About the approval of the Rules of placement of the state sports order in sports sections for children and youth and their functioning
Order of the Minister of Culture and Sports of the Republic of Kazakhstan No. 120 dated April 27, 2021. Registered with the Ministry of Justice of the Republic of Kazakhstan on April 27, 2021 No. 22631.
This order comes into force on May 1, 2021.
In accordance with subparagraph 65-8) of Article 7 of the Law of the Republic of Kazakhstan "On Physical Culture and Sports", I ORDER:

To approve the attached Rules for placing the state sports order in sports sections for Children and Youth and their Functioning.
The Committee for Sports and Physical Culture of the Ministry of Culture and Sports of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) after the entry into force of this order, its placement on the Internet resource of the Ministry of Culture and Sports of the Republic of Kazakhstan;
3) within two working days after the execution of the measures provided for in this paragraph, submission to the Department of the Legal Service of the Ministry of Culture and Sports of the Republic of Kazakhstan of information on the execution of the measures.
Control over the execution of this order should be entrusted to the supervising Vice-Minister of Culture and Sports of the Republic of Kazakhstan.
This order comes into force on May 1, 2021 and is subject to official publication.

Rules of placement of the state sports order in sports sections for children and youth and their functioning

Chapter 1. General provisions
These Rules for placing a state sports order in sports sections for children and youth and their functioning (hereinafter – the Rules) are developed in accordance with subparagraph 65-8) of Article 7 of the Law of the Republic of Kazakhstan "On Physical Culture and Sports" (hereinafter – the Law) and determine the procedure for placing a state sports order in sports sections for children and youth and their functioning.
The following concepts are used in these Rules:
1) operator – a local executive body of a region, a city of republican significance and the capital, or its structural subdivision authorized to administer the procedure for placing a state sports order in accordance with these Rules;
2) supplier – a legal entity or an individual entrepreneur, regardless of the form of ownership, departmental subordination, types and types, except for educational organizations;
3) legal representatives of the child – parents (parent), adoptive parents (adoptive parents), guardian or trustee, foster parent (foster parents), foster carer and other persons replacing them, who, in accordance with the legislation of the Republic of Kazakhstan, take care, education, upbringing, protection of the rights and interests of the child.
Chapter 2. The procedure for placing a state sports order

The second, sixth, seventh, eighth parts of paragraph 3 are put into effect from 01.01.2023 in accordance with the order of the Minister of Culture and Sports of the Republic of Kazakhstan dated 15.09.2022 No. 265.
Placement of the state sports order in sports sections for children and youth (hereinafter – the state order) includes:
1) selection of suppliers for placing a state order;
2) the order of allocation of seats in sports sections.
The placement of the state order is carried out by the operator through an information system integrated with the information system "National Educational Database" (hereinafter – NOBD).
The placement of the state order is carried out among suppliers in the amount of funds provided for in the operator's budget for the corresponding year.
The draft plan for financing the state order is drawn up by the operator in full calendar year and posted on the official Internet resource of the operator annually no later than October 31 of the year preceding the planned year.
The approved state order financing plan is posted by the operator on the operator's official Internet resource annually no later than 5 (five) working days after its approval.
The approved amount of financing of the state order is placed by the operator on the information system annually on the first working day of the financial year, minus the amount of funds provided for the continuation of financing of the state order of the previous financial year.
When allocating additional funds from the operator's budget for the implementation of the state order, the approved amount of additional funding is placed in the information system no later than 3 (three) working days after its approval.
The recruitment of a contingent of children is carried out by the operator through an information system automatically on the basis of electronic applications submitted by the legal representatives of the child under a certain supplier. When recruiting a contingent of children, the information system allocates places to sports sections for children and youth (hereinafter referred to as sports sections), guided by the order provided for in paragraphs 11 and 12 of these Rules.
Placement of a state order, recruitment of a contingent of children, as well as other related functional operations of the supplier, operator and legal representative of the child related to these processes are carried out free of charge for the supplier and the legal representative of the child;
3) ensuring the execution of all stages and procedures of placement, quality control and targeted development of the state order in electronic and publicly available formats.
Paragraph 1. Selection of suppliers for placing a state order

The first part of paragraph 4 is put into effect from 01.01.2023 in accordance with the order of the Minister of Culture and Sports of the Republic of Kazakhstan dated 15.09.2022 No. 265.
In order to participate in the placement of a state order, the supplier, through the information system, submits to the operator an application in the form according to Annex 1 to these Rules with the following documents attached:
1) for individuals – notification of the beginning of activity as an individual entrepreneur or a coupon of an individual entrepreneur, or a certificate of an individual entrepreneur, for legal entities – a certificate of state registration (re-registration) of a legal entity;
2) title documents for immovable property owned by the supplier and (or) on another legal basis, for use in organizing the activities of the sports section.
The term of the document confirming the right to use real estate is at least 10 (ten) months after the date of submission of the application by the supplier.
When using real estate that is in state ownership, a service agreement is provided, where the service provider is the balance holder directly with the provision of title documents;
3) a copy of the sanitary and epidemiological conclusion on the compliance of the building/premises of the Organization with sanitary and epidemiological requirements, according to the order of the Minister of Health of the Republic of Kazakhstan dated November 30, 2020 No. KR DSM-336/2020 (registered in the Register of State Registration of Regulatory Legal Acts of the Republic of Kazakhstan under No. 22004) or a copy of the notification of the commencement of activity (operation) of the facility of minor epidemic significance;
4) a sports curriculum approved by the supplier, containing:
goals and objectives of the curriculum;
predicted sports results;
the content of classes by degrees of study (listing the topics of classes for one calendar year with an indication of the number of classes spent on one topic, in accordance with the Methodology of Per capita regulatory financing of the state sports order approved by the Order of the Minister of Culture and Sports of the Republic of Kazakhstan dated April 27, 2021 No. 119 (registered in the Register of State Registration of Regulatory Legal Acts of the Republic of Kazakhstan under No. 22633) (hereinafter referred to as the Methodology));
description of material and technical equipment for providing classes;
schedule of classes;
the planned schedule of internal events, including competitive (competitive), reporting events and open lessons for the legal representatives of the child;
information about the individual inventory and equipment of children required for classes;
regulations for visiting the sports section;
5) a list of employees involved in conducting classes with children, with the attachment of documents and information specified in paragraph 5 of these Rules.
