Position about state institution "Apparatus of akim of Boskol rural district"

1. General Provisions

1. The state institution "Apparatus of akim of the Boskol rural district" is a state body of the Republic of Kazakhstan, which exercises management in the field of information and analytical, organizational, legal and material and technical support of the activities of the akim of the rural district.
2. The state institution "Apparatus of akim of the Boskolsky rural district" has no departments.
3. The state institution "Akim's office of the Boskolsky rural district" carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.   
4. The state institution "Akim's Office of the Boskolsk Rural District" is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan, accounts in the treasury bodies.
5. The state institution "Apparatus of akim of the Boskolsk rural district" enters into civil law relations on its own behalf.
6. The state institution "Apparatus of akim of the Boskolsk rural district" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the law.
7. The state institution "Akim's office of the Boskolsky rural district" on its competence in the manner prescribed by law makes decisions, formalized by the order of the akim of the state institution "Akim's office of the Boskolsky rural district" and other acts provided for by the legislation of the Republic of Kazakhstan.
8. The structure and staffing limit of the state institution "Apparatus of akim of the Boskol rural district" are approved in accordance with the current legislation.
9. Location of the legal entity: 110902, Republic of Kazakhstan, Kostanay region, Karabalyk region, Boskol village.
10. The full name of the state body is the state institution "Apparatus of akim of the Boskol rural district".
    11. This Regulation is a constituent document of the state institution "Apparatus of akim of the Boskol rural district".
11. Financing of the activities of the state institution "Apparatus of akim of the Boskolsky rural district" is carried out from the local budget.

              13 . The state institution "Apparatus of akim of the Boskol rural district" is prohibited from entering into contractual relations with business entities for the performance of duties that are functions of the state institution "Apparatus of akim of the Boskol rural district" .

              If the state institution "Apparatus of akim of the Boskolsk rural district" is granted the right to carry out income-generating activities by legislative acts, then the income received from such activities is directed to the state budget.

2. Mission, main tasks, functions,
   rights and obligations of the state body

14. The mission of the state institution "Apparatus of akim of the Boskolsk rural district" is information-analytical, organizational, legal and material-technical support of the activities of the akim of the rural district.
15. Tasks of the state institution "Apparatus of akim of the Boskol rural district" :

1) implementation of the policy of the President of the Republic of Kazakhstan on the protection and strengthening of state sovereignty, constitutional order, security, territorial integrity of the Republic of Kazakhstan, rights and freedoms of citizens;

2) implementation of the strategy of socio-economic development of the Republic of Kazakhstan, implementation of the main directions of state socio-economic policy and management of social and economic processes in the country;

3) implementation of the constitutional principles of social harmony and political stability, the solution of the most important issues of state life by democratic methods;

4) implementation of measures to strengthen legality and law and order, increase the level of legal awareness of citizens and their active civic position in the social and political life of the country;

5) interaction with public organizations and the media;

6) other tasks provided by the legislation of the Republic of Kazakhstan.
     16. Functions of the state institution "Apparatus of akim of the Boskol rural district" :

1) an explanation of the domestic and foreign policy pursued by the President;

2) ensuring coverage of the activities of the akim in the media, publication of regulatory legal acts;

3 ) plans the work of the apparatus, holds meetings, seminars and other events, organizes their preparation and conduct;

4) prepares draft decisions and orders of the akim of the Boskol rural district;

5) promote the implementation by citizens and legal entities of the norms of the Constitution of the Republic of Kazakhstan, laws, acts of the President and the Government of the Republic of Kazakhstan, normative legal acts of central and local state bodies;  

6) ensures the proper execution and distribution of acts of the akim;

7) organizes, in accordance with plans, office work in the state institution "Apparatus of akim of the Boskolsky rural district" ;

8) considers official documents and applications of individuals and legal entities, organizes a personal reception of individuals and representatives of legal entities by the akim;

9) takes measures aimed at the widespread use of the state language;

              10) carries out work to improve the style and methods of work, the introduction of new information technologies;

11) ensures the availability of standards and regulations of public services;

12) organizes work on landscaping, lighting, landscaping and sanitary cleaning of settlements;

13) performs other functions in accordance with applicable law.

17. Rights and obligations of the state institution "Apparatus of akim of the Boskol rural district" :

1) for the implementation of the main tasks and functions provided for by this Regulation, the state institution "Apparatus of akim of the Boskol rural district" has the right to request and receive the necessary information, documents and other materials from state bodies and officials within the limits of its powers;

2) give explanations to individuals and legal entities on issues within the competence of the state body;

3) The state institution "Apparatus of akim of the Boskolsky rural district" has the right to be a plaintiff and defendant in court.

4) other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.

3. Organization of activities of a state body

18. The management of the state institution "Akim's Office of the Boskolsky rural district" is carried out by the akim of the rural district, who is personally responsible for the implementation of the tasks assigned to the state institution "Akim's office of the Boskolsky rural district" and the implementation of its functions.
19. The head of the state institution "Apparatus of the akim of the Boskolsky rural district" is appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
20. The head of the state institution "Apparatus of akim of the Boskolsky rural district" has no deputies.
21. Powers of the akim of the state institution "Apparatus of akim of the Boskol rural district" :

1) represents the state institution "Akim's office of the Boskolsky rural district" in state bodies and other organizations;

2) develops the Regulation of the state institution "Akim's office of Boskolsky rural district" , submits proposals to the district akimat for approval of the structure and staffing of the state institution "Akim's office of Boskolsky rural district" ;

3) establishes the internal labor regulations in the state institution "Apparatus of akim of the Boskolsky rural district" ;

4) determines the duties and powers of employees of the state institution "Akim's Office of the Boskolsky rural district";

5) in accordance with the procedure established by legislation, appoints, releases and brings to disciplinary responsibility employees of the state institution "Apparatus of akim of the Boskolsky rural district" ;

6) issues decisions and orders, gives instructions that are binding on employees of the state institution "Apparatus of akim of the Boskolsky rural district" ;

7) coordinates the work on monitoring the implementation of the decisions and orders of the akim of the rural district;

8) organizes work with personnel in accordance with the current legislation of the Republic of Kazakhstan;

9) signs official documentation within the limits of his competence;
     10) sends employees of the state institution "Akim's Office of the Boskolsky rural district" on business trips;

11) carry out personal reception of individuals and representatives of legal entities;

12) forms working groups to develop drafts of regulatory legal acts, programs and other documents;

13) disposes of the funds of the state institution "Apparatus of akim of the Boskol rural district" , signs financial documents within its competence;

14) implements gender policy within its competence;

15) conducts the fight against corruption within its competence;

16) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.

The execution of the powers of the akim of the state institution "Akim's Office of the Boskolsky rural district" during his absence is carried out by a person replacing him in accordance with the current legislation.

4. Property of a state body

22. The state institution "Apparatus of akim of the Boskolsky rural district" may have separate property on the basis of operational management in the cases stipulated by law. The property of the state institution "Apparatus of akim of the Boskolsky rural district" is formed at the expense of the property transferred to it by the owner, as well as property (including cash income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
    
         23. The property assigned to the state institution "Akim apparatus of the Boskolsky rural district" refers to communal property.
         24. The state institution "Apparatus of akim of the Boskolsky rural district" is not entitled to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds issued to it under the financing plan, unless otherwise provided by law.

5. Reorganization and abolition of the state body

25. Reorganization and abolition of the state institution "Apparatus of akim of the Boskol rural district" are carried out in accordance with the legislation of the Republic of Kazakhstan.
