From the date of receipt of the relevant court order with a copy of the sentence, the Probation Service, no later than ten calendar days, summons the convicted person to punishment in the form of community service and issues a referral certificate to the local executive bodies at the place of residence of the convicted person for performing community service. Control over the performance of public works by convicted persons is carried out by the Probation Service at the place of residence of the convicted person. At the main place of work of a convicted person to community service, the Probation Service sends a message about his release from work for the duration of community service. The probation service, when referring a convicted person to a local executive body, hands him a referral certificate. The referral certificate specifies the personal data of the convicted person, his place of residence and place of main work( study), the article of the Criminal Code of the Republic of Kazakhstan (hereinafter – the Criminal Code of the Republic of Kazakhstan) under which he was convicted, the term of public works (in hours), the date of the appearance of the convicted person to the local executive body, the procedure for calculating it in accordance with Article 58 of the Criminal Executive Code of the Republic of Kazakhstan (hereinafter - the PEC of the Republic of Kazakhstan), the duties of the local executive body according to Article 62 of the PEC of the Republic of Kazakhstan. Convicted persons are involved in performing socially useful works that do not require any special training in the improvement of the territory. When changing the place of residence, a convicted person serving a sentence in the form of community service immediately notifies the Probation Service, which sends a corresponding request to the Probation Service at the new place of residence of the convicted person. After receiving confirmation, the Probation Service sends a submission to the local executive body about the dismissal of the convicted person to community service, and the personal file and accounting documents to the Probation Service at the new place of residence of the convicted person. The probation service at the new place of residence of the convicted person sends information confirming the receipt of a personal file and a registration card and issues a certificate to the convicted person-a referral for performing public works at the new place of residence of the convicted person. If the place of residence of the convicted person changes within the served area (city), the convicted person is not removed from the Probation Service's register. Public works are performed with the release of the convicted person for the time of their performance from labor duties at the place of main work, or in their free time of study no more than 4 hours a day. Granting the convicted person another vacation at the main place of work does not suspend the performance of public works. The beginning of the term of serving public works is the day when the local executive bodies receive a referral certificate. The probation service makes a decision on allowing the convicted person to work less hours during the week if there are the following valid reasons: illness of the convicted person(medical certificate), temporary departure of the convicted person from the place of permanent residence for valid reasons(involvement in military training, serious illness, or death of close relatives). If a convicted person is recognized as a disabled person of the first or second group according to the conclusion of the medical and social expert commission, the Probation Service sends a submission to the court to release him from further serving of the sentence. If a convicted person becomes pregnant while serving a sentence, the Probation Service sends a submission to the court about the postponement of serving her sentence from the date of granting maternity leave. In case of violation by the convicted person of the order and conditions of serving the sentence, the Probation Service issues a written warning about responsibility, which the convicted person gets acquainted with under the signature, after which it is filed in a personal file. If a convicted person evades serving a sentence, the Probation Service sends a submission to the court to replace public works with arrest in accordance with part 2 of Article 43 of the Criminal Code of the Republic of Kazakhstan. The submission on the replacement of public works for the evasion of a convicted person from serving a sentence is sent to the court within a month from the date of detection of the last violation. In addition to a detailed and motivated presentation on the replacement of community service with another type of punishment, the Probation Service additionally sends the following documents to the court: a written explanation of the convicted person himself, describing materials and information about the application of administrative and disciplinary measures to the convicted person. The submission on the replacement of public works for the evasion of a convicted person from serving a sentence is sent to the court within fifteen calendar days from the date of detection of a repeated violation, and in respect of persons who have fled from their place of residence, after the initial search measures are carried out.
