 16 of the Law is allowed when purchasing homogeneous goods with a value of up to 100 MCI (432.5 thousand tenge), and works and services — up to 500 MCI (2.1625 million tenge). For the offices of akims of cities of district significance, villages, settlements, and rural districts, this threshold is up to 4,000 MCI (17.3 million tenge).
Correct determination of the level of the single public procurement organizer and compliance with the established threshold values will help avoid violations of the law, cancellation of procurement procedures, as well as the adoption of response measures based on the results of state audit and desk control.
