The Department of Internal State Audit in the Akmola region of the ISAC of MF of the Republic of Kazakhstan on an ongoing basis carries out desk control in the framework of compliance with legislation in the field of public procurement.
At the entrance of the desk control, the Department identifies violations that budget program administrators commit during public procurement.
Thus, according to the Law of the Republic of Kazakhstan "On Public Procurement," the following qualification requirements are imposed on potential suppliers and (or) subcontractors (co-contractors):
- have legal capacity (for legal entities) and civil capacity (for individuals);
- be financially stable and not have a tax debt exceeding six times the monthly calculation indicator established for the corresponding financial year by the law on the republican budget;
- not subject to bankruptcy or liquidation proceeding
-have material, labor and financial resources sufficient to fulfill obligations under the contract, as well as not have overdue wage arrears to employees;
- have work experience.
At the same time, according to the new law of public procurement, in the case of public procurement, for which it is necessary to have permission with the Law of the Republic of Kazakhstan "On Permits and Notifications," the customer, organizer, single organizer are obliged to establish a requirement for potential suppliers and (or) subcontractors (co-contractors) to have the appropriate permission (notification).
However, as the practice of public procurement shows, sometimes administrators of budget programs ignore the above legislative norms. This is especially true for RFQ procedures. For example, customers/organizers during public procurement for sanitary services did not indicate a license to provide disinfection, disinsection, deratization services in the field of health.
Such minor omissions as not indicating a license on the part of the organizers lead to the selection of suppliers who do not have the proper permission to provide services, perform work for which a certain permission (license) is required.
The Department, in accordance with the Rules for conducting desk control, in the event of such violations, sends notifications to the organizers to eliminate the violation.
Work on monitoring the legality of public procurement is carried out on an ongoing basis. Detection of violations at an early stage leads to a decrease in the administrative burden of audit objects and unlawful conclusion.
