The Department of Internal State Audit for the Zhetysu Region conducted an unscheduled audit at the State Communal Enterprise on the Right of Economic Management "Aksu Central District Hospital" of the state institution "Healthcare Department of the Zhetysu Region" regarding compliance with the norms of the legislation of the Republic of Kazakhstan on public procurement in the execution of contractual obligations.
The audit results established that, within the framework of public procurement for the supply of dry milk formulas intended for mixed and artificial feeding of children aged 0 to 6 months and 6 to 12 months, the supplied products do not meet the requirements of the Customer's technical specifications in a number of technical and qualitative characteristics.
In particular, the following discrepancies were identified:
according to the technical specifications, the osmolarity index of the formula should not exceed 295 mOsm/kg, whereas in the supplied products it is 300 mOsm/kg;
the iron content, set at a level not exceeding 0.7 mg/100 ml, actually amounts to 1.2 mg/100 ml;
the lactose share should be at least 90% of the total carbohydrates, however, in the "Nutrilak Premium 2" formula, this indicator is 61%.
Similar discrepancies were established for other product components, including fats, selenium, niacin, folic acid, prebiotics, and other indicators.
Thus, the supplied milk formula does not meet the requirements of the technical specifications established by the Customer.
In connection with the identified violations, the audit issued an instruction to eliminate them, as well as to consider the responsibility of the officials who allowed the violations.
Furthermore, in violation of the requirements of the Law of the Republic of Kazakhstan "On Public Procurement," the Customer did not take measures to apply to the court with a claim to recognize the supplier as an unfair participant in public procurement.
Regarding this fact, a protocol on an administrative offense, provided for by subparagraph 10-2 of paragraph 10 of Article 207 of the Code of the Republic of Kazakhstan "On Administrative Offenses," has been drawn up against an official of the enterprise.
