In accordance with the Law of the Republic of Kazakhstan dated 03.07.2002 No. 331 "On Plant Protection" (hereinafter – the Law), the main objectives of the state policy in the field of plant protection are:
1) ensuring food security of the state;
2) ensuring a favorable phytosanitary situation;
3) prevention and prevention of harmful effects of pesticides on human health, pollution of agricultural products, the environment during phytosanitary measures.
In order to prevent the implementation, the use of plant protection products for other purposes, prevention and prevention of the harmful effects of pesticides on human health, it is necessary to comply with the requirements of the legislation of the Republic of Kazakhstan in the field of plant protection, so according to Article 14-5 of the Law, individuals and legal entities whose activities are related to the objects of state phytosanitary control, are obliged to: "2) comply with the requirements safety in the sphere of pesticide turnover, established by technical regulations".
According to the Technical Regulations on the Safety of plant protection products (pesticides) approved by the Order of the Minister of Agriculture of the Republic of Kazakhstan dated June 8, 2020 No. 197 (hereinafter referred to as the Technical Regulations), the requirements are established:
Chapter 6. Requirements for the safety of pesticides in their implementation.
The sale of registered pesticides on the territory of the Republic of Kazakhstan is allowed only after obtaining a license for the sale of pesticides.
The sale of pesticides for gardens and vegetable gardens from agricultural pests, diseases and weeds, as well as means to control domestic rodents intended for use in personal subsidiary farms, is carried out through non-food specialty retail stores.
Suppliers (importers, sellers) engaged in wholesale and retail trade in pesticides are allowed to purchase and sell only pesticides that have passed state registration.
The release of pesticides to consumers is allowed only in the manufacturer's containers, if there is relevant information on safe use measures, including information on the neutralization (disposal, destruction) of pesticides unsuitable for further use and containers from under them, as well as containers from under used pesticides in compliance with the requirements of the Law of the Republic of Kazakhstan dated May 4, 2010 "On consumer protection".
Chapter 7. Requirements for the safety of pesticides during their storage, transportation and use
The storage of pesticides is carried out in compliance with the requirements established in accordance with Article 19-9 of the Law on Plant Protection, as well as those provided for by the packaging label, recommendations for the use of specific pesticides, their classification codes, including the creation of conditions for the separate storage of preparations incompatible in their physicochemical properties (volatility, oxidizability and other properties), fire and and explosion hazard, reactivity, temperature conditions of storage.
Admission of individuals and legal entities to work on the use of pesticides is carried out in accordance with this technical regulation.
