“Department of Internal State Audit for Kostanay Region” (hereinafter – the Department) on February 2, 2026, as a result of desk (cameral) control conducted at the Municipal State Treasury Enterprise “Nursery-Kindergarten ‘Qarlygash’” (hereinafter – the Institution), identified a violation of paragraphs 5 and 6 of Article 16 of the Law “On Public Procurement”. Specifically, when forming the draft contract, the decisions on carrying out public procurement from a single source by direct conclusion of a contract, which must be adopted by the first head, were not attached.
In this regard, a notice to eliminate the violation No. 391010000-OIPD-10-371071 was issued with a deadline for execution until February 16, 2026. However, the Institution failed to comply with the notice within the установленный срок.
Therefore, by a court ruling, the head of the Institution was brought to administrative responsibility for an offense предусмотренное Part 3 of Article 462 of the Code of the Republic of Kazakhstan on Administrative Offenses — failure or improper fulfillment of lawful requirements, orders, submissions, or resolutions issued by state control and supervisory bodies (officials), as well as officials of state bodies within their competence.
Taking into account the nature of the committed offense, the head of the Institution was subjected to an administrative penalty in the form of a fine. In accordance with Part 2 of Article 829-11 of the Code of Administrative Offenses of the Republic of Kazakhstan, the amount of the fine was reduced by thirty percent.
