Violation when concluding contracts using a single-source method

Public procurement continues to be one of the key mechanisms for implementing state programs and developing infrastructure. In these conditions, adherence to the principles of legality, transparency, and fair competition becomes particularly important, especially when applying the single-source procurement method.

According to the results of the first quarter of 2026, the Department of Internal State Audit for the Akmola Region, as part of the desk control of procurements conducted through the single-source method, identified 243 violations totaling approximately 2.5 billion tenge.

The conducted analysis showed that the most common violations remain the procurement of homogeneous goods, works, and services exceeding the limits established by law, as well as instances of artificially splitting procurements to bypass competitive procedures. Such violations negatively impact the development of fair competition and create risks of inefficient use of budgetary funds.

Furthermore, cases were identified of concluding contracts for performing works and providing services to meet daily and weekly needs in the absence of legal grounds for applying the single-source procurement method, including without a confirmed refusal from the supplier to extend a previously active contract. Particular attention is paid to instances of missing supporting documents when leasing non-residential premises, which also constitutes a violation of legal requirements.

The Department notes that a significant portion of the violations are related to insufficient planning of procurement activities and a formal approach in preparing documentation.

To prevent violations, customers are recommended to conduct a needs analysis in advance, adhere to the principles of openness and competitiveness, and ensure documentary confirmation of all decisions made in the field of public procurement.
