  1. The state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is a state body of the Republic of Kazakhstan, exercising leadership in the field of housing and communal services, passenger transport , highways, Control I of the housing stock, gas and supply and state supervision within the boundaries of the settlements on the objects of social infrastructure in the field of industrial safety compliance with the requirements of safe operation of hazardous technical devices.

The state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan, accounts with the treasury bodies.
  5. The state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" enters into civil law relations on its own behalf.

1 0 . The full name of the state body is the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" .

1 1 . This Regulation is a constituent document of the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" .

1 2 . Financing of the activities of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is carried out from the republican and local budgets.

1 3 . The state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is prohibited from entering into contractual relations with business entities for the performance of duties that are functions of the state institution "Department of housing and communal services, passenger transport, highways and the housing inspection of the Akimat of the Karabalyk region ” .

If the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" is granted the right to carry out income-generating activities by legislative acts, then the income received from such activities is directed to the state budget.

14 . The mission of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is the formation of a full-fledged environment for human life, sustainable development of the infrastructure complex of settlements and territories of the Karabalyk region, provision of activities in the field of transport and communications, management of housing fund and state supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety over compliance with the requirements for the safe operation of hazardous technical devices.

15 . Tasks of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" :

1) organization of maintenance and repair of highways and development of transport and road infrastructure;

2) improving the safety level of the road industry;

3) providing consumers with high-quality communal services, modernizing and increasing the efficiency of the housing and communal services system;

4) creation of a favorable sanitary and epidemiological background for the life of the population;

5) monitoring of the financial and economic activities of subordinate enterprises;

6) operational coordination of all sites (suppliers and consumers) in the stable supply of the district with heat and electric energy, water, fuel, regardless of the form of ownership;

7) ensuring the availability and quality of the provision of public services;

8) state control in the areas of housing stock management, gas and gas supply; 

9) state supervision in the field of industrial safety over compliance with the requirements for the safe operation of hazardous technical devices.

1 6 . Functions of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" :

1) coordination and control of work on preparation of enterprises of the region for work in autumn-winter conditions and in the flood period;

2) the organization of work on the improvement and sanitary cleaning of the settlements of the district, the organization of months of sanitary cleaning;

3) analysis, adjustment and assistance in the implementation of priority programs for the development of infrastructure and housing and communal services of the district;

4) development of a competitive market in the field of housing and communal services, passenger transport and highways;

5) ensuring the organization of measures for the preservation and proper operation of the housing stock;

6) control over the implementation of energy saving measures, development of housing and communal services, passenger transport and highways;

7) interaction with republican and territorial subdivisions of the state examination of projects and licensing bodies;

8) organization of work on the construction, reconstruction, repair and maintenance of public highways of regional significance, in accordance with the legislation of the Republic of Kazakhstan on public procurement and on concessions;

9) development and implementation of programs for housing and communal services, passenger transport and highways;

10) participation in the development and implementation of state energy, housing and communal policies and programs for the development of the infrastructure of the district;

11) coordination of interaction of all participants (suppliers and consumers) in a stable supply of heat, water, gas and electricity, fuel, regardless of the form of ownership;

12) provision of public services in accordance with the legislation;

13) ensuring the availability and quality of the provision of public services;

14) analysis and monitoring of the territory development program for the Karabalyk region ;

15) state supervision in relation to the subjects of supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety over compliance with the requirements for the safe operation of hazardous technical devices, namely, steam and hot water boilers operating at a pressure of more than 0.07 megaPascals and (or) at a water heating temperature of more than 115 degrees Celsius (heat supply organization), vessels operating under a pressure of more than 0.07 megaPascal, lifting mechanisms, escalators, cable cars, funiculars, elevators at social infrastructure facilities;

16 ) state control in relation to subjects of control within the boundaries of settlements at social infrastructure facilities in the areas of housing stock management, gas and gas supply, including for:

16-1 ) compliance with the procedure for choosing the form of management of the condominium object by the owners of apartments, non-residential premises, opening current and savings accounts;

16-2 ) compliance with the procedure for the use, maintenance, operation and repair of the common property of apartment owners, non-residential premises in the facility and territories adjacent to an apartment building;

16-3 ) the presence in multi-apartment residential buildings (residential buildings) of general house metering devices for heat, energy, gas and water resources;

16-4 ) the technical condition of the common property of the condominium object and its engineering equipment, timely execution of works on its maintenance and repair in accordance with the current regulatory and technical and project documents in the field of construction and housing and communal services;

16-5 ) implementation of measures to prepare an apartment building for seasonal operation;

16-6 ) the implementation of the decisions and instructions for the elimination of the identified violations;

16-7 ) holding a competition to determine the design organization and the preparation of design estimates for the overhaul of the common property of the condominium facility at the expense of the local budget;

16-8 ) the quality of work performed on certain types of overhaul of the common property of the condominium object;

16-9 ) compliance with the requirements for the safe operation of household cylinders and objects of gas supply systems for household and municipal consumers within the boundaries of the settlement.

