The Department of Internal State Audit for the Pavlodar Region of the Committee of State Audit of the Ministry of Finance of the Republic of Kazakhstan continuously carries out desk control over compliance with legislation in the field of public procurement.
During the control, isolated cases of unjustified application of the single-source procurement method were identified. According to public procurement plans, when concluding contracts using this method, customers apply subparagraph 35) of paragraph 3 of Article 16 of the Law of the Republic of Kazakhstan "On Public Procurement".
This legal provision provides for the possibility of temporarily procuring goods, works, and services of daily or weekly necessity for the period until the results of the main procurement procedure are summed up and the contract comes into force. However, the application of this method is permitted only in limited cases, including when a supplier refuses to extend a contract concluded in the previous year, and exclusively within the first month of the current year, or during the creation or reorganization of a customer.
However, customers applied this method without proper justification (such as a supplier's refusal to extend a contract concluded in the previous year). Furthermore, in a number of cases, the legally established timeframes during which this provision can be used had expired.
Thus, the application of this subparagraph under such circumstances contradicts the requirements of the current legislation and indicates non-compliance with the procedure for conducting single-source public procurement.
Regarding the identified violations, the Department is taking appropriate response measures. These measures are preventive in nature and aimed at preventing violations, as well as ensuring the principles of legality and openness in procurement. The Department continues its systematic work on monitoring and analyzing public procurement procedures to enhance their transparency and efficiency.
