The procedure for limiting and terminating the supply of electric energy to the consumer

The relations arising between energy-producing, energy-transmitting, energy-supplying organizations and consumers of electric energy in the wholesale and retail markets are regulated by the Civil Code of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan in the field of electric power.

The procedure for the use of electric energy by energy-producing, energy-transmitting, energy-supplying organizations and consumers in the territory of the Republic of Kazakhstan is determined by the Rules for the Use of Electric Energy approved by Order No. 143 of the Minister of Energy of the Republic of Kazakhstan dated February 25, 2015 (hereinafter referred to as the Rules).

Paragraph 51 of the Rules defines the cases in which an energy enterprise has the right to stop completely or partially supplying electric energy, these include:

absence of payment, as well as incomplete payment for electric energy within the terms established by the power supply contract, at the request of the energy supply organization;
violation of the electricity consumption regime established by the power supply contract
, failure to comply with the requirements of the energy transmitting (energy producing) organization on the elimination of violations of these Rules within the established time limits.

Much attention is paid to the proper notification of the consumer by the energy enterprise about the upcoming restriction in the supply of electric energy. Thus, the Rules regulate that the energy supply organization is obliged to send a notification at least 5 (five) working days before the termination of the supply of electric energy to the Consumer. For consumers using electric energy for household needs, the notification period is at least 30 (thirty) calendar days before the introduction of restrictions.

Without prior notice, complete termination of the supply of electrical energy is allowed in the following cases:

unauthorized connection of electric energy receivers to the electric network of an energy transmitting (energy producing) organization;
connection of electric energy receivers in addition to (excluding) commercial electric energy metering devices;
reducing the quality indicators of electric energy through the fault of the consumer to values that disrupt the functioning of electrical installations of an energy transmission (energy-producing) organization and other consumers;
preventing representatives of energy-transmitting (energy-producing) organizations and the energy supervision and control body from accessing commercial metering devices of electric energy and electrical installations of the consumer during working hours (as a business trip);
emergency situation.

For all issues of compliance with the legislation of the Republic of Kazakhstan in the field of electric power, consumers can contact the State Institution "Territorial Department of the Committee for Atomic and Energy Supervision and Control of the Ministry of Energy of the Republic of Kazakhstan for the Kostanay region" located at 75 Gogol Str., office 219, Kostanay or by phone 8 (7142)-50-02-60.