  3. State institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" when exercising state control within the boundaries of settlements at social infrastructure facilities in the areas of housing stock management, gas and gas supply, as well as state supervision in relation to the subjects of supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety for compliance with the requirements for the safe operation of hazardous technical devices, ensures the transparency of its activities by posting on the Internet resource of the local executive body:

1 ) information about objects and subjects of state control and state supervision;

2 ) on the inspection schedules and their results;

3 ) on the identified shortcomings, as well as on the drawn up acts and issued instructions on compliance with the requirements for the safe operation of hazardous technical devices at social infrastructure facilities;

4 ) formation and introduction of a register of formed simple partners within the limits of the settlement;

20 . The rights and obligations of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" :

1) make proposals to the akim and akimat of the district on the main directions of socio-economic development, priorities and strategies for the development of the district;

2) within the limits of their competence, give binding instructions and instructions to contractors;

3) request and receive the necessary information from the departments of the district akim apparatus and other state bodies;

4) to attract specialists from institutions, enterprises, organizations, public formations of the region, in agreement with their leaders, to conduct inspections, examinations and consultations and participate in the work of commissions;

5) make decisions within their competence on the implementation of energy policy, which are binding on all subjects of energy activities in the region;

6) visit energy facilities, road, water and housing and communal services for control purposes, within their competence;

7) take part in the work of advisory commissions and working groups formed for the development, discussion of decisions on financial and credit, investment, privatization, tax policies of the region;

8) provide relevant information to non-governmental structures conducting public monitoring in accordance with the procedure established by legislation;

9) take part in the preparation of regulatory and methodological documents on quality control of the maintenance of the common property of the condominium object, the adjoining land plot of an apartment building and the provision of utilities, and also provides consulting assistance to the owners of controlled objects, enterprises, organizations or citizens who manage and maintain multi-apartment buildings. residential buildings, social infrastructure facilities, including individuals and legal entities on applications received in accordance with the Law of the Republic of Kazakhstan "On the Procedure for Considering Applications of Individuals and Legal Entities";

10) submit documents for state registration of a condominium object in accordance with the Law of the Republic of Kazakhstan " On state registration of rights to real estate " ;

11 ) exercise other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.

  1. Inspections and preventive control of business entities are carried out in accordance with the Entrepreneurial Code of the Republic of Kazakhstan, and inspection of apartments, non-residential premises in accordance with the Law of the Republic of Kazakhstan "On Housing Relations".

 

 

  1. Organization of the activities of the
    state body

 

22 . The management of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" is carried out by the first head, who is personally responsible for the implementation of the State Institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region ” tasks and implementation of its functions.

23 . The first head of the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" is appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.

24 . Powers of the first head of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" :

1) organizes and manages the work of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of the Karabalyk region" ;

2) appoints and dismisses employees of the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" in the manner prescribed by law;

3) without a power of attorney acts on behalf of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of the Karabalyk region" ;

4) in the manner prescribed by law, apply incentive measures and impose disciplinary penalties on employees of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region"

5) signs orders, binding on employees of the state institution "Department of housing and communal services, passenger transport, highways and housing inspection of the Akimat of Karabalyk region" ;

6) represents the interests of the state institution " Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of the Karabalyk District " in state bodies and other organizations;

7 ) exercise other powers in accordance with the legislation of the Republic of Kazakhstan;

The execution of the powers of the first head of the state institution "Department of Housing and Utilities, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" during his absence is carried out by a person replacing him in accordance with the current legislation.

25 . Each inspector of the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" has a personal stamp.

    state body

 

26 . State Institution " Department of housing and communal services, passenger transport, roads and housing inspection akimat Karabalyk district " can have the right of operative management, separate property in the cases , stipulated by the legislation.

The property of the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" is formed at the expense of the property transferred to it by the owner, as well as property (including cash income) acquired as a result of its own activities and other sources, not prohibited by the legislation of the Republic of Kazakhstan.

27 . The property assigned to the state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" refers to communal property.

2 8 . The state institution "Department of Housing and Communal Services, Passenger Transport, Highways and Housing Inspection of the Akimat of Karabalyk District" is not entitled to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
