"Without improving the quality of life of people, it is unnecessary to be proud of the achievements and international successes of our country. All citizens should feel the real benefits of economic development. I follow this principle when making every decision. Along with improving the social situation of the population, it is also important to protect the rights and ensure equal opportunities for every citizen. In my understanding, this is a fair state.»
From the article of the President of the Republic of Kazakhstan K. K. Tokayev in the newspaper "Egemen Qazaqstan" dated January 5, 2021 "Independence is the most expensive»
From the theory of the origin of the state, we have an idea of different scientific approaches to the definition of a just state, as well as the status and human rights, the rule of law, the restriction of arbitrariness of state authorities, and the principles of separation of powers.
Since gaining independence, our State has been firmly and consistently following the path of building a State governed by the rule of law, where the main goal is to ensure the rights and freedoms of citizens.
In accordance with the current legislation, the judicial authorities, within their competence, provide legal support for the activities of the state, maintain the rule of law in the work of State bodies, organizations, officials and citizens, protect the rights and legitimate interests of citizens and organizations, and in fact are one of the key state authorities.
The implementation of the tasks assigned to the judicial authorities for the legal support of the state's activities is carried out, among others, through the state registration of normative legal acts, since it is at the subordinate level that most of the normative legal acts of state bodies that affect the rights, freedoms and duties of citizens are adopted.
In the process of state registration by the judicial authorities, a legal examination is carried out on the act adopted by the authorized body for compliance with the current legislation, the purpose of which is to prevent infringement of the rights and freedoms of citizens, as well as the interests of private business entities.
The further uniform application of the act in practice depends on the effectiveness of this work. The fact of state registration of the act in the judicial authorities is a necessary condition for its entry into force.
As we have already pointed out above, most legislative initiatives and plans for socio-economic development are implemented by local government bodies, including through the adoption of regulatory legal acts. At the same time, as the President of the Republic of Kazakhstan notes: "No aspect of socio-economic development can be successfully implemented without the rule of law and guaranteeing the security of our citizens. The "hearing State" is, in fact, the concept of building a "Just state". It is not enough just to hear and see the problems of citizens, the main thing is to respond to them correctly and objectively."
Thus, in the Address of the President of the country, the emphasis is placed on building a just state, which requires political changes in the field of human rights protection.
In this regard, special attention will be paid to the development of local self-government, where citizens will be more actively involved in the process of government.
Thus, the next message of the Head of State, as always, inspires confidence in the progressive development of our sovereign country and the justice authorities will actively participate in this work.
