The Constitutional Court did not identify permissible conditions to verify the constitutionality of the norm on the obligation of a citizen to submit a declaration of income after the termination of public service

A citizen applied to the Constitutional Court to review the constitutionality of Articles 630 and 633 of the Code "On Taxes and Other Compulsory Payments to the Budget (Tax Code)".

The citizen believes that the provisions of the above-mentioned articles, which oblige him to submit a declaration of assets and income after the termination of public service, violate his constitutional right to secrecy of personal deposits and savings, guaranteed by paragraph 2 of Article 18 of the Constitution.

Prior to the appeal to the Constitutional Court, this issue was subject to examination by the court of first instance and appealed in the appellate instance. On examination, the Constitutional Court noted that the obligation to submit a declaration does not limit the right to secrecy of personal deposits and savings. Moreover, the applicant based his application for constitutional review solely on his disagreement with the judicial acts, without providing any other arguments.

Thus, based on the results of the preliminary examination, the Constitutional Court did not identify permissible conditions for constitutionality review of the said norm.
